12、 ll l l llll lllIII l l II簽約須知1、簽約雙方應(yīng)仔細閱讀本合同書,以明確各自的權(quán)利、義務(wù)。2、勞動合同必須由用人單位法定代表人或其委托代理人與勞動者本人簽訂。3、本合同一律使用鋼筆或簽字筆填寫,字跡清楚,文字簡練、準確。合同中凡 需雙方協(xié)商的,經(jīng)協(xié)商一致后明確填寫在空格內(nèi);涉及貨幣數(shù)字應(yīng)填寫“ 0000.00 ”式樣或大寫金額。合同中空格處雙方如無約定內(nèi)容須畫“/”或填“無”。本合同一經(jīng)簽訂,不得涂改。對勞動合同的效力有爭議,由勞動 爭議仲裁委員會或人民法院確認。4、甲方招用乙方時,應(yīng)查驗乙方提供未與其他用人單位存在勞動關(guān)系的憑證后, 方可與其簽訂勞動合同;乙方與原用

13、人單位未解除勞動關(guān)系的,以及甲方聘 用的退休人員,不能簽訂勞動合同。甲方有權(quán)了解乙方與勞動合同直接相關(guān) 的基本情況,乙方應(yīng)當如實說明。5、勞動合同期限三個月以上不滿一年的,試用期不得超過一個月;勞動合同期 限一年以上不滿三年的,試用期不得超過二個月;三年以年固定期限和無固 定期限的勞動合同,試用期不得超過六個月。同一用人單位與同一勞動者只 能約定一次試用期,試用期包含在勞動合同期限內(nèi)。6、社會保險費按國家規(guī)定繳納,雙方不能協(xié)商約定。7、按照國家就業(yè)準入制度的規(guī)定,甲方招用技術(shù)復(fù)雜以及涉及到公民生命安全 和消費者利益工種的從業(yè)人員,必須從取得相應(yīng)職業(yè)資格證書的人員中錄用。8、解除、終止勞動合同的

25、業(yè)危害防護第六條甲方應(yīng)根據(jù)國家有關(guān)規(guī)定,為乙方提供符合國家標準的勞動安全衛(wèi) 生設(shè)施和必要的勞動保護用品,建立、健全符合安全衛(wèi)生的操作規(guī)程,保障乙方 安全與健康。乙方在勞動過程中,必須嚴格遵守安全操作規(guī)程。對從事有職業(yè)危 害作業(yè)的勞動者,甲方應(yīng)當定期組織乙方進行健康檢查。甲方應(yīng)按照國家有關(guān)規(guī)定為未成年工和在孕期、產(chǎn)期、哺乳期間的女職工提 供勞動保護。五、勞動報酬第七條乙方執(zhí)行標準工時工作制或綜合計算工時工作制的,甲方每月日前以貨幣形式支付乙方工資,月工資為 元。試用期間的 月工資 元。乙方執(zhí)行不定時工作制的,甲方每月 日前支付乙方的工資按 執(zhí)行。第八條 乙方在法定的工作時間內(nèi)提供正常勞動,甲方支

35、izati on re quireme nts, 18se ssi onofthe第十三條經(jīng)甲乙雙方協(xié)商一致,可以變更本合同。第十四條本合同訂立時所依據(jù)的法律、行政法規(guī)、規(guī)章發(fā)生變化,本合同應(yīng)變更相關(guān)內(nèi)容。第十五條本合同訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行的,經(jīng)甲乙雙方協(xié)商同意,可以變更本合同相關(guān)內(nèi)容。九、勞動合同的解除第十六條經(jīng)甲乙雙方協(xié)商一致,本合同可以解除。第十七條乙方有下列情形之一,甲方可以解除本合同;1、 、 在試用期間被證明不符合錄用條件的;2、 嚴重違反勞動紀律或甲方規(guī)章制度的;3、 嚴重失職、營私舞弊,給甲方利益造成重大損害的;4、 勞動者同時與其他用人單位建

36、立勞動關(guān)系,對完成本單位的工作任務(wù)造成嚴重影響,或者經(jīng)用人單位提出,拒不改正的;5、 以欺詐、脅迫的手段或者乘人之危,使對方在違背真實意思的情況下訂立的或者變更勞動合同的;6、 被依法追究刑事責任的。第十八條有下列情形之一,甲方提前三十日以書面形式通知乙方或者額外支付勞動者一個月工資后,可以解除勞動合同:1 、乙方患病或者非因工負傷,在規(guī)定的醫(yī)療期滿后,不能從事原工作也不能從事由甲方另行安排的工作的;2、乙方不能勝任工作,經(jīng)過培訓(xùn)或者調(diào)整工作崗位,仍不能勝任工作的;3、勞動合同訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行,經(jīng)雙方協(xié)商不能就變更合同內(nèi)容達成協(xié)議的。第十九條甲方瀕臨破產(chǎn)進
