2、,協(xié)商一致的基礎(chǔ)上,同意訂立本勞動(dòng)合同,共 同遵守本合同所列條款。The Parties, intending to be bound hereby, agree to en ter into this Employme nt Con tract on the basis of equality, free will and mutual con sultati on pursuant to the Labor Law of the People ' Republic of China ( “ PRC” , the Employme nt Con tract Law of the PR
3、C and other laws, regulati ons and rules.第一條 勞動(dòng)合同類型及期限Article 1 Type and Term of the Employme nt Con tract一、勞動(dòng)合同類型及期限按下列第項(xiàng)確定。1. The type and term of the Employme nt Con tract shall be determ ined as set forth in Itembelow:1、固定期限:自年月日起至年月日止。 Fixed Term: Fromto;2、無(wú)固定期限:自年 月 日起至法定的解除或終止合同的條件出現(xiàn)時(shí)止。(2) Op
4、en-en ded: Fromto the date whe n a statutory obligati on oragreeme nt to term in ate the con tract arises; or3、以完成一定工作為期限:自 年 月曰起至終止(3) Project-based: Fromto the expiratio n of the term.二、本合同約定試用期,試用期自年 月 日起至 年 月 日止。2. This Con tract specifies a probati onary period comme ncing onand ending on.第二條工作
5、內(nèi)容、工作地點(diǎn)及要求Article 2 Job Descripti on. Workplace Locati on and Work Requireme nts乙方從事 工作,工作地點(diǎn)在。Party B shall en gage in the job of, with the workplace located at乙方工作應(yīng)達(dá)到以下標(biāo)準(zhǔn)。根據(jù)甲方工作需要,經(jīng)甲、乙雙方協(xié)商同意,可以變更工作崗位、工作地點(diǎn)。Party B'svork shall meet the followi ng sta ndards:. PartyB'jobpositions and workplace
6、 locations may be changed with theParties mutualconsent based on Party A'svork n eeds.第三條工作時(shí)間和休息休假Article 3 Work ing Hours, Rest and Leave En titleme nts一、工作時(shí)間按下列第 項(xiàng)確定:1. The working hours shall be determined as set forth in Itembelow:1、 實(shí)行標(biāo)準(zhǔn)工時(shí)制。乙方每日工作時(shí)間不超過(guò)8小時(shí),每周工作時(shí)間不超 過(guò)40小時(shí),每周至少休息一天。(1) The nor
7、mal working hours system shall be implemented. Party B shall work no more tha n 8 hours a day, and 40 hours a week, and shall have at least one day' rest each week.2、實(shí)行經(jīng)勞動(dòng)保障行政部門批準(zhǔn)實(shí)行的 不定時(shí)工作制。(2) A non-fixed worki ng hours system shall be impleme nted with then ecessary approval from the releva nt
8、 labor admi nistrati on authorities.3、實(shí)行經(jīng)勞動(dòng)保障行政部門批準(zhǔn)實(shí)行的 綜合計(jì)算工時(shí)工作制。結(jié)算周期: 按結(jié)算。(3) A cumulative worki ng hours system shall be impleme nted with the n ecessary approval from the releva nt labor admi nistrati on authorities.二、甲方由于生產(chǎn)經(jīng)營(yíng)需要經(jīng)與工會(huì)和乙方協(xié)商后可以延長(zhǎng)乙方工作時(shí)間, 一般每日不得超過(guò)一小時(shí);因特殊原因需要延長(zhǎng)工作時(shí)間的,每日不得超過(guò)三小時(shí),但每月不得超過(guò)三十六
9、小時(shí)。甲方依法保證乙方的休息休假權(quán)利。2. Due to its operati onal n eeds. Party may exte nd PartyB'svorki ng hoursupon consultation with the Trade Union and Party B, provided that the extended work ing hours for a give n day should gen erally not exceed one hour. If an exte nsion of work ing hours is n ecessary for
10、 special reas ons, the exte nded work ing hours for a give n day should not exceed three hours, provided that the exte nded work ing hours for a month should not exceed 36 hours. Party A shall ensure that Party B will receive their rest and leave entitlements according to the law.第四條勞動(dòng)報(bào)酬及支付方式與時(shí)間Arti
11、cle 4 Work Remun eratio n, Payme nt Method and Date of Payme nt.一、 乙方試用期間的月勞動(dòng)報(bào)酬為元。1. The monthly remuneration payable to Party B during the probationaryperiod shall be RMB.二、試用期滿后,乙方在法定工作時(shí)間內(nèi)提供正常勞動(dòng)的月勞動(dòng)報(bào)酬為元,或根據(jù)甲方確定的薪酬制度確定為。2. After the expirati on of the probati onary period, the mon thly rem un erati
12、 on for Party B' performanee of his normal labor obligations within statutoryworki ng hours shall be RMB, or RMBdetermi ned under PartyA'sremun erati on policies.乙方工資的增減,獎(jiǎng)金、津貼、補(bǔ)貼、加班加點(diǎn)工資的發(fā)放,以及特殊情況 下的工資支付等,均按相關(guān)法律法規(guī)及甲方依法制定的規(guī)章制度執(zhí)行。甲方支付給乙方的工資不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。Party B' swage increase/decrease, bonu
