1、關于東平湖水資源管理問題的思考孫遠擴(山東黃河河務局)摘 要:本文從東平湖水資源開發(fā)利用現(xiàn)狀入手,分析了水資源權屬管理現(xiàn)狀, 針對水資源權屬管理方面存在的突出問題,提出了東平湖水資源隸屬黃河部門管理的主要法律依據和南水北調東線經過東平湖調蓄必須由黃河主管部門管理的理由,進而提出了加大研究工作力度、把戴村壩以上的大汶河水資源管理權化歸黃河部門、加強入河排污監(jiān)督管理等建議。關鍵詞:水資源;水權;東平湖;管理東平湖水庫是黃河下游運用機率最大的分滯洪區(qū),也是黃河下游最大的支流大汶河的自然滯洪區(qū),同時又是國家南水北調東線調水過黃河的調蓄水庫和山東省西水東調工程的水源地,正像黃委會李國英主任所講的東平湖是
2、黃河下游防洪和水資源利用戰(zhàn)略布局中最重要的棋子,是山東黃河“啞鈴”戰(zhàn)略的一端。分析研究東平湖水資源開發(fā)利用及管理問題,解決好東平湖水資源問題,既能部分地解決“堤防不決口,黃河不斷流,水質不超標,河床不抬高”的問題,實現(xiàn)黃河長治久安,又能有效緩解山東省和華北地區(qū)水資源短缺,同時有利于黃河資源節(jié)約型、環(huán)境友好型和生態(tài)文明的建設,意義重大。 1 東平湖水資源及其開發(fā)利用現(xiàn)狀1.1東平湖水資源概況。東平湖位于黃河右岸由寬變窄的過渡段上,大汶河匯流入黃處。庫區(qū)總面積627KM2,其中老湖區(qū)209 KM2,設計蓄洪水位46M,近期蓄洪水位保證44M爭取44.5M,老湖常年積水面積124 KM2,蓄量約1.
3、65億M3,多年平均水位40.25M,水面面積近20萬畝。本地區(qū)水資源主要包括大汶河水、可調蓄的黃河水、南水北調長江來水等。1.1.1大汶河來水。大汶河是山東黃河最大的支流,也是東平湖的主要補給水源,根據水文資料統(tǒng)計,大汶河水資源具有以下幾個特點:(1)來水量年際和年內豐枯變化大。入湖水量多年(19521999)平均為10.77億M3,最大為1964年的60.73億M3,最小為1989年的0。其中710月份平均為9.10億M3,其它月份為1.66億M3。(2)來水量呈現(xiàn)遞減趨勢。近年來,汶河上游加快了整治步伐,加大了地表徑流攔蓄措施,擴大了水資源的開發(fā)利用,使來水明顯減少,春季減少尤甚。據統(tǒng)計
4、,19521960年平均來水量為14.70億M3,19611970年平均來水量為17.49億M3,19711980年平均來水量為9.30億M3,19811989年平均來水量為3.31億M3,19901999年平均來水量為8.70億M3。進入80年代枯水期,汶河春季不斷出現(xiàn)長期干河斷流的現(xiàn)象,尤其是從1988年10月至1990年5月,創(chuàng)連續(xù)20個月未發(fā)生徑流的記錄。1.1.2黃河水資源存在斷流與棄水并存的局面。據水文資料統(tǒng)計,1950至1999年黃河平均每年入海水量有344億M3,其中非汛期入海水量為133億M3。其中:1950至1959年平均每年入海水量480億M3,非汛期入海水量181億M3
5、;1960至1969年平均每年入海水量501億M3,非汛期入海水量210億M3;1970至1979年平均每年入海水量311億M3,非汛期入海水量124億M3;1980至1989年平均每年入海水量286億M3,非汛期入海水量96億M3;1990至1999年平均每年入海水量億142M3,非汛期入海水量億54M3。因此,利用東平湖水庫可供調蓄的黃河水量是有保證的。1.1.3南水北調水量。根據1993年9月水利部會同有關省市共同審查通過的南水北調東線工程修訂規(guī)劃報告和南水北調東線第一期工程可行性研究修訂報告,第一期工程過黃河規(guī)劃規(guī)模為200M3/S,31.1億M3/年;2020年水平過黃河規(guī)劃規(guī)模為4
6、00M3/S,80.1億M3/年;過黃河最終規(guī)劃規(guī)模為700M3/S,130億M3/年。根據調整后的南水北調東線一期工程山東供水區(qū)規(guī)劃報告,2010年山東需調引江水30億M3,通過東平湖調節(jié)由西水東調工程向膠東送水1012億M3,2010年后黃河以北的聊城、德州兩市可利用江水5億M3。1.2東平湖水資源開發(fā)利用現(xiàn)狀。從整體上看東平湖地區(qū)屬于水資源比較豐富的地區(qū),但由于東平湖目前仍沒有擺脫只考慮防洪而不能適當調蓄的單一運用方式,再加上來水量時間上分布不均、引湖開發(fā)利用設施配套差、湖水水質較差等因素,東平湖地表水資源開發(fā)利用率仍較低,多年平均引湖水量只有0.66億m3左右。2 東平湖水資源管理現(xiàn)狀
