住所Address:法定代表人(或主要負(fù)責(zé)人):LegalRepresentative(orPrincipalResponsiblePerson):乙方:(勞動(dòng)者)姓名NameofPartyB(Employee):性別:Sex居民身份證號(hào):IDCardNo:文化程度:EducationBackground住址:Address根據(jù)《中華人民共和國(guó)勞動(dòng)法》、《中華人民共和國(guó)勞動(dòng)合同法》等法律、法規(guī)、規(guī)章的規(guī)定,在平等自愿,協(xié)商一致的基礎(chǔ)上,同意訂立本勞動(dòng)合同,共同遵守本合同所列條款。TheParties,intendingtobeboundhereby,agreetoenterintothisEmploymentContractonthebasisofequality,freewillandmutualconsultationpursuanttotheLaborLawofthePeople’sRepublicofChina(“PRC”),theEmploymentContractLawofthePRCandotherlaws,regulationsandrules.第一條勞動(dòng)合同類(lèi)型及期限TypeandTermoftheEmploymentContract一、勞動(dòng)合同類(lèi)型及期限按下列第項(xiàng)確定。ThetypeandtermoftheEmploymentContractshallbedeterminedassetforthinItem___below:1、固定期限:自年月日起至年月日止。FixedTerm:Fromto;2、無(wú)固定期限:自年月日起至法定的解除或終止合同的條件出現(xiàn)時(shí)止。Open-ended:Fromtothedatewhenastatutoryobligationoragreementtoterminatethecontractarises;or3、以完成一定工作為期限:自年月日起至終止。Project-based:Fromtotheexpirationoftheterm.二、本合同約定試用期,試用期自年月日起至年月日止。ThisContractspecifiesaprobationaryperiodcommencingonandendingon.第二條工作內(nèi)容、工作地點(diǎn)及要求JobDescription,WorkplaceLocationandWorkRequirements乙方從事工作,工作地點(diǎn)在。PartyBshallengageinthejobof,withtheworkplaceTOC\o"1-5"\h\zlocatedat.乙方工作應(yīng)達(dá)到以下標(biāo)準(zhǔn)。根據(jù)甲方工作需要,經(jīng)甲、乙雙方協(xié)商同意,可以變更工作崗位、工作地點(diǎn)。PartyB’sworkshallmeetthefollowingstandards:.PartyB’sjobpositionsandworkplacelocationsmaybechangedwiththeParties’mutualconsentbasedonPartyA’sworkneeds.第三條工作時(shí)間和休息休假WorkingHours,RestandLeaveEntitlements一、工作時(shí)間按下列第項(xiàng)確定:TheworkinghoursshallbedeterminedassetforthinItem___below:1、實(shí)行標(biāo)準(zhǔn)工時(shí)制。乙方每日工作時(shí)間不超過(guò)8小時(shí),每周工作時(shí)間不超過(guò)40小時(shí),每周至少休息一天。Thenormalworkinghourssystemshallbeimplemented.PartyBshallworknomorethan8hoursaday,and40hoursaweek,andshallhaveatleastoneday’sresteachweek.2、實(shí)行經(jīng)勞動(dòng)保障行政部門(mén)批準(zhǔn)實(shí)行的不定時(shí)工作制。Anon-fixedworkinghourssystemshallbeimplementedwiththenecessaryapprovalfromtherelevantlaboradministrationauthorities.3、實(shí)行經(jīng)勞動(dòng)保障行政部門(mén)批準(zhǔn)實(shí)行的綜合計(jì)算工時(shí)工作制。結(jié)算周期:按結(jié)算。Acumulativeworkinghourssystemshallbeimplementedwiththenecessaryapprovalfromtherelevantlaboradministrationauthorities.二、甲方由于生產(chǎn)經(jīng)營(yíng)需要經(jīng)與工會(huì)和乙方協(xié)商后可以延長(zhǎng)乙方工作時(shí)間,一般每日不得超過(guò)一小時(shí);因特殊原因需要延長(zhǎng)工作時(shí)間的,每日不得超過(guò)三小時(shí),但每月不得超過(guò)三十六小時(shí)。甲方依法保證乙方的休息休假權(quán)利。Duetoitsoperationalneeds,PartymayextendPartyB’sworkinghoursuponconsultationwiththeTradeunionandPartyB,providedthattheextendedworkinghoursforagivendayshouldgenerallynotexceedonehour.Ifanextensionofworkinghoursisnecessaryforspecialreasons,theextendedworkinghoursforagivendayshouldnotexceedthreehours,providedthattheextendedworkinghoursforamonthshouldnotexceed36hours.PartyAshallensurethatPartyBwillreceivetheirrestandleaveentitlementsaccordingtothelaw.第四條勞動(dòng)報(bào)酬及支付方式與時(shí)間WorkRemuneration,PaymentMethodandDateofPayment.一、乙方試用期間的月勞動(dòng)報(bào)酬為元。ThemonthlyremunerationpayabletoPartyBduringtheprobationaryperiodshallbeRMB.二、試用期滿(mǎn)后,乙方在法定工作時(shí)間內(nèi)提供正常勞動(dòng)的月勞動(dòng)報(bào)酬為元,或根據(jù)甲方確定的薪酬制度確定為。Aftertheexpirationoftheprobationaryperiod,themonthlyremunerationforPartyB’sperformanceofhisnormallaborobligationswithinstatutoryworkinghoursshallbeRMB,orRMBdeterminedunderPartyA’sremunerationpolicies.乙方工資的增減,獎(jiǎng)金、津貼、補(bǔ)貼、加班加點(diǎn)工資的發(fā)放,以及特殊情況下的工資支付等,均按相關(guān)法律法規(guī)及甲方依法制定的規(guī)章制度執(zhí)行。甲方支付給乙方的工資不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。