13、the acceptance and he is responsible for this, he is charged for the additional costs that are occurred because of the delay.如果買方推遲發(fā)貨或延遲接收貨物且屬于買方責(zé)任的，買方應(yīng)負(fù)擔(dān)為推遲發(fā)貨而發(fā)生的額外費(fèi)用。7.If the delay if caused by higher force, industrial action or actions that are outside of the influence of the supplier, the delive

Liability is limited to 12 months from the date when final acceptance is passed single shift and excluding wear parts and to the invoice value of the defective item.

18、 DEPRAG products having such defects will be repaired, replaced or credited as DEPRAG elects. Charges will not be allowed for labor or expenses incident to the repair or replacement of the invoiced DEPRAG product. 德派將為全產(chǎn)品系列提供制造工藝缺陷和產(chǎn)品材料缺陷方面的質(zhì)量保證體系。質(zhì)保期為12個(gè)月，按終驗(yàn)收結(jié)束之日起算【單班操作；不含設(shè)備消耗品】，同時(shí)依據(jù)缺陷產(chǎn)品的發(fā)票列明金額提供對(duì)

21、我們自身的利益，德派已投保了包括公眾責(zé)任險(xiǎn)及產(chǎn)品責(zé)任險(xiǎn)的綜合責(zé)任保險(xiǎn)單。該保單基于期內(nèi)發(fā)生制的索賠形式，責(zé)任限額為“每次事故及全年累計(jì)賠償 EUR1,000,000”。保障因我們經(jīng)營(yíng)業(yè)務(wù)發(fā)生意外事故、或因我們生產(chǎn)、出售、分銷及修理的產(chǎn)品造成使用、消費(fèi)或操作該產(chǎn)品或商品的人或其它任何人的人身傷害或財(cái)產(chǎn)損失所依法應(yīng)由承擔(dān)之賠償責(zé)任。We would like to point out, however, that any indirect or consequential loss and/or damages (i.e. profits, production rates, capital co

24、況。2For RMB contract, the transfer of perils is fulfilled when the delivery item arrives at the plant gate of the customer. Also when the supplier made partial deliveries or has to pay or make other services (according to the order confirmation) like shipping cost and installation.人民幣合同中貨物風(fēng)險(xiǎn)在交付貨物到達(dá)客戶

25、工廠門口時(shí)完成轉(zhuǎn)移。本規(guī)定亦適用于供貨方部分交貨，或（根據(jù)訂單確認(rèn)書）必須支付裝運(yùn)費(fèi)用或提供其他安裝等服務(wù)的情況。3Partial deliveries are acceptable as far as it is reasonable.合理的分批交付應(yīng)可以接受。Retention of title:所有權(quán)保留：所有權(quán)保留：1The supplier beholds the ownership of the supplying part till the buyer transfers the last payment. 在買方支付最后貨款之前供貨方保留所供應(yīng)貨物的所有權(quán)。 2The supp

31、of perils. The supplier has to be informed about the imperfectly immediately in written form. The replaced parts becoming ownership of the buyer.如果缺陷由在風(fēng)險(xiǎn)轉(zhuǎn)移前發(fā)生的事件引起，有缺陷的產(chǎn)品應(yīng)由供貨方維修或更換或改造。買方應(yīng)在發(fā)現(xiàn)缺陷后立即書面通知供貨方。被更換的部件應(yīng)為買方所有。2The buyer has to give the supplier enough time and the possibility to make the nece

32、ssary modifications. Otherwise the supplier is exempt from liability and the following results. Only in urgent cases, when the supplying part is causing danger for operational safety, the buyer is allowed to make changes on his own or third parties and to charge the supplier for the modification cos