7、2.1黃河主管部門管理現(xiàn)狀。國務院取水許可制度實施辦法、水利部關于授予黃河水利委員會取水許可管理權限的通知等下發(fā)后,根據統(tǒng)一部署,東平湖管理局自1994年下半年起組織開展了東平湖(含戴村壩以下的大清河)水資源開發(fā)利用情況普查及取水許可登記工作,1995年7月根據管理權限由山東河務局對其4個地表取水口和360個地下取水口發(fā)放了取水許可證;并分別于2000、2005年由黃委對地表水和生活、工業(yè)用地下水取水口換發(fā)了取水許可證。根據水利部取水許可監(jiān)督管理辦法的規(guī)定,取水許可監(jiān)督管理機關每年都認真組織開展了取水許可證年度審驗和取用水統(tǒng)計工作,定期不定期地對取水人的取水情況進行現(xiàn)場監(jiān)督檢查。2.2黃河部門
8、管理的主要依據。(1)有利于黃河防洪保安全。東平湖滯洪區(qū)包括新湖區(qū)和老湖區(qū)兩部分,是分滯黃河洪水、接納汶河洪水,控制艾山下泄流量不超過10000億M3/S,確保山東省黃河防洪安全的關鍵工程。老湖區(qū)不僅分滯黃河洪水,而且接納汶河洪水,調蓄南水北調水量,運用機遇較高,防汛任務非常重,確保分滯黃河洪水和蓄滯汶河洪水安全是東平湖老湖的首要任務,在此前提下,才能進行綜合開發(fā)、蓄水興利。因此,東平湖水庫和水資源只有由黃河部門實施統(tǒng)一管理,南水北調東線經過東平湖調蓄只有由黃河部門牽頭管理,才能在確保黃河和汶河防洪安全的前提下,把防汛和利用水庫調蓄興利有機結合起來,充分發(fā)揮東平湖的綜合效益。(2)從法律層面講
9、,水資源管理權限明確。水利部取水許可監(jiān)督管理辦法規(guī)定:流域機構是實施本辦法的取水許可監(jiān)督管理機關;水利部關于授予黃河水利委員會取水許可管理權限的通知(水利部水政資1994197號)明確規(guī)定:黃河水利委員會對黃河干流及其重要跨省區(qū)支流的取水許可實行全額管理或限額管理,東平湖滯洪區(qū)(含大清河)范圍內的取水,取水單位或個人應到黃河水利委員會進行取水登記,領取取水許可證,其中已由當?shù)厮姓鞴懿块T登記過的,應到黃河水利委員會換領取水許可證;山東省人大常委會通過的山東省黃河河道管理條例第25條規(guī)定:在黃河河道管理范圍內設置或擴大排污口,應當征得黃河河道主管機關同意。3 東平湖水資源管理權方面存在的主要問
10、題3.1管理權交叉,給水資源統(tǒng)一管理設置了障礙。關于授予黃河水利委員會取水許可管理權限的通知中規(guī)定:東平湖滯洪區(qū)(含大清河)內的取水由黃河水利委員會實行全額管理,受理、審核取水許可(預)申請,發(fā)放取水許可證。因此,黃河水利委員會的派出機構東平湖管理局,應是東平湖水資源的主管機關,代表國家行使水行政主管職能。1995、2000年由黃委會審批發(fā)放了取水許可證,初步實現(xiàn)了對東平湖水資源的權屬管理。東平湖滯洪區(qū)的行政管理權分屬于東平、梁山和汶上三縣,其中老湖區(qū)隸屬于東平縣,東平縣設有東平湖管理委員會,主要職責是開發(fā)東平湖水產資源、旅游資源,實施東平湖綜合開發(fā)戰(zhàn)略,侵犯了黃河部門的合法權益,產生了諸多矛
11、盾。如2001年8月份,當東平湖湖水位回落到43M高程之時,黃委會根據全河水資源管理的需要,要求關閘蓄水,保留5.4億M3的水量,以防黃河斷流之用。當?shù)卣畢s強烈要求盡快退水還田,拒不允許關閘蓄水,當?shù)厝罕娨簿郾娮钄r,至使黃委指令難以實施,使有限的水資源白白流失。3.2水法第三十四條第二款規(guī)定,直接從地下或者江河、湖泊取水的,可以由省、自治區(qū)、直轄市人民政府決定征收水資源費,而水法實施14年后的今天,由于沒有征收水資源費的法律依據和標準,流域機構尚未開征黃河水資源費,水資源的國家所有權沒有得到應有的補償和體現(xiàn)。由于地方人民政府對黃委會出臺的規(guī)范性文件的效力產生疑問,加之黃委出臺的規(guī)范性文件大大
12、落后于地方,黃委對黃河水資源使用權的管理困難重重。3.3東平湖水污染嚴重。據不完全統(tǒng)計,排入東平湖的工業(yè)和生活污水量多年平均達1億多M3,大部分未經處理直接排入河道流入東平湖,使東平湖水質日趨惡化。東平湖水多數(shù)流入黃河或被當?shù)厝罕娙∮?,加劇了黃河污染,危及庫區(qū)及沿湖群眾的身體健康,影響水產養(yǎng)殖。近幾年,黃河部門加大了水質監(jiān)測力度和監(jiān)督管理力度,配合地方政府和環(huán)保部門關停了部分排污嚴重的企業(yè),但東平湖水污染仍十分嚴重,水質一般介于類之間。東平湖管理局作為東平湖水庫和水資源的主管機關,上級僅僅賦予了其對水質的監(jiān)督權,對向東平湖排污的單位和個人無權直接采取強制措施,加之東平湖的上界僅到戴村壩,戴村壩
