建設(shè)工程委托監(jiān)理合同(中英文)

1、合同訂立原那么平等原那么：根據(jù)?中華人民共和國合同法?第三條：“合同當(dāng)事人的法律地位平等，一方不得將自己的意志強(qiáng)加給另一方 的規(guī)定，平等原 那么是指地位平等的合同當(dāng)事人，在充分協(xié)商達(dá)成一致意思表示的 前提下訂立合同的原那么。這一原那么包括三方面內(nèi)容：合同當(dāng)事 人的法律地位一律平等。不管所有制性質(zhì)，也不問單位大小和經(jīng) 濟(jì)實(shí)力的強(qiáng)弱，其地位都是平等的。合同中的權(quán)利義務(wù)對等。 當(dāng)事人所取得財(cái)產(chǎn)、勞務(wù)或工作成果與其履行的義務(wù)大體相當(dāng)； 要求一方不得無償占有另一方的財(cái)產(chǎn)，侵犯他人權(quán)益；要求禁止 平調(diào)和無償調(diào)撥。合同當(dāng)事人必須就合同條款充分協(xié)商，取得 一致，合同才能成立。任何一方都不得凌駕于另一方之上，不

2、得 把自己的意志強(qiáng)加給另一方，更不得以強(qiáng)迫命令、脅迫等手段簽 訂合同。自愿原那么：根據(jù)?中華人民共和國合同法?第四條:當(dāng)事人依法享有自愿訂立合同的權(quán)利，任何單位和個人不得非法干預(yù)的規(guī)定，民事活動除法律強(qiáng)制性的規(guī)定外，由當(dāng)事人自愿約定。包括：第一， 訂不訂立合同自愿；第二，與誰訂合同自愿，；第三，合同內(nèi)容 由當(dāng)事人在不違法的情況下自愿約定；第四，當(dāng)事人可以協(xié)議補(bǔ) 充、變更有關(guān)內(nèi)容；第五，雙方也可以協(xié)議解除合同；第六，可 以自由約定違約責(zé)任，在發(fā)生爭議時(shí)，當(dāng)事人可以自愿選擇解決 爭議的方式。公平原那么：根據(jù)?中華人民共和國合同法?第五條：“當(dāng)事人應(yīng)當(dāng)遵循公平原那么確定各方的權(quán)利和義務(wù)的規(guī)定，公平原

34、sorwithinsuchatimethattheSupervisor'swork willnotbehampered:第十四條委托人應(yīng)通知承包人在不影響監(jiān)理人開展監(jiān)理工作的時(shí)間 內(nèi)向監(jiān)理人提供如下資料：(1) Listofsuppliers&manufacturersoftherawmaterials,components andparts,mechanicalequipmentetc.tobeusedintheProject;與將用于本工程的原材料，構(gòu)配件，機(jī)械設(shè)備等的供應(yīng)和生產(chǎn)廠 家名錄；(2) Listofcoordinators,cooperatorsinrelati

35、ontothedevelopmentofth eProject.提供與本工程有關(guān)的協(xié)作人，配合人的名錄。Article15TheClientshallfurnishfreeofcharge(includingutilityfees)tot heSupervisorthesiteoffice,telecommunicationconnection,accomm odationandotherfacilitiesspecifiedintheConditionsofParticularAppl ication.第十五條委托人應(yīng)免費(fèi)(包括使用費(fèi))向監(jiān)理人提供辦公場所、訊接口 ，網(wǎng)路接口 住宿及合同專用

38、randaccordingtot herelevantcontractualdocumentsandapplicablelaws:第十七條監(jiān)理人在委托的工程范圍內(nèi)應(yīng)具有以下權(quán)利， 而且在此雙方確認(rèn)任何如下活動也應(yīng)作為監(jiān)理人的義務(wù)，即其有義務(wù)在有必 要的情況下為了以最好的方式并以符合全部合同文件和適用的法律 的方式完本錢工程的目的而進(jìn)行如下活動。(1) Therightandobligationtomakerecommendationsontheselection oftheGeneralcontractor(1)選擇工程總承包人的建議權(quán)和義務(wù)；(2) Therightandobligation

39、tomakerecommendationsontheselection oftheSub-contractor(2)選擇工程分包人的建議權(quán)和義務(wù)；(3) TherightandobligationtomakerecommendationstotheClientinth erespectsoftheprojectincludingprojectsize,designstandard,planni ngdesign,technologicaldesignandperformancerequirements.(3) 對工程建設(shè)有關(guān)事項(xiàng)包括工程規(guī)模、設(shè)計(jì)標(biāo)準(zhǔn)、規(guī)劃設(shè)計(jì)、生 產(chǎn)工藝設(shè)計(jì)和使用功能要求，向

40、委托人的建議權(quán)和義務(wù)；(4) Therightandobligationtoadvise,intheprinciplesofsafetyandopti mum,theClientonthetechnicalproblemsinthedesign.Ifthedesignisf oundtobenotinconformitywiththeQualityStandardspromulgatedbyt heStateorspecifiedintheDesignContract,theSupervisorshallreportt otheClientinwriting.(4) 對工程設(shè)計(jì)中的技術(shù)問題 ,

41、按照平安和最優(yōu)化的原那么 ,有權(quán)利和義 務(wù)向委托人提出建議 .當(dāng)發(fā)現(xiàn)工程設(shè)計(jì)不符合國家公布的建設(shè)工程 質(zhì)量標(biāo)準(zhǔn)或設(shè)計(jì)合同約定的質(zhì)量標(biāo)準(zhǔn)時(shí) ,監(jiān)理人應(yīng)當(dāng)書面報(bào)告委托 人.并提供處理方案(5) Therightandobligationtoreviewtheconstructionmanagementpla nandthetechnicalproposalandtomakerecommendationtotheClient forchangesthattheContractorcouldimplementtoensurequality,on- timecompletionandcostreduct

42、ion.(5) 對審查工程施工組織和技術(shù)方案 ,按照保質(zhì)量、保工期和降低成 本的原那么 ,并就承包人有可能采取的變化監(jiān)理人有權(quán)利和義務(wù)向委 托人提出建議并 提供處理意見 .(6) Conductappropriatearrangementandco- ordinationwithrelevantorganisations,whichcanexertbeneficialinfluencetothedevelopmentoftheProject.ForallsuchmatterstheSupervi sorshallfirstreporttotheClientinadvanceandseekthe

43、authorityofthe Clienttomakesucharrangementsandco-ordination.(6) 主持工程建設(shè)有關(guān)協(xié)作單位的組織協(xié)調(diào) ,對于所有協(xié)調(diào)項(xiàng)應(yīng)當(dāng)事 先向委托人報(bào)告 ,并要求委托人授權(quán)以進(jìn)行組織協(xié)調(diào)工作 .(7) HavingobtainedtheconsentoftheClient,theSupervisorhastherig httogivecommandwithregardstocommencement,suspensionandr esumptionoftheworks.Butbeforedoingso,heshallreporttotheClie
