PartyAshouldassist Party Bincaseofvehicledamageinhandlingaccidentsandberesponsibleforclaiminginsuranceindemnifications.5、甲方根據(jù)乙方需要配備司機(jī)服務(wù)或提供有關(guān)車輛的其它服務(wù)。AccordingtoPartyB‘srequest，PartyAshallprovidechaufferserviceandrelatedvehicleservices.6、甲方根據(jù)乙方的資信情況，有權(quán)要求乙方提供經(jīng)濟(jì)擔(dān)保。經(jīng)濟(jì)擔(dān)保人必須是具有代為履行或代償能力的國(guó)有企業(yè)或其他經(jīng)濟(jì)組織。PartyBshallprovideeconomicassuranceaccordingtoPartyA‘srequirement.Thewarrantorshouldbenationalenterprisesorothercompaniesthathascompletecompensationalabilities.三、乙方的責(zé)任和義務(wù) PartyB‘sRightsandResponsibilities51、乙方租車提供的所有證件必須真實(shí)有效。如屬偽造或超過有效期，一切經(jīng)濟(jì)和法律責(zé)任均由乙方承擔(dān)。Toensureallthedocumentsprovidedareallrealandvalid.PartyBshallundertakealltheresponsibilitiesofeconomicandlawifanydocumentsprovidedbyPartyBarefalseoroutofvalidity.2、乙方配備的駕駛員必須持有中華人民共和國(guó)公安交通管理部門簽發(fā)的有效機(jī)動(dòng)車駕駛證，并具備壹年以上的駕駛經(jīng)歷，非合同上注明的駕駛員無權(quán)駕駛甲方的車輛，否則造成的一切后果由乙方負(fù)責(zé)。ThevehiclecanonlybedrivenbylesseeoranyotherpersonwhoisconsentedbyPartyAwritten approval andwhoholdsavalid driver‘slicense foroveroneyearpermitted bytrafficadministrationofficeofthePeople ’sRepublicofChina ，orPartyBshallundertakealltheresponsibilitiesofrelatedresponsibilitiesincludinginsuranceindemnificationclaims.3、乙方租用的車輛不能轉(zhuǎn)租、轉(zhuǎn)借、變賣、抵押，不能賦予自己對(duì)車輛任何超出本合同的其它權(quán)力。PartyBisnotallowedtore-rent ，mortgage，re-selltheleasedvehicleoranyotherpowerbeyondthecontract.64、嚴(yán)禁使用車輛進(jìn)行違法活動(dòng)，嚴(yán)禁使用車輛參加競(jìng)賽及作測(cè)試使用，嚴(yán)禁使用車輛進(jìn)行盈利性質(zhì)的營(yíng)運(yùn)，嚴(yán)禁運(yùn)送易燃、易爆、易腐蝕品等對(duì)車輛安全造成影響的物品。PartyBisneitherallowedtoviolatelawsandregulationsorusethevehiclefortestandcompetitionandisnotallowedtousethevehicleforprofitableserviceortransport offlammable，explosive ，corrosive orradioactivematerials ，etc.harmfultovehiclesafety.5、乙方應(yīng)做到每日檢查車輛的機(jī)油、剎車油、助力轉(zhuǎn)向油、防凍液、輪胎氣壓等，發(fā)現(xiàn)問題速與甲方聯(lián)系，否則造成的一切后果由乙方負(fù)責(zé)。Tocheckondaily basisthelubricating oil，brakefluid ，coolingwater ，batteryfluid ，andtyreair-pressure ，andimmediately inform PartyAif anyabnormality isfoundout，orPartyBshallundertakealltheresponsibilities.6、乙方租用的車輛發(fā)生各類機(jī)件故障、事故車修復(fù)，必須到甲方指定的修理廠進(jìn)行修理，不得自行送外廠修理。人為造成的機(jī)件故障，修理費(fèi)用自理。歸還車輛時(shí)，經(jīng)檢驗(yàn)因乙方自行送外廠修理，造成車輛修理質(zhì)量低劣、不符規(guī)格的部件，需重新修復(fù)的，乙方必須承擔(dān)由此造成修復(fù)費(fèi)用。7Incaseofvehicledamage ，PartyBshallhavethevehiclerepairedattheplacedesignatedbyPartyA.OtherwisePartyBshallpayallexpensescausedbylow-qualityrepairorequipment.PartyBshallpayexpensesforalltheman-madedamages.7、乙方若遺失牌照或有關(guān)證件，應(yīng)立刻向甲方申請(qǐng)補(bǔ)辦，補(bǔ)辦期間的車輛租金及補(bǔ)辦手續(xù)費(fèi)由乙方承擔(dān)。If thelicense plate oranydocumentsaboutthevehiclearelostduringtheleasingterm ，PartyBshallinformPartyAandmakesubstitutionimmediatelyandbearallexpensesforthesubstitutionandrentduringthesuspenseofusingthevehicle.8、乙方要保護(hù)好甲方車輛上的特征標(biāo)志，不得涂改遺失，嚴(yán)禁私自拆、換車輛上的任何部件及設(shè)備，嚴(yán)禁拆動(dòng)里程表，如有拆動(dòng)，將按使用期內(nèi)規(guī)定里程總數(shù)的 5倍罰款。