1、British Insurance Institute Cargo Clause of Insurance Contract 英國保險(xiǎn)協(xié)會(huì)貨物保險(xiǎn)合同條款（A） (1st January 1982) 第1條 風(fēng)險(xiǎn)條款 Risks Clause 1 This insurance covers all risks of loss of or damage to the subject-matter insured except as provided in clause 4,5,6 and 7 below 本保險(xiǎn)承保除了下述第4、5、6 和7 條規(guī)定的除外責(zé)任以外的保險(xiǎn)標(biāo)的的滅失或損害的一切風(fēng)險(xiǎn)。

2、 第2條 共同海損條款(General Average Clause) 2 This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and /or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those exclude

3、d in Clause4,5,6 and 7 or elsewhere in this insurance. 本保險(xiǎn)承保根據(jù)貨運(yùn)合同及/或管轄的法律和慣例理算或確定的，為避免或與避免任何原因造成的有關(guān)引起共同海損和救助費(fèi)用的損失，但第4，5，6和7條或本保險(xiǎn)其他條文的除外條款除外。 第3條 “互有責(zé)任碰撞”條款(Both to Blame Collision Clause) This insurance is extended to indemnify the Assured against such proportion of liability under the contract of

9、費(fèi)用除外）。 4.6 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel. 因船舶所有人、管理人、承租人或經(jīng)營人的無償付能力或財(cái)務(wù)困境引起的滅失、損害或費(fèi)用。 4.7 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusio

10、n or other like reaction or radioactive force or matter 因使用原子或核裂變和/或聚變或其他類似反應(yīng)或放射性力量或物質(zhì)造成的任何戰(zhàn)爭武器產(chǎn)生的滅失、損害或費(fèi)用。 第5條不適航和不適運(yùn)除外條款 (Unseaworthines and Unfitness Exclusion Clause) 5.1 In no case shall this insurance cover loss damage or expense arising from unseaworthness of vessel or craft, unfitness of ves

11、sel craft conveyance container or lifivan for the safe carriage of the subject-matter insured, where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein. 本保險(xiǎn)在任何情況下均不承保因下述原因所致的滅失、損害或費(fèi)用： 船舶或駁船不適航， 船舶、駁船、運(yùn)輸工具、集裝箱和托盤對(duì)安全運(yùn)輸

12、保險(xiǎn)標(biāo)的不適合，在保險(xiǎn)標(biāo)的被裝上船當(dāng)時(shí)，被保險(xiǎn)人或其雇員對(duì)此種不適航或不適合有私謀。 5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness. 保險(xiǎn)人

13、放棄運(yùn)載保險(xiǎn)標(biāo)的至目的港的船舶不得違反船舶適航和適運(yùn)的任何默示保證，除非被保險(xiǎn)人或其雇員對(duì)此種不適航或不適運(yùn)有私謀。 第6條 戰(zhàn)爭除外條款 (War Exclusion Clause) 6 In no case shall this insurance cover loss damage or expense caused by 6 本保險(xiǎn)在任何情況下均不承保下述原因造成的滅失、損害或費(fèi)用 6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile

14、act by or against a belligerent power 戰(zhàn)爭、內(nèi)戰(zhàn)、革命、叛亂、暴動(dòng)，或由此引起的民間沖突(civil strife)，或來自交戰(zhàn)方或針對(duì)交戰(zhàn)方的任何敵對(duì)行為。 6.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or any attempt thereat 捕獲、扣押、扣留、拘留或羈押（海盜除外），及由此引起的后果或企圖這么做的任何威脅。 6.3 derelict mines torpedoes bombs or

15、 other derelict weapons of war. 丟棄的水雷、魚雷、炸彈或其他被遺棄的戰(zhàn)爭武器。 第7條 罷工除外條款(Strikes Exclusion Clause) 7 In no case shall this insurance cover loss damage or expense( 本保險(xiǎn)在任何情況下均不承保下列滅失、損害或費(fèi)用： 7.1 caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions 由

16、罷工、被迫停工工人或參加工潮、暴亂（riots）民事騷亂（civil commotions）的人員造成者 7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions 罷工、停工、工潮、暴亂或民事騷亂引起者 7.3 caused by any terrorist or any person acting from a political motive. 恐怖分子或出于政治動(dòng)機(jī)而作為的任何人員造成者。 第8條 運(yùn)輸條款(Transit Clause) 8.1 This insurance

17、 attaches from the time the goods leave the warehouse or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either 8.1 本保險(xiǎn)責(zé)任始于貨物運(yùn)離保險(xiǎn)單載明的倉庫或貯存處所開始運(yùn)送之時(shí)，在運(yùn)送的通常過程期間持續(xù)，終止于 8.1.1 on delivery to the Consignees or ot

21、reunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destination. 8.2 如果在最后卸貨港卸離來自海外的船舶后，但在本保險(xiǎn)終止之前，貨物被轉(zhuǎn)運(yùn)至非保險(xiǎn)承保的其他目的地，本保險(xiǎn) 在依然受前述規(guī)定的終止制約的同時(shí)，截止于開始向此種其他目的地運(yùn)送之時(shí)。 8.3 This insurance shall remain in force (

22、subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any variation of the adventure arising from the exercise of a liberty granted to shipowners or