13、以上的大汶河隸屬于沿河的縣、市、區(qū)管理,給大汶河、大清河和東平湖的防污、治污增加了難度。3.4東平湖水庫調蓄能力不足,影響了其調蓄水資源效能的充分發(fā)揮。東平湖是是黃河下游防洪、水資源利用戰(zhàn)略布局中最重要的一個棋子,承擔著向濟寧市供水和南四湖補水的任務,同時作為南水北調東線工程向膠東、天津、北京等地送水的調水平臺,這些任務對東平湖蓄水能力提出了更高要求。當前老湖常積水面積一般保持在20萬畝左右,相應蓄水量只有1.65億立方米左右,愈來愈滿足不了形勢發(fā)展的需要。3.5水資源管理方式落后,監(jiān)督管理不及時,影響了水資源管理效能的發(fā)揮。多年來,由于黃河主管部門對水的資源管理認識不到位,重建輕管思想嚴重,
14、對水的資源管理和湖產品、旅游資源開發(fā)管理力度小,東平湖水資源統(tǒng)一管理尚未真正落到實處。目前尚處在探索階段,管理方式僅維持在粗放管理層面上,缺乏生機和創(chuàng)新,管理效益非常差。4 東平湖水資源管理初步設想隨著水權水市場的建立,我們要以水權理論為指導,研究解決東平湖資源管理中的問題,讓東平湖有限的水資源發(fā)揮更大的社會效益和經濟效益。4.1積極向上級反映,爭取由水利部出臺專門的東平湖水資源管理辦法,依法規(guī)范東平湖水資源的資源管理和開發(fā)使用管理行為。4.2研究南水北調調水到東平湖的成本,研究東平湖水資源的機會成本既水價問題,為水權轉讓打下堅實的基礎。4.3建議把戴村壩以上的大汶河水資源管理權統(tǒng)一化歸黃河主
15、管部門,以實現(xiàn)對山東黃河干支流的統(tǒng)一規(guī)劃和管理,便于實現(xiàn)對山東黃河的取水總量控制和干支流的統(tǒng)一調度管理。4.4認真執(zhí)行取水許可和水資源征收管理條例,嚴格取水許可證的發(fā)放、審核,建立取用水管理工作體系,完善取水許可制度。4.5要盡快與地方政府協(xié)商,要求返還東平湖的全部管理權,由東平湖管理局對東平湖全面管理實行統(tǒng)一規(guī)劃(當前要抓緊制定規(guī)劃),統(tǒng)一調配,統(tǒng)一管理,充分發(fā)揮東平湖水資源、湖產資源、旅游資源的綜合效益。搞好黃河管理部門與地方政府的關系,使之心往一處想,勁往一處使,團結一致搞好東平湖的開發(fā)治理。4.6建立東平湖水務一體化管理機制,建立健全水資源管理專職執(zhí)法隊伍,對東平湖水資源實行統(tǒng)一規(guī)劃,
16、統(tǒng)一調配,統(tǒng)一監(jiān)督管理,統(tǒng)一發(fā)放取水許可證、采砂許可證,統(tǒng)一征收水資源費,統(tǒng)一管理水量水質,制定完善水資源配置,節(jié)約和保護制度,實行水資源有償使用制度。4.7采取有效措施,增大水儲備能力,發(fā)揮東平湖多種功能。東平湖水庫防洪功能是第一位的,但防洪運有一定的時限性,要充分發(fā)揮東平湖的蓄水功能,把東平湖建成黃河下游應急水源工程,應注意解決好以下幾個問題:一是采取法律、行政等多種手段,采取強硬措施,堅決破除生產堤,退田于湖。東平湖老湖現(xiàn)有圍湖造田14處,圍面積59.48平方公里,占老湖面積的28.4%,這些生產堤的存在,嚴重地影響了老湖的儲水能力,也給防洪保安全造成很大壓力。二是有計劃地遷出湖區(qū)群眾。
17、老湖庫區(qū)內現(xiàn)居住4個鄉(xiāng)鎮(zhèn),31個村,4566戶,16011人。由于這些群從在湖區(qū)生活生產,這也是庫區(qū)內生產堤難以破除的根本原因。要搞好宣傳,做好群眾工作,有計劃地將其遷出,妥善安排,實現(xiàn)老湖區(qū)全面運用。三是確定合理的汛線水位和興利庫容。根據東平湖現(xiàn)有工程蓄水能力,經過去年8月份44.38M高水位的考驗。汛線水位建議確定為43M,儲水量約5.5億M3。此水位即可儲蓄豐富水量,又可留足防洪庫容,不至影響沿湖群眾生產生活,達到防洪蓄水,群眾生活皆相宜。四是根據蓄水先治污的原則,加大汶河上游排污口的治理力度,嚴格控制污水入湖量。4.8為適應南水北調對水質的要求(類以上標準),要認真執(zhí)行水污染防治法和河