PartyBisnotallowedtorepairorchangeanypart ，accessory，interenvironmentandexteriorappearanceoftherentedvehicle. It isprohibited tochangeorthrowawayanypartandequipmentorpulloutorrefitthemileagemeters.Incaseanytrace ofsuchpulling outorrefitting isfoundout，Party8Bshallpayapenaltyequaltofivetimestheamountforthemileagelimiteddefinedintheleaseforthetotalleseterm.四、意外交通事故處理及保險(xiǎn) TrafficAccidentandInsurance1、乙方發(fā)生交通事故（包括非道路交通事故），應(yīng)立即向交通管理部門報(bào)案，保護(hù)好現(xiàn)場(chǎng)（快處快撤除外），并按市內(nèi)2小時(shí)、市外4小時(shí)的原則通知甲方，事故處理結(jié)束將交通管理部門的證明和其它索賠材料在15天內(nèi)送交甲方，甲方據(jù)此辦理保險(xiǎn)索賠事宜，逾期因不能提供交通管理部門證明和其它索賠材料而無法向保險(xiǎn)公司索賠的，其事故造成的全部損失均由乙方承擔(dān)。發(fā)生事故后，未經(jīng)甲方同意，乙方不得擅自處理事故和安排修理。Incaseoftrafficaccident （includingofnon-roadaccident），Party Bshall preserve thesite wheresuchaccidenttakeplace（excluding fast dealandmoveaway）andimmediatelyreporttrafficadministrationdepartmentandinformPartyAundertheprincipleofwithin2hoursCity-inand4hoursout-of-city.PartyBshallprovideareportontheactualaccident. Certificate for casesettlement issuedbythetrafficadministrationdepartmentandotherindemnificationdocumentswithin fifteen （15）daysshouldbetransmitted toPartyA.PartyshallassistPartyBinhandlingaccidentsandberesponsible9forclaiminginsuranceindemnifications.IfPartyBfailstoprovidenecessarydocumentstoPartyAwithinfifteendayscountingfromthedatewhentheinsuredvehicleisrepairedorwhenthecaseisconcluded ，itshallberegardedthatPartyBrevoketheright for claimsvoluntarily. PartyBcanonlyhandletheaccidentandhavetheleasedvehiclerepairedbyPartyA‘swrittenapproval.2、事故期間，由于乙方司機(jī)駕駛引起的交通事故，根據(jù)保險(xiǎn)的條款和交通部門裁定，第三者強(qiáng)制險(xiǎn)部分除外，負(fù)事故次責(zé)的，賠償甲方事故費(fèi)用總額的 10%；負(fù)事故半責(zé)的，負(fù)責(zé)賠償甲方事故費(fèi)用總額的15%；負(fù)事故主責(zé)的，賠償甲方事故費(fèi)用總額的 20%；負(fù)事故全責(zé)的，賠償甲方事故費(fèi)用總額的 30%.Incaseofsuchaccident causedbyPartyB‘sdesignateddriver，accordingtothejudgingoftrafficadministrationdepartmentandinsurancecompany，asidethirdpersonliabilityriskinsurance，PartyBshallpay10percentoftotalaccidentexpenseswithlesserresponsibilities；pay15percentoftotalaccidentexpenseswithhalfresponsibilities；pay15percentoftotalaccidentexpenseswithhalfresponsibilities；pay20percentoftotalaccidentexpenseswithminorresponsibilitiesandpay30percentexpensesoftotalaccident10expenseswithwholeresponsibilities.3、乙方所租用車輛在非正式道路上發(fā)生單車輕微肇事事故，應(yīng)立即向交通管理部門報(bào)案或向保險(xiǎn)公司報(bào)案，等待保險(xiǎn)公司到現(xiàn)場(chǎng)勘查，甲方代為向保險(xiǎn)公司索賠，保險(xiǎn)公司實(shí)行 40%的絕對(duì)免賠率，理賠不足部分由乙方承擔(dān)。