PartyB’swageincrease/decrease,bonuses,allowancesandsubsidies,andovertimewages,aswellasthewagepaymentinspecialcircumstances,shallbegovernedbyrelevantlawsandregulationsandPartyA’sinternalrulesandpolicies.ThewagespaidbyPartyAtoPartyBshallnotbelessthantheminimumwagestandardstipulatedbythepeople’sgovernmentwheretheemployerislocated.三、甲方的工資發(fā)放日為每月日。甲方應(yīng)當(dāng)以貨幣形式按月支付工資,不得拖欠。PartyAwillpaywagestoPartyBonthe___thdayofeachmonth.PartyAshallwagesinmonetaryformonamonthlybasis,withoutdelay.四、乙方在享受法定休假日以及依法參加社會(huì)活動(dòng)期間,甲方應(yīng)當(dāng)依法支付工資。DuringanyperiodwhenPartyBparticipatesinanysocialactivitieswhichcitizensarerequestedtoperformfornationalorpublicinterests,duringstatutoryworkinghours,PartyAshallpaywagestoPartyBaccordingtothelaw.第五條社會(huì)保險(xiǎn)SocialInsurance甲、乙雙方必須依法參加社會(huì)保險(xiǎn),按月繳納社會(huì)保險(xiǎn)費(fèi)。乙方繳納部分,由甲方在乙方工資中代為扣繳。PartyaandPartyBmustparticipateinsocialinsuranceandpaysocialinsurancepremiumsonamonthlybasisinaccordancewiththelaw.TheamountpayablebyPartyBshallbewithheldbyPartyBfromthePartyA’smonthlywages.第六條勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)LaborProtection,WorkingConditionsandProtectionsAgainstOccupationalHazards甲乙雙方都必須嚴(yán)格執(zhí)行國(guó)家有關(guān)安全生產(chǎn)、勞動(dòng)保護(hù)、職業(yè)衛(wèi)生等規(guī)定。有職業(yè)危害的工種應(yīng)在合同約定中告知,甲方應(yīng)為乙方的生產(chǎn)工作提供符合規(guī)定的勞動(dòng)保護(hù)設(shè)施、勞動(dòng)防護(hù)用品及其他勞動(dòng)保護(hù)條件。乙方應(yīng)嚴(yán)格遵守各項(xiàng)安全操作規(guī)程。甲方必須自覺(jué)執(zhí)行國(guó)家有關(guān)女職工勞動(dòng)保護(hù)和未成年工特殊保護(hù)規(guī)定。ThePartiesmuststrictlyimplementrelevantnationaloccupationalsafety,laborprotectionandoccupationalsanitationproceduresandstandards.Anyjobexposedtooccupationalhazardsshallbespecifiedinthecontract,andPartyAshallprovidePartyBwithworksafetyandhygienefacilities,laborprotectionequipmentandothernecessaryconditionsforPartyB’sworkactivities.PartyBmuststrictlycomplywiththeworkdisciplines,operatingproceduresandsafetyrulessetbyPartyA.PartyAmustconscientiouslycarryoutrelevantprovisionsformulatedbythestatefortheprotectionoffemaleandunder-agedemployees,第七條勞動(dòng)合同變更、解除、終止Modification,CancellationandTerminationtheEmploymentContract一、經(jīng)甲乙雙方協(xié)商一致,可以變更勞動(dòng)合同相關(guān)內(nèi)容。變更勞動(dòng)合同,應(yīng)當(dāng)采用書(shū)面形式。變更后的勞動(dòng)合同文本由甲乙雙方各執(zhí)一份。ThePartiesmaymodifyrelevanttermsoftheEmploymentContractwheretheyhaveagreedtodosothroughmutualconsultationandagreement.二、經(jīng)甲乙雙方協(xié)商一致,可以解除勞動(dòng)合同。ThePartiesmayterminatetheEmploymentContractwheretheyhaveagreedtodosothroughmutualconsultationandagreement.三、乙方提前三十日以書(shū)面形式通知甲方,可以解除勞動(dòng)合同。乙方在試用期內(nèi)提前三日通知甲方,可以解除勞動(dòng)合同。PartyBmayterminatetheEmploymentContractwith30dayspriorwrittennoticetoPartyA.PartyBmayterminatetheEmploymentContractduringtheprobationaryperiodwith3days’writtennoticetoPartyA.四、甲方有下列情形之一的,乙方可以解除勞動(dòng)合同:PartyBmayterminatehisemploymentcontractunderanyofthefollowingcircumstancesinvolvingPartyA:TOC\o"1-5"\h\z1、未按勞動(dòng)合同約定提供勞動(dòng)保護(hù)或者勞動(dòng)條件的;WherePartyAhasfailedtoprovidelaborprotectionorworkingconditionsasstipulatedintheemploymentcontract;2、未及時(shí)足額支付勞動(dòng)報(bào)酬的;WherePartAhasfailedtopayremunerationontimeorinfull;3、未依法繳納社會(huì)保險(xiǎn)費(fèi)的;WherePartyAhasfailedtocontributesocialinsurancepremiumsonbehalfofPartyBinaccordancewiththelaw;章制度違反法律、法規(guī)的規(guī)定,損害乙方權(quán)益的;WherePartyA’spoliciesviolatelawsorregulations,therebyinfringinguponPartyB’srightsandinterests;5、以欺詐、脅迫的手段或乘人之危,使乙方在違背真實(shí)意思的情況下訂立或者變更勞動(dòng)合同致使勞動(dòng)合同無(wú)效的;WherePartyAha