18、道管理條例,加大對入湖(河)排污口的建前審查和日常監(jiān)督、排污達標控制和總量控制管理。4.9要增加治水管水的科技含量,著力開發(fā)水資源節(jié)約保護的新技術,用現(xiàn)代化的管理手段管理東平湖水資源。Discussion on the Dongping Lake Water Resources ManagementSun Yuankuo(Yellow River Shandong Bureau)Dongping Lake reservoir is a flood detention basin with the largest frequency application in the downstream Y

20、ndong water regulation from west to east, it is just as what Li Guoying director said that Dongping Lake is the most important chessman in the down stream Yellow River flood control and water resources utilization stratagem layout and it is a stratagem engineering in the downstream Yellow River floo

At the moment of the national east line water transportation from south to north starting, we should study carefully the water resources management right of Dongping Lake and make out the scientific evidences of Dongping Lake water resources management righ
22、t of Yellow River Management Department, and analyse the reason why we should manage the national east line water transportation from south to north by the way of Dongping Lake regulation, and solve desirably the Dongping Lake water resources, which can not only partially solve the problems of "
23、;no embankment bursting, no Yellow River flow breaking, no pollution exceeding standard, no river bed silting up", but also is a basic measure that solves gradually water resources shortage in Shandong province and north China region ,at the same time, its meaning is important to increasing Lak
24、e water breeding aquatics and peoples life level along the lake, guaranteeing Yellow River long safety ,the national water transportation from south to north ,Shandong water transportation from west to east and developing Shandong Yellow River production economy.1 Dongping Lake water resources and t
25、he present condition of development and utilization1.l The general situation of Dongping Lake water resources. Dongping Lake is situated at the transition reach where the Yellow River right bank,s breadth becomes from wideness to narrowness, Dawen River's outlet into Yellow River Reservoir total