Incaseofslightaccidentinnon-roadenvironment ，PartyBshall report totraffic administration departmentortheinsurancecompanyandwaitingfortheperambulation.PartyAshall beresponsibility forclaiming insurance indemnification.Insurance companydoesnottakeforty （40）per centexpensesoftotal accident expense，soPartyBshall beresponsible forallthedamagesasidefromtheinsuranceindemnifications.4、乙方租用甲方車輛發(fā)生各類事故后的損失費(fèi)用，先由乙方支付，甲方按保險(xiǎn)公司理賠規(guī)定辦理索賠手續(xù)，且在保險(xiǎn)公司理賠后，由甲方退還給乙方。保險(xiǎn)公司免賠部分由乙方承擔(dān)。Incaseofvehicledamages ，PartyBshallpaytotalexpensesfirstly.PartyAshallberesponsibleforclaiminginsuranceindemnificationsaccordingtotheproceduresandregulationsoftheinsurancecompanyandrefundtheexactindemnificationstoPartyB.partyBshallberesponsiblefor11alldamagesasidefromtheinsuranceindemnifications.5、乙方如發(fā)生違反交通法規(guī)的嚴(yán)重違法和交通事故，造成保險(xiǎn)費(fèi)率的上浮部分，由乙方承擔(dān)。具體上浮按保險(xiǎn)公司標(biāo)準(zhǔn)執(zhí)行。Incaseofserious accident orvehicle damages，PartyA‘svehicle insurance rate goupbyit，Party Bshall paytheextraincreasedinsuranceexpensesaccordingtothecriterionofinsurancecompany.6、由乙方指定的駕駛員造成各類事故的車輛停駛和修理期間，甲方不免費(fèi)提供替換車；乙方要承擔(dān)事故車停駛、修理期間的租金。Duringtheprocessingoftheaccidentcausedbythedriver designated byPartyB，Party Bshall beresponsible forthevehicle rentstill. PartyAdonotprovide freesubstitutionvehicle.7、乙方發(fā)生行車事故，無論有無責(zé)任，均按事故修理費(fèi)的10%補(bǔ)償甲方車輛的殘值損失。Inanycaseofvehicledamages，PartyBshallcompensatepartyAanamountatten（10）percenttotalexpensesfordamagecausedbyaccelerateddepreciation.128、乙方在租賃期間發(fā)生車輛丟失，須出示當(dāng)?shù)毓补芾聿块T出具的有效證明，由甲方向保險(xiǎn)公司辦理索賠手續(xù)。乙方必須承擔(dān)車輛丟失后原車型三個(gè)月的租賃費(fèi)和保險(xiǎn)公司賠償后不足部分的車輛損失費(fèi)。If theleasedvehicle isstolen during theleaseterm，PartyBshallprovideeffectiveevidenceissuedbyresidentsPoliceadministrationdepartment.AndPartyAshallberesponsibleforclaiminginsuranceindemnification.PartyBshall undertaketheresponsibilities ofthree （3）monthsrentandall damageexpensesasidefrominsurance indemnifications.9、乙方必須嚴(yán)格遵守道路交通安全法和實(shí)施條例，確保行車的安全。如發(fā)生交通違法和交通事故或者被“電子警察”拍攝行為的，必須積極做好事后工作，自覺接受公安交警部門處理，并及時(shí)交納罰金，對(duì)于未繳納部分，甲方有權(quán)從押金中扣除。乙方歸還車輛 7天以后，甲方退還乙方不計(jì)利息的押金余額。根據(jù)上海市機(jī)動(dòng)車第三者責(zé)任保險(xiǎn)費(fèi)率浮動(dòng)制度的規(guī)定，乙方必須承擔(dān)因?yàn)樯鲜鲈蛩恋乃廛囕v保險(xiǎn)費(fèi)費(fèi)用上浮的責(zé)任。如果因?yàn)槲唇邮芄步痪块T處理而造成所作用車輛不能參加年度檢驗(yàn)，致使車輛被強(qiáng)制停駛，乙方必須承擔(dān)相關(guān)責(zé)任和費(fèi)用。PartyBshallstrictlyabidebythetrafficlawandregulations during theleaseterm. Incaseofbreachoftraffic13regulationandlaw（includingpoliceCCTV），PartyBshallberesponsibleforallrelatedpenaltyvoluntarily.PartyAhastherighttodeductthepenaltythatPartyBhasnotpaidfromthedeposit.PartyBwillberefundedthedepositwithoutinterestsafter7workingdaysoftheleasedcarreturned.AccordingtothefloatingregulationofShanghaithirdpersonliabilityriskinsurance，PartyBshallundertaketheresponsibilitiesfortheincreasedinsuranceexpensescausedbythereasonmentionedabove.Moreover，PartyBshallberesponsibilitiesforpenaltyandexpensesiftheleasedvehiclecannotpassannualcheckandevenarestoppedrunning.