2024版勞務(wù)派遣合同中英文2024LaborDispatchContractPartyA(Employer):__________PartyB(LaborDispatchUnit):__________鑒于PartyArequireslaborservicesduetobusinessdevelopmentandworkneeds,andintendstoemploylaborservicesthroughPartyB'sdispatch.PartyB,asalabordispatchunitwithcorrespondingqualifications,agreestoprovidelabordispatchservicesaccordingtotheneedsofPartyA.Toclarifytherightsandobligationsofbothparties,thisLaborDispatchContractisherebyconcludedbymutualagreement.Chapter1GeneralProvisionsArticle1PurposeoftheContractThepurposeofthiscontractistoclarifytherights,obligations,andresponsibilitiesofbothPartyAandPartyBinthelabordispatchcooperationtoensurethesmoothprogressofthelabordispatchwork.Article2LegalEffectoftheContractThiscontractshallcomeintoeffectfromthedatewhenitissignedandsealedbytheauthorizedrepresentativesofbothpartiesandshallhavelegalbindingforceonbothparties.Chapter2LaborDispatchContentArticle3DispatchedPositionsandNumberofPeoplePartyA,accordingtobusinessneeds,entrustsPartyBtodispatchlaborerswhomeetthefollowingconditionstoworkforPartyA:PositionName:__________;NumberofPeople:__________;PositionRequirements:__________.Article4DispatchPeriodThedispatchperiodshallbefrom__________to__________.Chapter3RightsandObligationsArticle5RightsandObligationsofPartyAPartyAhastherighttosuperviseandguidetheworkofthedispatchedlaborers.PartyAshallpaythelabordispatchfeestoPartyBasagreed.PartyAshallprovidelaborconditionsandlaborprotectioninaccordancewithnationalregulationsforthedispatchedlaborers.Article6RightsandObligationsofPartyBPartyBisresponsiblefortherecruitment,training,anddailymanagementofdispatchedlaborers.PartyBshallensurethatthedispatchedlaborersmeetthepositionrequirementsofPartyA.PartyBshallpaythewagesofthedispatchedlaborersontimeandpaysocialinsuranceforthemaccordingtolaw.Chapter4LaborRemunerationandPaymentArticle7LaborRemunerationThelaborremunerationincludesthewagesofthedispatchedlaborers,socialinsurancefees,managementfeesofPartyB,etc.,withthespecificamountbeing__________.Article8PaymentMethodPartyAshallpaythelaborremunerationtothedesignatedaccountofPartyBbythe__________dayofeachmonth.Chapter5BreachofContractLiabilityArticle9BreachofContractLiabilityIfPartyAfailstopaythelaborremunerationontime,itshallpayliquidateddamagestoPartyBattherateof__________%oftheunpaidamount.IfthedispatchedlaborerssentbyPartyBdonotmeettheagreedconditionsorareunabletoperformthework,PartyBshallbearthecorrespondingliabilityforbreachofcontract.Chapter6ContractModification,Rescission,andTerminationArticle10ContractModificationOncethecontractissigned,neitherpartymayunilaterallymodifythecontentofthecontractwithouttheconsentofbothparties.Article11ContractRescissionBothpartiesmayrescindthecontractbymutualagreement.Apartyintendingtorescindthecontractshallnotifytheotherpartyinwriting__________daysinadvance.Article12ContractTerminationThecontractshallterminateupontheexpirationoftheterm.Thecontractshallterminatewhentheconditionsforterminationagreedbybothpartiesaremet.Chapter7DisputeResolutionArticle13DisputeResolutionIncaseofanydisputearisingfromtheperformanceofthecontract,thepartiesshallfirstresolveitthroughnegotiation;ifnegotiationfails,itmaybesubmittedtothe__________ArbitrationCommissionforarbitration,orfiledwiththePeople'sCourtforlitigation.Chapter8SupplementaryProvisionsArticle14OtherAgreements__________.Article15EffectivenessoftheContractThiscontractshallcomeintoeffectfromthedateofsigningandsealingbytheauthorizedrepresentativesofbothparties.Article16NumberofContractCopiesThiscontractismadeintwocopies,eachpartyholdingonecopy,withthesamelegaleffect.PartyA(Seal):__________PartyB(Seal):__________AuthorizedRepresentativeSignature:__________AuthorizedRepresentativeSignature:__________Date:__________Date:____________________(Endofthetext)Chapter9AnnexandSupplementaryInstructionsArticle17AnnexCopyofPartyB'sbusinesslicenseandlabordispatchqualificationcertificate;Listofdispatchedworkersandtheirpersonalqualifications;Detaileddescriptionoflaborremunerationandpaymentcycle;SpecificjobrequirementsandworkdescriptionprovidedbyPartyAfordispatchedworkers;Anyotherrelevantdocumentsagreeduponbybothparties.Article18BreachofContractandDeterminationPartyA'sfailuretopaylaborremunerationaccordingtotheagreedtimeandamount,andafterbeingremindedinwritingbyPartyB,stillfailstopaywithinareasonableperiod,isconsideredabreachofcontract.PartyBdispatchesworkerswhodonotmeetthecontractconditionsorcannotcompletetheassignedwork,andafterbeingnotifiedinwritingbyPartyA,failstoreplaceorcorrectwithinareasonableperiod,isconsideredabreachofcontract.Anypartyviolatesothertermsofthecontractanddoesnottakeremedialmeasureswithinareasonableperiodafterbeingnotifiedinwritingbytheotherparty,isconsideredabreachofcontract.Article19LegalTermsandInterpretationsLaborDispatch:Referstotheactwherealabordispatchunitestablishesalaborrelationshipwithworkersandthendispatchesthemtoanemployerforagreedwork.Employer:Referstotheunitthatacceptsworkersdispatchedbyalabordispatchunitandarrangestheirwork.ForceMajeure:Referstounforeseeable,unavoidable,andinsurmountableobjectivecircumstances,suchasnaturaldisasters,wars,etc.,thatresultinthecontractbeingunabletobeperformedorpartiallyperformed.Article20ProblemsEncounteredDuringImplementationandSolutionsIfPartyAneedstochangethejobpositionorcontentoftheworker,itshouldconsultwithPartyBinadvanceandsignawrittensupplementaryagreement.IftheworkerdispatchedbyPartyBcannotperformtheirdutiesduetospecialreasons,theyshouldnotifyPartyAintimeandconsultonothersolutions.Bothpartiesshouldestablishaneffectivecommunicationmechanism,regularlychecktheimplementationofthecontract,andresolveissuesarisinginthecooperationprocessinatimelymanner.Article21AllApplicationScenariosThiscontractisapplicabletovariousindustriesandfieldswhereemployersneedtemporary,auxiliary,oralternativelabordispatch.Thiscontractisapplicabletofull-time,part-time,seasonal,andotherformsoflabordispatch.Thiscontractisapplicabletoenterprises,institutions,socialorganizations,individualeconomicorganizations,andotherorganizationswithlaborneeds.Chapter10SpecialAgreementsArticle22SpecialAgreementsPartyBshallensurethelegalrightsandinterestsofthedispatchedworkers,includingbutnotlimitedtowagepayment,restandvacation,laborprotection,etc.PartyAshallprovidelaborconditionsandlaborsafetyandhealthfacilitiesinaccordancewithnationalregulationsfordispatchedworkers.Bothpartiesshallcomplywiththelatestnationallawsandregulationsonlabordispatchandadjustthecontentofthecontractinatimelymanneraccordingtochangesinlawsandregulations.Article23ContractModificationandSupplementAnymodificationorsupp
