1、重大責任事故罪論文：論重大責任事故罪的法定刑【中文摘要】本文立足當前我國社會生產(chǎn)生活中責任事故頻發(fā)的 現(xiàn)實狀況，對重大責任事故罪的法定刑進行了專題研究。采用比較的 方法對國內外的重大責任事故罪法定刑規(guī)定進行分析,結合重大責任 事故罪的特點，從刑罰功能的角度對本罪的法定刑完善進行研究。通 過比較分析得岀我國當前重大責任事故罪法定刑立法不足之處，指出 其違背法定刑設置根據(jù)及設置原則，并提出完善建議。以期通過完善 重大責任事故罪的法定刑來提高刑法保障生產(chǎn)、經(jīng)營安全的功能，從 而更好的適應社會主義經(jīng)濟建設的需要。法定刑包括刑種和刑度兩個 方面，關于法定刑的設置根據(jù)大概有三種觀點，即報應論，功利論以及

2、報應優(yōu)先兼顧功利的綜合論，本文結合當前學者觀點,對綜合論著重 從客觀方面犯罪行為的危害性以及主觀方面犯罪人的人身危險刑兩 個方面進行分析，得出法定刑設置的合理根據(jù)。關于法定刑設置原則 將主要介紹明確性原則，罪刑均衡原則及公正合理原則。具體到重大 責任事故罪的法定刑，也應該遵循法定刑的-般原理。從建國至今， 重大責任事故罪的法律規(guī)定也發(fā)生了一系列的變化，通過對重大責任 事故罪的立法規(guī)定進行梳理,可以更好的探索立法本意，能夠止確的 認識和理解重大責任事故罪。目前我國重大責任事故罪的法定刑規(guī)定 無論是從刑種方面還是刑度方面都是與本罪的性質不適應的,違背了 法定刑設置原則及配置根據(jù)。他山之石，可以攻玉

3、。法國、俄羅斯、 荷蘭、日本四國的刑法在責任事故類犯罪的法定刑設置上除了注重刑 種的多樣性如設置罰金刑、資格刑、自由刑之外，更是把單位犯罪納 入了刑法典的規(guī)制當中，對于防治責任事故類犯罪起到了積極作用， 值得我國借鑒。重大責任事故罪作為一種危害公共安全類犯罪，屬于 業(yè)務過失犯罪，與單位犯罪密切相關，且多屬貪利性犯罪。根據(jù)重大責 任事故罪的性質，筆者認為在刑種方面增加罰金刑和資格刑。在刑度 方面，重大責任事故罪作為一種業(yè)務過失犯罪，應該重于普通過失類 犯罪的法定刑。另外,增設單位犯罪以豐富法定刑的劃分標準?！居⑽恼縯aking into account the increasing numb
