RMB___________。租約期滿,乙方如不再續(xù)租,甲方應(yīng)在租賃期結(jié)束后叁日內(nèi) (在乙方將全部水,電,煤氣費和中央空文案大全實用文案調(diào)費等雜費及電話費付清后)將押金退還(不計利息)。如因賬期原因,乙方承擔(dān)的全部水,電,煤氣費和中央空調(diào)費等雜費及電話費無法在柒日內(nèi)付清,甲方有權(quán)保留部分押金并在上述項目付清后返回剩余押金給乙方,但保留的押金部分不因超過上一賬期應(yīng)付額的二倍。ThedepositisRMB___________intotal.Oncompletionofthetenancycontract,ifPartyBwillnotcontinuetorenttheleasedproperty,PartyAmustreturnthedepositinfulltoPartyB(withoutinterest)withinthreedaysaftertheterminationofthecontractundertheconditionthatPartyBhaspaidalltheoutstandingutilitiesfeesuchaswater,electricity,gas,centralair-conditioningfeeandtelephonebill.Ifsuchoutstandingutilitiesfeescouldnotbesettledduetothetimelimitofitsaccountwithin7days,PartyAhastherighttokeeppartofthedepositandpaybackthebalancetoPartyBaftertheoutstandingutilitiesfeeissettled.Howeverthekeptpartofdepositshouldbelimitedtotwicetheamountofthepreviousbillingperiod.2、甲方因乙方違反本合同的規(guī)定而受的損失,可在保證金中扣抵合理數(shù)目,在甲方作出該種抵扣前,需通知乙方將被抵扣的金額和理由,乙方有權(quán)拒絕不合理或不公正的抵扣。如果保證金不足以支付前述金額的,不足部分乙方必須在接到甲方付款通知后7天內(nèi)補足。PartyAmaydeductareasonableamountfromthesecuritydeposittowardspaymentofanyactualdamagesPartyAmayhaveincurredorsufferedasaresultofPartyB'sbreachofthisAgreement.Priortomakingsuchdeductions,PartyAshallinformPartyBoftheamount,andthereasonformakingsuchdeductions.PartyBshallbeentitledtoobjecttosuchdeductionsifPartyBbelievesthatsuchdeductionsareunreasonableorunjustified.Ifthesecuritydepositisnotsufficienttocoversuchamounts;PartyBmustpaythedeficiencywithinseven(7)daysofthereceiptofademandfromPartyA.第五條:其它費用 、______________.2、乙方所用電話,按電信局標(biāo)準(zhǔn)收費,每月根據(jù)實際用量結(jié)算,乙方按單繳付。AlltelephonechargesshallbepaidbyPartyBandbasedontheactualusageaccordingtotheTelecommunicationBureaustandardtariffsonreceiptofthebills.3、甲方承擔(dān)在租賃期內(nèi)的物業(yè)管理費,供暖費 _______________、_______________。Duringtheperiodoftenancy,PartyAshallpaypropertymanagementfee,heatingfee________________ 、_______________.第六條:甲方的責(zé)任Landlord’sResponsibilities :1、本租約簽訂后,甲方不得無故收回房屋。租賃期內(nèi),甲方需提前收回該房屋的,應(yīng)提前30日通知乙方,將已收取的租金余額退還乙方并按月租金的_____%支付乙方違約金。PartyAisnotpermittedtotakebacktheleasedpropertyduringthetermofcontractwithoutanyreason.Duringthetermofcontract,PartyAshallinformPartyB30daysinadvanceincasePartyAneedstoreclaimthepremiseinadvanceandPartyAshallreturnthebalanceofthecollectedrenttoPartyBandpaydefaultfineequalto_____%ofthemonthlyrenttoPartyB.2、甲方應(yīng)保證物業(yè)公司向乙方提供足夠的服務(wù),如冷水、熱水、電的供應(yīng)及各種設(shè)備的正常工作。甲方應(yīng)負責(zé)租賃期內(nèi)房屋及其設(shè)備的正常維修,并承擔(dān)維修房屋及設(shè)備的正常磨損而產(chǎn)生的費用。 PartyAshallensurethattheestatemanagementofficeprovidessufficientandtimelyservicetoPartyB,文案大全實用文案suchassupplyofcoldwater,hotwater,electricityandensurethepropermaintenanceofallkindsofequipment.PartyAshallberesponsibleforallnormalmaintenanceoftheleasedpropertyandequipmentduringthetermlease,andPartyAshallbearallmaintenancecharges.3、甲方應(yīng)對甲方的固定設(shè)施,包括該物業(yè)的結(jié)構(gòu)、屋頂、管道、設(shè)施、排污、管道和纜線(包括電力及電話)等進行維護,使之處于完好狀態(tài);如果對上述各項的造成的損壞或破壞,不是由乙方的疏忽或不良行為造成的,則甲方在收到乙方發(fā)出的通知后7天內(nèi)修理或修繕該損壞處。