26、 area is 627 KM2,and old lake area is 209 KM2 thereinto, design storage flood level is 46M,near period storage flood level is assured to reach 44M and strived for 44.5M,old lake annual collecting water area is 124 KM2,storage pondage is roughly 1.65 hundred mi1lion M3,the average level of many years
27、 is 40.25M,surface area is near 3.29ten thousand acre. The water resources in this area include primarily the Dawen River foreign water and Yellow River water diversion, Yangtze River water of transportation from south to north etc.1.1.1 The Dawen River guest water resources. Dawen River is the bigg
28、est branch in Shandong Yellow River, is also Dongping Lake,s main source of nourishment, and according to hydrology data statistics Dawen River water resources has a few characteristics below :(l)The variety of abundance and lowness of annual inflow and interannual inflow is big. The average quantit
29、y of water flowing into the lake from 1952 to 1999 is 10.77 hundred mi11ion M3, the biggest is 60.73 hundred million M3 in 1964,the least is O in 1989.The average quantity of water is 9.lO hundred mi11ion M3 in month 7to month 10,is 1.66 hundred million M3 in other month. (2)Inflow has a trend of gr
30、adually decreasing. In recent years, steps of renovating the upstream Dawen River are quickened, measures of surface runoffs interception and storage are increased, the water resources development and utilization are extended, which make inflow decrease obviously, particularly in spring. According t
31、o statistics, the average of inflow is 14.70 hundred million M3 from year 1952 to year 1960,is 17.49 hundred million M3 from year 1961 to 1970 year, is 9.30 hundred million M3 from year 1971 to 1980 year, is 3.31 hundred mi11ion M3 from year 1981 to 1990 year ,is 9.70 hundred million M3 from year 19
32、91 to 1999 year. Dawen River takes on continuously a phenomenon of long period flow-breaking in spring in draught period in the 1980s, particularly from October 1988to May 1990, it created a record that it had not been flowing for continuing 20 months.1.1.2 Ye11ow River water resources flowing here.
