2、nown as “Party B “ would like to apply for the company(Name of company, hereafter known as “Party A " ) to sponsor me to attend theTraining Programme/ Course (Nameof Training) , (hereafter known as “Training ") organized by(Nameof the Training Organization). The trainingshall be held from(
3、YYYY-MM-DD) to(YYYY-MM-DD).The total training expenses are RMB經(jīng)協(xié)商同意,甲乙雙方就相關(guān)責(zé)任達(dá)成以下協(xié)議,并從培訓(xùn)之日起生效:Upon signing the agreement, both Party A and Party B shall be subjected to the stipulated obligations and this agreement shall take effect from the commencement date of the Training.1 .甲方責(zé)任 Company s Obliga
4、tions(1)甲方按時發(fā)放乙方在培訓(xùn)期間的全部工資;During the training , Party A shall compensate Party B with full working salary remuneration.(2)甲方向乙方資助相關(guān)的培訓(xùn)費用;Party A shall bear all the related training expenses on behalf of Party B.(3)乙方在培訓(xùn)期間享有甲方所規(guī)定的公司福利;During the training , Party B shall be entitled to the benefit pa
5、ckage stipulated by Party A.2 . 乙方責(zé)任 Trainee ' s Obligations(1)乙方須珍惜培訓(xùn)時機(jī),如培訓(xùn)期間因個人原因違紀(jì)解約而導(dǎo)致不能順利完成學(xué)業(yè), 或擅自終止培訓(xùn),乙方應(yīng)退還甲方代付全額培訓(xùn)費用;培訓(xùn)期間工資據(jù)實結(jié)算;Party B is urged to cherish the training opportunity. In the event Party B violates any obligation included in this agreement or withdraws from the training due
6、to personal reason or termination , Party B shall bear the entire cost of training and refund the full sum of the training expenses back to Party A. Party B ' s salary remains unchanged during this training period.(2)乙方須提供培訓(xùn)機(jī)構(gòu)相關(guān)課程的原始資料,包括但不限于課程簡介、主辦機(jī)構(gòu)、主講、費用、地點、學(xué)時、日期 /時間等,以證實培訓(xùn)課程的合理性;Party B shal
7、l provide Party A with original copies of the training materials and course synopsis. Including but not limited to information on the training organization , lecture notes , expenses , training venue, training duration , time and date shall be provided as valid proofs for attending the training prog
8、ramme.(3)乙方同意為甲方效勞一定的年限,效勞期從培訓(xùn)結(jié)束之日起計算.根據(jù)費用支付 的額度大小,具體規(guī)定如下:Party B shall agree to be legally bonded to work for Party A for an agreed period stipulated in the schedule(please refer to the policy) and the bond commences upon the completion of the training , The length of the bond that Party B is requi
9、red to serve will be determined by the type of training sponsorship.(請在相應(yīng)類別欄目內(nèi)打勾并用文字注明,將不適宜處劃掉,不得涂改)(Please mark an option by placing a tickin the corresponding box andfill in the blanks. 10、0至9, 999元之間,效勞期為 6個月;即從年月日至年月日For training sponsorship that costs between RMB5 000 and RMB9 999 , the bond period will be 6 months; From (YY-MM-DD) to (YY-MM-DD) ()B 類 Type B費用在RMB10 000至29, 999元之間,效勞期為12個月;即從年月日至年月日For training sponsorship that costs between RMB10 , 000 and RMB29, 999, the bond per
11、iod will be 12 months; From (YY-MM-DD) to (YY-MM-DD) ()C 類 Type C費用在RMB30 000至99, 999元之間,效勞期為24個月;即從年月日至年月日For training sponsorship that costs between RMB30 , 000 and RMB99, 999, thebond period will be 24 months; From (YY-MM-DD) to(YY-MM-DD)()D 類 Type D費用在RMB100 000元,效勞期為36個月;即從年月日至年月日For training s
12、ponsorship that costs more than RMB100, 000 , the bond periodwill be 36 months;From (YY-MM-DD) to (YY-MM-DD)()E 類 Type E員工在試用期參加培訓(xùn),費用缺乏RMB5 000元,效勞期至試用期滿.For employees under probation on training sponsorship that costs less than RMB5 000, the bond period will be the length of the probation period.()
13、F 類 Type F員工參加特殊課程,費用合計,效勞期為月;即從年月日至年月日For employee attending special training (course name), Totalexpenditure, the bond period will be months.From(YY-MM-DD) to(YY-MM-DD)(4)如因違反國家法律法規(guī)或公司制度而導(dǎo)致違紀(jì)解約,那么乙方須向甲方歸還未完成的效勞期的培訓(xùn)費用,費用歸還的計算方式如下:歸還金額=(全額資助費用/約定效勞月份數(shù))*未效勞月份數(shù)If Party B is unable to complete the bond
14、 period due to a breach of state lawor non-compliance to the company regulations which leads to the earlytermination of his/her employment, Party B shall refund Party A the followingamount calculated using the following formula.Refund Amount = Training Expenses/ Bond Period (no. of months) X Uncompl
15、eted Bond Period (No. of months) 如乙方在合約所規(guī)定的效勞期內(nèi)提出解除勞動合約,那么須向甲方歸還未效勞月份的培訓(xùn)費用,歸還方式同4.In the event where Party B wishes to terminate his/her labor contract duringhis/her bond period , he/she shall refund to Party A an amount calculated usingthe above formulae in article 4 of Trainee' s Obligation.本協(xié)議作為雙方簽訂的?勞動合同?的附件,與?勞動合同?具備同等效力.如果本協(xié)議效勞期在勞動合同期內(nèi),那么乙方應(yīng)根據(jù)勞動合同約定期限履行,費用歸還那么根據(jù)本協(xié)議約定執(zhí)行;如果本協(xié)議效勞期超過勞動合同期限,那么勞動合同期限相應(yīng)順延,費用償還根據(jù)本協(xié)議約定執(zhí)行.This Agreement is coequal with the labor contract.
