2014版安全生產(chǎn)法深度解讀一、明確了立法目的和調(diào)整范圍1、明確立法目的:明確規(guī)定為了加強安全生產(chǎn)工作?預防和減少生產(chǎn)安全事故?保障人民群眾生命健康和財產(chǎn)安全?促進經(jīng)濟社會和諧發(fā)展?根據(jù)憲法?制定本法。2、調(diào)整范圍:,1,刪除了有關(guān)法律、行政法規(guī)對消防安全和道路交通安全、鐵路交通安全、水上交通安全、民用航空安全另有規(guī)定的?適用其規(guī)定的內(nèi)容。,2,規(guī)定學校、幼兒園、醫(yī)院、公園等公益性單位的安全生產(chǎn)?參照本法的規(guī)定執(zhí)行。二、完善安全工作方針和機制1、 關(guān)于安全生產(chǎn)工作方針:將現(xiàn)行法規(guī)定的“安全生產(chǎn)管理?堅持安全第一、預防為主的方針”?修改為如下:安全生產(chǎn)應當以人為本?堅持安全第一、預防為主、綜合治理的方針?建立政府領(lǐng)導、部門監(jiān)管、單位負責、群眾參與、社會監(jiān)督的工作機制。2、 規(guī)范了建設(shè)項目安全設(shè)施設(shè)計審查的程序規(guī)定高危建設(shè)項目的安全設(shè)施設(shè)計應當報安全生產(chǎn)監(jiān)督管理部門或者有關(guān)部門審查同意后方可開始施工。審查部門及其負責審查的人員對審查結(jié)果負責。負責審查的安全生產(chǎn)監(jiān)督管理部門或者有關(guān)部門應當自收到安全設(shè)施設(shè)計后四十五日內(nèi)作出審查意見書?并書面通知建設(shè)單位。審查不得收取任何費用。安全風險較大的建設(shè)項目的安全設(shè)施設(shè)計應當報安全生產(chǎn)監(jiān)督管理部門或者有關(guān)部門備案?安全生產(chǎn)監(jiān)督管理部門或者有關(guān)部門應當進行抽查。4、 新增了監(jiān)理單位的責任規(guī)定工程監(jiān)理單位對高危建設(shè)項目應當審查施工組織設(shè)計中的安全技術(shù)措施或者專項施工方案是否符合相關(guān)標準?并對建設(shè)工程安全生產(chǎn)承擔監(jiān)理責任。6、 加強生產(chǎn)經(jīng)營單位安全文化建設(shè)生產(chǎn)經(jīng)營單位應當加強安全文化建設(shè)?建立完善安全生產(chǎn)績效考核獎懲制度?促進從業(yè)人員遵章守紀。生產(chǎn)經(jīng)營單位應當組織從業(yè)人員每月至少開展一次安全生產(chǎn)知識方面的宣傳教育活動?培養(yǎng)從業(yè)人員安全生產(chǎn)意識、習慣和技能。安全生產(chǎn)活動情況應當記錄備查。生產(chǎn)經(jīng)營單位的車間,區(qū)隊,應當每周至少召開一次安全會?分析安全生產(chǎn)情況,班組應當每日召開一次班前會?并對所轄作業(yè)區(qū)域至少進行一次安全巡查?查明作業(yè)場所和工作崗位可能存在的重大危險和事故隱患?提出防范和整改措施。車間,區(qū)隊,安全會、班組安全巡查情況應當記錄備查。3、 建立全國統(tǒng)一的生產(chǎn)安全事故應急救援信息系統(tǒng)國務(wù)院安全生產(chǎn)監(jiān)督管理部門應當建立全國統(tǒng)一的生產(chǎn)安全事故應急救援信息系統(tǒng)?國務(wù)院有關(guān)部門應當建立健全相關(guān)專業(yè)的生產(chǎn)安全事故應急救援信息系統(tǒng)?？h級以上地方各級人民政府應當建立或者確定本行政區(qū)域統(tǒng)一的生產(chǎn)安全事故應急救援信息系統(tǒng)。生產(chǎn)安全事故應急救援信息系統(tǒng)應當與各級人民政府建立的突發(fā)事件信息系統(tǒng)實現(xiàn)互聯(lián)互通、信息共享。2、 國家加強應急能力建設(shè)國家建立礦山、危險物品、公路交通、鐵路運輸、水上搜救、油氣田事故應急救援基地和應急救援隊伍?？h級以上地方各級人民政府應當根據(jù)本地區(qū)安全生產(chǎn)的特點?建立或者確定相應的專業(yè)應急救援隊伍?并配備必要的設(shè)備、設(shè)施和器材。3、 增設(shè)了生產(chǎn)經(jīng)營單位主要負責人安全職責的內(nèi)容生產(chǎn)經(jīng)營單位主要負責人負有確定符合條件的分管安全生產(chǎn)的負責人、技術(shù)負責人?組織開展本單位的安全生產(chǎn)教育培訓和應急演練工作?組織開展安全生產(chǎn)標準化建設(shè)?實施本單位的職業(yè)危害預防工作?保障從業(yè)人員的職業(yè)健康等職責?并且應當每年向職工代表大會、職工大會、股東大會報告?接受監(jiān)督。2、 新增高危企業(yè)安全生產(chǎn)管理人員資格準入制度礦山、冶金、軌道交通運營、道路交通運營、建筑施工單位?危險物品的生產(chǎn)、經(jīng)營、儲存單位和使用危險物品從事生產(chǎn)并且使用量達到規(guī)定數(shù)量的單位的專職安全生產(chǎn)管理人員應當具有注冊安全工程師資格和三年以上相應工作經(jīng)歷。3、