33、 According to hydrology data statistics, the average quantity of water flowing into the sea is 344 hundred million M3 from 1952 to 1999, and the average quantity of water flowing into the sea is 133 hundred million M3 in non-flood season. Thereinto, the average is 480 hundred million M3 from 1950 to
34、 1959 and is 181 hundred million M3 at non-flood season, the average is 501 hundred million M3 from 196O to 1969 and is 210 hundred million M3 at non-flood season, the average is 311 hundred million M3 from 1970 to 1979 and is 124 hundred million M3 at non-flood period, the average is 286 hundred mi
35、llion M3 from 1980 to 1989 and is 96 hundred mi Ilion M3 at non-flood season, the average is 142 hundred million M3 from 1990to 1999 and is 54 hundred million M3 at non-flood season .Therefore, Yellow River quantity of water which is regulated through Dongping Lake is guaranteeing.1.1.3 The quantity
36、 of water transportation from south to north. According to Revising and programming reports on the east line water transportation from south to north and Possibility study and revising report on the first-period east line water transportation from south to north that Water Conservancy Department cen
37、sored with some provinces and cities related and were passed in 1993,the first-period engineering programming scale across Yellow River is 20OM3/s,31.l hundred million M3/y;in 2020,the level programming scale across Yellow River will get to 400M3/s,80.l hundred mi11ion M3/y;the final programming sca
38、le across yellow River will get to 700 M3/s,130 hundred mi11ion M3/y.According to the adjusted programming report on the first-period east line water transportation from south to north providing water to Shandong, Shandong need transfer Yangtze River quantity of water 30 hundred million M3 in 2010,t
39、he water transportation from west to east will transfer water lO-12hundred mi1lion M3 to Jiaodong region by the way of Dongping Lake regulation, and two cities of Liaocheng and Dezhou can make use of 5 hundred million M3 Yangtze River water after 2010.1.2 The present condition of Dongping Lake water
40、 resources development and uti lization. Dongping Lake region is abundant in water resources as a whole, but the development and utilization ratio of its surface water resources is still lower and the quantity of water diversion from the lake is only 0.66 hundred million M3 or so as an average of ma
41、ny years due to single operation manner that we don,t break away from only considering the flood control now and have no proper regulation and storage to it, plus the irregularity of inflow distributing at spatio-temporal aspect and the bad match of lake diversion development and utilization devices
42、 and bad lake water quality and so on.2 Yellow River management department's actua1ity and main basis on managing Dongping lake water resources.2.1 Yellow River management department,s management actuality. After State Council's operation means of draught admitting system and Water Conservan
43、cy Department , s Informations concerning authorizing Yellow River water Conservancies Committees the right and limit of draught admitting management were publicized, according to unitary arrangement, Dongping Lake Management Bureau organized and carried out some surveys to Dongping Lake (including
44、downstream Daicun dam)water resource development and utilization circumstance and some register works about draught admitting from the second half year in 1994,and according to the management right and limit, this bureau issued draught permits to 4 surface draught points and 360 subsurface draught p
45、oints in July 1995,and Ye11ow River Water Conservancies Committees exchanged and issued the draught permits to the surface draught points and the life and industry subsurface draught points in June 2000.According to the provisions of the Water Conservancy Department's Supervision and management
46、items of draught admitting, draught admitting supervision and management department organized and carried out annual checkup to draught permits and statistics work about draught and using water annually, and carried out supervision and checkup on the spot to draught persons, draught circumstance ter
47、mly and aperiodically.2.2 Yellow River Management Department,s main basis.(1)The Dongping Lake flood detention basin includes two partthe new lake and the old lake, and it is a key engineering which can retard Yellow River flood and take on Dawen River f1ood and control Aishan discharge within lOOOO
48、M3/s,and guarantee Shandong province Yellow River control flood safety .The old lake can not only retard the Yellow River the flood, but also take on Dawen River flood and regulate quantity of water transportation from south to north, and its application opportunity is bigger and the f1ood preventio
49、n task is heavy. Therefore, as far as old lake is concerned, its initial task is to guarantee retarding Yellow River flood and Dawen River flood safety. Under this premise, Dongping Lake can be developed overall and stores water and exerts its benefit best. Only Yellow River Departments carry out un