TomaintainandkeepPartyA’sfixtures,includingthestructure,roof,sanitaryandplumbingfacilities,drains,pipesandcables(includingelectricityandtelephone)ingoodconditions.PartyAshouldpromptlyrepairorremedyanydefectsthereinafterbeingnotifiedofsuchdefectsbyPartyB,providedallsuchdefectsarenotasaresultofthePartyB’scarelessmistakeormisconduct.PartyAshalldothenecessaryrepairsormaintenancewithinsevendaysafterreceivingthenoticefromPartyB.4、如果甲方未能在規(guī)定時間內(nèi)修理,乙方可以自行請人維修,維修的費用由甲方承擔(dān),乙方可以從應(yīng)支付給甲方的房租中扣除。IfPartyAfailtodonecessaryrepairsinstatedtimePartyBshallhaveathirdpartytorepairandthefeeshallbebornebyPartyA.PartyBcandeductthefeefromtherentwhichshallbepaidtoPartyA.(newadded)5甲方謹(jǐn)在此聲明及保證甲方為出租房屋的合法擁有人并有合法地位出租此房屋于乙方。PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowneroftheleasedpropertyandhasthenecessarylegalcapacitytoleasethepropertytoPartyB.6、所有權(quán)變動:租賃期內(nèi)該房屋所有權(quán)發(fā)生變動的,甲方須保證本文案大全實用文案合同在乙方與新所有權(quán)人之間具有法律效力,否則視為甲方違約,甲方應(yīng)向乙方承擔(dān)xxx月租金作為違約金。Transferingoftheownership:Incasetheownershipofthepremisechangesduringtheleaseperiod,PartyAshallguaranteethattheContractshallbekepteffectivebetweenPartyBandthenewowner.otherwiseit ’sdeemedthatPartyAbreachthecontractandPartyAshallpayapenaltyofxxxmonth ’srental.第七條:乙方責(zé)任Tenant’sResponsibilities :1、乙方應(yīng)按本租約第三、五條約定,按期交納租金及其他費用。如乙方遲延支付,超過期限五個工作日,則甲方有權(quán)解除本租約。PartyBshouldpromptlypaytherent,depositandotherchargesassetoutinClauses3and5oftheAgreement.IntheeventthatPartyBdelaystopaytherentforfiveworkingdays,PartyAhastherighttoterminatethecontract.2、未經(jīng)甲方書面同意,乙方不得將所租房屋分租或轉(zhuǎn)租給第三方及與第三方以任何方式共用該房屋;若出現(xiàn)上述情形,則甲方有權(quán)解除本租約,房客的家庭成員及朋友的短暫居住或拜訪除外。DuringtheperiodofTenancy,unlesswithwrittenconsentfromPartyA,PartyBshallnottransferorsubleasethePropertyinwholeorinpartorinanymannerwhatsoeversharetheusethereofincommonorjointlywithanythirdparty.OtherwisePartyAhastherighttoterminatetheAgreement.Thisexcludesthestayingoffamilyandfriendsforshortterm.3、乙方應(yīng)愛護房屋及其設(shè)備,如因使用不當(dāng)而導(dǎo)致?lián)p壞,乙方應(yīng)負責(zé)賠償。PartyBmusttakegoodcareofthepropertyanditscontents,otherwisePartyBshouldpaycompensationtoPartyAforhisimproperuseoftheproperty.4、除房內(nèi)已有的裝飾和設(shè)施之外,乙方如要增加設(shè)備或其他裝修須征得甲方同意。租賃期滿,乙方向甲方交還房產(chǎn)時,必須恢復(fù)其原狀文案大全實用文案(正常磨損除外)。Inadditiontothedecorationandequipmentalreadyintheproperty,ifPartyBwishestomakeanyalterationsordecorationtotheproperty,PartyBshouldgettheconsentofPartyA.OncompletionoftheLease,PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition(exceptforitsnormalwear&tear).5、在未經(jīng)甲方書面同意下,乙方不得擅自設(shè)立、安裝或移動設(shè)施及設(shè)備,不能擅自設(shè)立隔斷,不得擅自對房屋的結(jié)構(gòu)改動或增加。