13、ses, allowances and subsidies, and overtime wages, as well as the wage payme nt in special circumsta nces, shall be gover ned by releva nt laws and regulati ons and PartyA'Sternal rulesand policies. The wages paid by Party A to Party B shall not be less than the minimum wage standard stipulated
14、by the people ' government where the employer is located.三、 甲方的工資發(fā)放日為每月日。甲方應(yīng)當(dāng)以 貨幣形式按月支付工資,不 得拖欠。3. Party A will pay wages to Party B on theth day of each mon th. PartyA shall wages in monetary form on a monthly basis, without delay.四、乙方在享受法定休假日以及依法參加社會(huì)活動(dòng)期間,甲方應(yīng)當(dāng)依法支付工資。4. During any period when Pa
15、rty B participates in any social activities which citizens are requested to perform for national or public interests, during statutory working hours, Party A shall pay wages to Party B according to the law.第五條社會(huì)保險(xiǎn)Article 5 Social In sura nee甲、乙雙方必須依法參加社會(huì)保險(xiǎn),按月繳納社會(huì)保險(xiǎn)費(fèi)。乙方繳納部分, 由甲方在乙方工資中代為扣繳。Party a and
16、 Party B must participate in social in sura nee and pay social in sura nce premiums on a mon thly basis in accorda nce with the law. The amount payable by Party B shall be withheld by Party B from the PartyA'smon thly wages.第六條勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)Article 6 Labor Protecti on. Work ing Con diti ons an
17、d Protecti ons Aga inst Occupati onal Hazards甲乙雙方都必須嚴(yán)格執(zhí)行國(guó)家有關(guān)安全生產(chǎn)、勞動(dòng)保護(hù)、職業(yè)衛(wèi)生等規(guī)定。 有職業(yè)危害的工種應(yīng)在合同約定中告知,甲方應(yīng)為乙方的生產(chǎn)工作提供符合規(guī)定 的勞動(dòng)保護(hù)設(shè)施、勞動(dòng)防護(hù)用品及其他勞動(dòng)保護(hù)條件。乙方應(yīng)嚴(yán)格遵守各項(xiàng)安全 操作規(guī)程。甲方必須自覺執(zhí)行國(guó)家有關(guān)女職工勞動(dòng)保護(hù)和未成年工特殊保護(hù)規(guī) 定。The Parties must strictly impleme nt releva nt n ati onal occupatio nal safety, labor protecti on and occupati o
18、nal san itati on procedures and sta ndards. Any job exposed to occupati onal hazards shall be specified in the con tract, and Party A shall provide Party B with work safety and hygiene facilities, labor protection equipme nt and other n ecessary con diti ons for PartyB'sork activities. Party Bmu
19、st strictly comply with the work discipli nes, operati ng procedures and safety rules set by Party A. Party A must con scie ntiously carry out releva nt provisi ons formulated by the state for the protecti on of female and un der-aged employees,第七條 勞動(dòng)合同變更、解除、終止Article 7 Modificati on. Can cellati on
20、 and Termin ati on the Employme nt Con tract一、經(jīng)甲乙雙方協(xié)商一致,可以變更勞動(dòng)合同相關(guān)內(nèi)容。變更勞動(dòng)合同,應(yīng) 當(dāng)采用書面形式。變更后的勞動(dòng)合同文本由甲乙雙方各執(zhí)一份。1. The Parties may modify releva nt terms of the Employme nt Con tract where they have agreed to do so through mutual con sultati on and agreeme nt.二、經(jīng)甲乙雙方協(xié)商一致,可以解除勞動(dòng)合同。2. The Parties may term i
21、n ate the Employme nt Con tract where they have agreed to do so through mutual con sultati on and agreeme nt.三、乙方提前三十日以書面形式通知甲方,可以解除勞動(dòng)合同。乙方在試用期內(nèi)提前三日通知甲方,可以解除勞動(dòng)合同。3. Party B may termi nate the Employme nt Con tract with 30 days' prior writte n no tice to Party A. Party B may termi nate the Employ
22、me nt Con tractduri ng the probati onary period with 3 d ays 'writte n no tice to Party A.四、甲方有下列情形之一的,乙方可以解除勞動(dòng)合同:4. Party B may term in ate his employme nt con tract un der any of thefollow ing circumsta nces involving Party A:1、未按勞動(dòng)合同約定提供勞動(dòng)保護(hù)或者勞動(dòng)條件的;(1) Where Party A has failed to provide labo
23、r protection or workingcon diti ons as stipulated in the employme nt con tract;2、未及時(shí)足額支付勞動(dòng)報(bào)酬的;(2) Where Part A has failed to pay remuneration on time or in full;3、未依法繳納社會(huì)保險(xiǎn)費(fèi)的;(3) Where Party A has failed to con tribute social in sura nee premiums on behalf of Party B in accordance with the law;4、規(guī)章制度違反法律、法規(guī)的規(guī)定,損害乙方權(quán)益的;4. Where Party A'solicies violate laws or regulations, thereby infringing upon Party B'sghts and interests;5、以欺詐、脅迫的手段或乘人之危,使乙方在違背真實(shí)意思的情況下訂立 或者變更勞動(dòng)合同致使勞動(dòng)合同無(wú)效的;(5) Where Party A has con cluded or modified the Employme nt Con tract aga inst the true inten
