16、roved by the headquarters of part a. second party shall not refuse to construct or raise the cost for any reason. 3、承包方式：雙包，包括并不限于包工、包料、包工期、包質(zhì)量、包資料 (書面資料及電子版資料)、包括圖紙規(guī)定范圍內(nèi)的施工措施、包安全文明施工、包施工現(xiàn)場多次駁運(yùn)、包現(xiàn)場成品保護(hù)、包已完工建筑產(chǎn)品保護(hù)、包垃圾清運(yùn)至市政要求的地方、包管理、包臨時設(shè)施等。(不包含場外棄土及垃圾)contracting way: including but not limited to labo

18、 municipal requirements, management and temporary facilities, etc. (not including discarding the soil and the garbage beyond the site)三、合同工期 agreement duration合同工期：總有工期360天。agreement duration: total duration is 360 days.材料準(zhǔn)備開工日期為2016年4月5日；進(jìn)場開工日期為2016年5月7日（以甲方正式的開工報告時間為準(zhǔn)）主車間基礎(chǔ)完成且達(dá)到鋼結(jié)構(gòu)入場安裝條件時間為2016年7月

19、30日；竣工日期為2017年5月2日，需要特殊說明的是因不可抗力等因素，如當(dāng)?shù)卮筮x除外或者連續(xù)下雨8小時，工期可以適當(dāng)順延，順延時間由甲方根據(jù)實(shí)際情況定，順延期間誤工費(fèi)等所有費(fèi)用均用由乙方自行承擔(dān)；the commencement date for material preparation is april 5th, 2016; the commencement date for starting work is may 7th, 2016 (subjected to the first party s formal work-start time ); the finished time f

21、ch as state election or eight hours continuous rain. the postpone time is confirmed by first party according to the actual situation, and all the expenses incurred because of the delays shall be borne by second party. 工程質(zhì)量標(biāo)準(zhǔn)：一次性驗收合格。（按印度工程質(zhì)量驗收標(biāo)準(zhǔn)達(dá)到備案合格標(biāo)準(zhǔn)）。本工程土建竣工資料由土建承包單位進(jìn)行，鋼結(jié)構(gòu)施工單位資料由鋼結(jié)構(gòu)單位進(jìn)行，資料由各施工單位

25、有工程量包干價，若招標(biāo)圖紙無修改、無設(shè)計變更及工程承包內(nèi)容內(nèi)增減，則合同總價一次包干，不作調(diào)整。（如圖紙設(shè)計中無做法與詳圖及材料要求的無法報價項，則不在包干范圍內(nèi)，包括但不限于廠區(qū)綠化工程，廠區(qū)大門，辦公樓區(qū)域圍欄等）.the agreement sum is a lump price including all the civil works in the tender drawings, which will not be adjusted if none of these special cases occurs such as the revision of tender drawin

27、, factory gate and the fences of the office building area and etc.)2、合同總價包干內(nèi)容為content of the agreement sum:1）、完成設(shè)計圖紙中確定的全部內(nèi)容：所發(fā)生的人工費(fèi)、材料費(fèi)、機(jī)械費(fèi)、措施費(fèi)、檢驗費(fèi)、安全文明施工費(fèi)、管理費(fèi)、利潤、稅金、垃圾清運(yùn)費(fèi)（垃圾需運(yùn)到甲方場內(nèi)指定堆放地點(diǎn)，只限于土建工程項所產(chǎn)生的建渣及生活垃圾）；entire contents specified in the designing drawings: expenses incurred in labor, materials

(refuse should be cleared up to the specified location, only including build slag and living garbage in the course of civil construction.)2）、 乙方投標(biāo)文件承諾及乙方商務(wù)標(biāo)書中漏錯項內(nèi)容

29、；the contents promised in second party s bid documents and omission and fault in their commercial bidding.3）、涉及工程制作施工、安裝施工、驗收所有檢驗（測）、實(shí)驗費(fèi)等； expenses incurred in inspection and testing for engineering manufacturing, installation and acceptance.六、款項支付與結(jié)算 payments and settlements1、本合同無預(yù)付款；this agreement

30、 includes no adanve money;2、月進(jìn)度款，每月按工程實(shí)際量的80%支付，乙方每個月25日提交上月25日到本月24日的工程量審核報告，甲方相關(guān)人員三天內(nèi)須到場審核，審核后在20工作日內(nèi)支付進(jìn)度款；其中,甲方代乙方支付材料款等合計一千五百萬(inr1,50,00,000.00)盧比整，經(jīng)甲乙雙方約定將從第一筆進(jìn)度款中全額扣除。 monthly progress payment should be 80% of actual amount of the quantity that finished in that month. second party shall submi

31、t the audit report of actual quantity during the period of 25th last month to 24th this month, after submission first party shall audit the quantity on-site within 3 days. once approved, monthly progress payment should be paid within 20 work days. both parties agreed that rupees fifteen million only

32、 (inr1,50,00,000.00) which first party has paid on behalf of second party as payment for materials shall be subtracted from the first monthly progress payment.3、工程竣工驗收審核：乙方先自行檢查，甲方項目組進(jìn)行復(fù)查，合格后申請甲方總部進(jìn)行綜合驗收，三個月內(nèi)甲方總部進(jìn)行綜合驗收合格后，乙方需向甲方交清整體驗收合格報告、竣工圖、竣工資料等并辦理結(jié)算；結(jié)算辦理完成后30天內(nèi)支付至工程總價的95%，余下的5%作為質(zhì)保金，質(zhì)保金一年后無息返還，質(zhì)

33、量保證要求嚴(yán)格按印度標(biāo)準(zhǔn)執(zhí)行； audit on completionacceptance of project: second party shall first make a self-inspection, first partys project group check again for review, they will apply to their headquarters for comprehensive acceptance after the review is passed. within three months after comprehensive accepta

34、nce, second party should submit to first party all the documents including the overall acceptance report, as-built drawing and completion data and handle the settlement. 95% of the project total sum should be paid to within 30 days after the completion of settlement, the remaining 5% will be regarde

35、d as quality retention money and be returned a year later with no-interest. quality guarantee is carried out according to india standards.4、質(zhì)保期自驗收合格之日起開始計算，質(zhì)保期內(nèi)乙方得到甲方維修通知后須在24小時內(nèi)做出回應(yīng)并在15日內(nèi)到場維修。如果乙方未按時到場維修，甲方可另請其他單位進(jìn)行維修，其費(fèi)用按實(shí)際發(fā)生金額的三倍扣罰.the quality guarantee period starts from the date of acceptance.

36、in quality guarantee period, second party should respond within 24 hours and commence repair within 15 days after receipt of first partys notice. if second party fail to arrive on time, first party has the right to ask other unit for repair and deduct three times of its cost incurred according to th

43、場不具備施工條件，如自然災(zāi)害等不可抗力的影響，書面通知甲方，經(jīng)甲方書面同意后乙方有權(quán)暫停施工和順延工期；if the site does not have the construction condition, such as the impact of natural disasters and other force de majeure, second party shall have the right to suspend the construction and postpone the construction progress accordingly, after they i

44、nform in writing to first party and receive first partys written consent.6、乙方施工全過程，必須接受甲方代表的監(jiān)督管理；second party must accept supervision and management of first partys representative during construction .7、乙方所有進(jìn)場材料及構(gòu)配件，必須經(jīng)甲方代表或者工程監(jiān)理驗收，不合格材料一律不準(zhǔn)進(jìn)場。all the materials and components of the building site pr