五、違約責(zé)任LiabilitiesofBreachingtheContracts1、乙方如果不履行合同條款，甲方有權(quán)收回車輛，終止合同，并有權(quán)收取賠償金。PartyAhastherighttoterminatethecontractandtakebacktheleasedvehicleifPartyBfailstocarryouthisimportantobligationsunderthiscontractandmayclaimindemnificationfromPartyB.2、合同期滿后，乙方未辦理延期手續(xù)，也未按時(shí)歸還甲方車輛的，甲方有權(quán)提交司法機(jī)關(guān)，依法處理。給甲方造成經(jīng)濟(jì)損失的，14按合同第一條第 4款予以賠償。Whenthedeadlineofthiscontractreached，PartyBshallreturntheleasedcarorexpendthecontractimmediately，orPartyAhastherighttoreporttojudicialofficeanddecideaccordingtolaw.PartyBshalltaketheresponsibilitiesforPartyA‘seconomicdamagesaccordingto4termofArticle1ofthiscontract.3、在合同期內(nèi)因乙方原因提前終止合同，乙方須首先付清實(shí)際租賃期間的相關(guān)費(fèi)用并賠償相關(guān)費(fèi)用。租期壹月及壹月以上的，賠償甲方不低于合同總金額的 30%費(fèi)用，租期壹周以上壹月以內(nèi)的支付合同未履行部分總租金 40%的費(fèi)用補(bǔ)償給甲方。IncaseofterminatethecontractinadvancecausedbyPartyB，heshallpaythetotalrentandberesponsibleforrelatedexpenses.PartyBshallpayTen（30）percentpenaltyofthetotalrentiftheleasedtermcoversonemonthorabove.AndPartyBshallpaytoPartyATwenty（40）percentpenaltyoftheremainingrentiftheleasedtermcoversOneWeektoOneMonth.4、乙方應(yīng)嚴(yán)格按照本合同履行其義務(wù)，由于乙方未能完善履行其義務(wù)而造成的損失，均由乙方自行承擔(dān)，造成甲方任何損失，15乙方應(yīng)付賠償責(zé)任。PartyBshallstrictlycarryouthisresponsibilitiesofthiscontractandbeartotalresponsibilitiesvoluntaryfordamagesandexpensescausedbyincompletelyfulfillingresponsibilities.AndPartyAisentitledtoclaimindemnificationsfromanydamagescausedbyPartyB.六、其他Others1、本車使用93型號(hào)燃料，因未使用指定燃料造成的車輛損失等后果由乙方承擔(dān)。車輛燃料費(fèi)用由乙方自理。還車時(shí)，若車內(nèi)存油低于出廠時(shí)存油，乙方要按市場(chǎng)價(jià)向甲方繳納所差油費(fèi)。Theleasedvehiclesuits93 （model）gasoline.PartyBshallbearalldamagescausebymisusinggasoline.PartyBitselfshalltakethegasolinecostduringleasedtermandpaythebalancegasolinefeecomparewithoutcometimeaccordingtothetemporalgasolineprice.2、因車輛行駛中發(fā)生故障給乙方造成保險(xiǎn)責(zé)任范圍以外的經(jīng)濟(jì)損失，甲方不予負(fù)責(zé)。PartyAdoesnottakeresponsibilitiesforPartyB ‘sdamagesoutofinsuranceforcecausedbymachineconkout.163、履行合同中發(fā)生異議的，由雙方協(xié)商解決，協(xié)商不成而提出訴訟，由甲方所在地人民法院受理。Anydisputesarisingfromorinconnectionwiththiscontract shall besettled throughamicableconsultation. Incasenosettlement isreachedthroughconsultations ，the twopartiesagreetorefer thedisputes tothePeople‘scourtforsettlementinPartyA ’sarea.4、合同期間，乙方司機(jī)發(fā)生電子警察違章抄報(bào)者，乙方應(yīng)積極配合處理違章，否則甲方有權(quán)按乙方租賃時(shí)登記司機(jī)的駕駛證上報(bào)交通管理部門，由交通管理部門負(fù)責(zé)催辦，直至吊銷駕駛證，其后果由乙方自負(fù)。IncaseofrecordedbyPoliceCCTV ，thedriversdesignatedbyPartyBshallpositivelytakethetreatmentandpaythepenalty intime. Otherwise，Party Aisentitled toreportthedrivers ‘information totraffic administration office andaskforinsistence.PartyBshallbeartheresponsibilitiestothedamagesincludingrevokingdriverlicense.5、本合同自雙方簽字蓋章后立即生效，合同壹式貳份，雙方各執(zhí)壹份。Thiscontracthasitslegaleffectafterbothofthe17parties signature.