Nottoerect,installorremoveanyfixturesorpartitioning,ortomakeanystructuraladditionsandalterationswithoutthepriorwrittenconsentofPartyA.6、租賃房屋過程中,乙方必須遵守中華人民共和國的有關(guān)法律、細則、規(guī)章及法令的規(guī)定,禁止利用房屋進行違反法律及不道德的行為。PartyBmustcomplyandadhereintheuseoftheleasedpropertyaccordingtoalllaws,regulationsanddecreesofthePeople’sRepublicofChina.Theleasedpropertyisnottobeusedforanypurposethatisunlawfulorimmoral.7、房屋除供乙方居住之外,未經(jīng)甲方書面同意,房屋不可作辦公或協(xié)議未曾說明之用。Theleasedpropertyisonlyforresidentialuse.PartyBshallnotusetheleasedpropertyasofficeorsomeotherpurposeswithoutthewrittenagreementofPartyA.8、租賃期內(nèi),乙方需提前退租,應(yīng)提前 30天通知甲方并且支付甲方違約金。Duringthetermofcontract,IfpartyBterminatestheTenancyAgreement,PartyBshallinformParty30daysinadvanceandshallpayapenaltyof XXX toPartyA.TherewasdiscrepacybetweenChineseandEnglish.IrevisedboththeEnglishpartandChinesepart.Pleasehavealook.第八條:房屋不能居住時,房屋由于火災(zāi)、惡劣天氣、戰(zhàn)爭或其它甲方不可抗拒因素,而不是因為乙方直接或間接的疏忽及故意行為造成文案大全實用文案房屋毀壞而不能被正常使用及居住時,乙方從該日起停止支付租金,直至房屋可再被使用及居住時為止。Whenthepropertyisunfitforuseoroccupation ,Iftheleasedpropertyaresubstantiallydestroyedordamagedbyfire,badweather,war,forcemajeure,orothercausesbeyondthecontrolofPartyAandnotattributabledirectlyorindirectlytothenegligenceormaliceofPartyBorareotherwiserenderedunfitforuseoroccupation,therentshallceasetobepayablefromthedatetheleasedpropertybecomeunfitforuseoroccupationuntiltheleasedpropertyshallagainberenderedaccessibleandfitforuse.第九條:本合同適用中華人民共和國法律;如在合同執(zhí)行過程中有爭議,雙方應(yīng)當(dāng)進行協(xié)商;如協(xié)商無法解決,因本合同引起的或與本合同有關(guān)的任何爭議,均提請華南國際經(jīng)濟貿(mào)易仲裁委員會按照該會仲裁規(guī)則進行仲裁。仲裁裁決是終局的,對雙方均有約束力。ThisContractwillbeinterpretedinaccordancewiththelawofthePeoplesRepublicofChina.AlldisputesarisingfromorinconnectionwiththisContractshallbesubmittedtoSouthChinaInternationalEconomicandTradeArbitrationCommissionforarbitrationinaccordancewithitsrulesofarbitrationineffectatthetimeofapplyingforarbitration.Thearbitralawardisfinalandbindinguponbothparties第十條:其它 Others:1、本租約附件是本租約不可分割的組成部分。Theappendixformsareaninternalpartofthecontract.2、居間方已告知甲方到當(dāng)?shù)囟悇?wù)機關(guān)納稅,并已告知乙方到當(dāng)?shù)嘏沙鏊k理臨時居住證明。甲方自行承擔(dān)稅費。PartyAhasbeenacknowledgedbytheAgencytopaythepersonaltaxatlocaltaxoffice.PartyBhasalsobeenacknowledgedbytheAgencytoapplyTheTemporaryResidentialCertificateatlocalpoliceoffice.PartyAshallbearthetax.3、合同經(jīng)甲、乙雙方簽字蓋章后生效。本合同(及附件)壹式叁份,其中甲方、乙方、居間經(jīng)紀(jì)方各執(zhí)壹份。中英文具同等法律效力。中英文條款及意思如有不一致之處,以中文為準(zhǔn)。文案大全實用文案TheContractshalltakeeffectafterPartyAandPartyBsignandaffixseals.TheContract(includingtheappendices)hasthreecopies.PartyA,PartyBandtheagencykeeponeeachasproof.BothChinesetextandEnglishtextshallhavethesamelegaleffect.Intheevent