23、charterers under the contract of affreightment. 8.3 在被保險(xiǎn)人不能控制的遲延任何繞航、強(qiáng)制卸貨、重裝或轉(zhuǎn)運(yùn)期間，以及船東或承租人行使根據(jù)貨運(yùn)合同賦予的自由權(quán)引起的海上冒險(xiǎn)的任何變更期間，本保險(xiǎn)仍然有效（但須受上述規(guī)定的終止和下述第9條規(guī)定的制約）。 第9條 運(yùn)輸合同終止條款(Termination of Contract of Carriage Clause) 9 If owing to circumstances beyond the control of the Assured either the contract of carriag

24、e is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is r

25、equested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either 9如果由于被保險(xiǎn)人不能控制的情況，運(yùn)輸合同在保險(xiǎn)單載明的目的地以外的港口或地點(diǎn)終止，或運(yùn)送在上述第8條規(guī)定的交付貨物前另行終止，那么本保險(xiǎn)也終止，除非迅速地通知了保險(xiǎn)人且在本保險(xiǎn)仍有效時(shí)要求繼續(xù)承保，并受保險(xiǎn)人要求的附加保險(xiǎn)費(fèi)的制約： 9.1 until the goods are sold and delivered at such port or

26、 place, or unless otherwise specially agreed, until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichever shall first occur, or 9.1 直至貨物在此種港口或地點(diǎn)出售并交付，或除非另有特別約定，直至承保貨物到達(dá)此種港口或地點(diǎn)滿60天，二者以先性生者為準(zhǔn)，或 9.2 if the goods are forwarded within the said period of 60days (

28、urance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters. 10如果在本保險(xiǎn)責(zé)任開始后，被保險(xiǎn)人變更目的地，應(yīng)按重新商定的保險(xiǎn)費(fèi)率和條件續(xù)保(held covered)，但以迅速通 知了保險(xiǎn)人為前提。 第11條 保險(xiǎn)利益條款(Insurable Interest Clause) 1111.1In order to reco

29、ver under this insurance the Assured must have an insurable interest in the subject-matter insured at the time of the loss. 11.1 為了根據(jù)本保險(xiǎn)索賠，在保險(xiǎn)標(biāo)的損失當(dāng)時(shí)被保險(xiǎn)人必須具有某種可保利益。 11.2 Subject to 11.1 above, the Assured shall be entitled to recover for insured loss occurring during the period covered by this insura

30、nce, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not. 11.2 根據(jù)上述11.1款，被保險(xiǎn)人有權(quán)索賠在本保險(xiǎn)承保期間發(fā)生的承保損失，盡管該滅失發(fā)生于本保險(xiǎn)合同成立之前，除非被保險(xiǎn)人已知悉該滅失，而保險(xiǎn)人不知情。 第12條續(xù)運(yùn)費(fèi)用條款(Forwarding Charges Clause) 12 Where, as a res

31、ult of the operation of a risk covered by this insurance, the insured transit is terminated at a port or place other than that to which the subject-matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading

32、storing and forwarding the subject-matter to the destination to which it is insured hereunder. This Clause 12, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clause 4,5,6 and 7 above, and shall not include charges arising from the fault ne

33、gligence insolvency or financial default of the Assured or their servants. 12 若由于本保險(xiǎn)承保的風(fēng)險(xiǎn)的作用，導(dǎo)致承保的運(yùn)輸在保險(xiǎn)標(biāo)的根據(jù)本保險(xiǎn)承保的目的地以外的港口或地點(diǎn)終止，保險(xiǎn)人將補(bǔ)償被保險(xiǎn)人因卸下、貯存和續(xù)運(yùn)保險(xiǎn)標(biāo)的至所承保的目的地而適當(dāng)和合理發(fā)生的額外費(fèi)用。 對(duì)共同海損和救助費(fèi)用不適用的本條規(guī)定，須受上述第4、5、6和7條所包含的除外責(zé)任的制約，且不包括因被保險(xiǎn)人或其雇員的過錯(cuò)、疏忽、無償付能力或財(cái)務(wù)困境而引起的費(fèi)用。 第13條 推定全損條款(Constructive Total Loss Clause) 1

34、3No claim for Constructive Total Loss shall be recoverable hereunder unless the subject-matter insured is reasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject-matter to the destination

35、 to which it is insured would exceed its value on arrival. 13 除非由于實(shí)際全損看來不可避免，或因?yàn)榛謴?fù)、修復(fù)和續(xù)運(yùn)保險(xiǎn)標(biāo)的至承保的目的地的費(fèi)用，將超過其抵達(dá)時(shí)的價(jià)值，而合理地委付保險(xiǎn)標(biāo)的，推定全損索賠不能獲得賠償。 第14條 增值條款(Increased Value Clause) 14.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shal

36、l be deemed to be increased to the total amount insured under this insurance and all Increased Value insurance covering the loss, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured. In the event of claim the Assured shall provi

37、de the Underwriters with evidence of the amounts insured under all other insurance. 14.1 如果被保險(xiǎn)人對(duì)保險(xiǎn)貨物辦理了增值保險(xiǎn)，貨物的約定價(jià)值應(yīng)視為增加至本保險(xiǎn)和承保滅失的所有增值保險(xiǎn)的保險(xiǎn)金額的總和，本保險(xiǎn)項(xiàng)下的責(zé)任應(yīng)按承保金額占此種保險(xiǎn)金額的總和的比例計(jì)算。 倘若提出索賠，被保險(xiǎn)人應(yīng)向保險(xiǎn)人提供所有其他保險(xiǎn)的保險(xiǎn)金額的證據(jù)。 14.2 Where this insurance is on Increased Value the following clause shall apply: The agre

38、ed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurance covering the loss and effected on the cargo by the Assured,and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.
