英文聘用合同聘用外國(guó)人EmploymentContractforForeignEmployee1.EmploymentThisagreement(“Agreement”)ismadeon[insertdate]between[insertemployername](the“Employer”)and[insertemployeename](the“Employee”),acitizenof[insertcountry],withanaddressof[insertemployee’saddress](the“Address”),foremploymentas[insertposition](the“Position”).2.TermofEmploymentTheEmployeeshallbeemployedfrom[insertstartdate]to[insertenddate](the“Term”),unlesstheemploymentisterminatedearlierbytheEmployerortheEmployeeasprovidedherein.3.DutiesandObligationsDuringtheTermofthisAgreement,theEmployeeshallperformthedutiesandresponsibilitiesofthePositiontothebestoftheEmployee’sabilityandinaccordancewiththeEmployer’spoliciesandprocedures.TheEmployeealsoagreestocomplywithalllaws,ordinances,rules,andregulationsof[insertcountry]andallotherapplicablelaws,ordinances,rules,andregulationsofanyotherjurisdictionwheretheEmployeeperformsworkfortheEmployer.4.CompensationTheEmployeeshallbepaidasalaryof[insertsalary]per[inserttimeperiod](the“Salary”),subjecttoallapplicabletaxesanddeductions.TheEmployeeshallalsobeeligiblefor[insertbenefits](the“Benefits”).5.WorkingHoursandOvertimeTheEmployeeshallwork[insertnumberofhours]perweek,between[insertstarttime]and[insertendtime],with[insertnumberofbreaks]breaksof[insertduration]each.TheEmployeeshallbeeligibleforovertimepayattherateof[insertrate]oftheEmployee’shourlyrateforeachhourworkedinexcessof[insertnumber]hoursinaweek.6.TerminationTheEmployerortheEmployeemayterminatethisAgreementatanytimeandforanyreason,withorwithoutcause,byproviding[insertnoticeperiod]days’writtennoticetotheotherparty.TheEmployershallhavetherighttoterminatetheEmployee’semploymentimmediatelyandwithoutpriornoticeintheeventofanybreachofanytermorconditionofthisAgreementbytheEmployee,whichbreach,inthereasonableopinionoftheEmployer,isofsuchanatureastowarrantanimmediateterminationofemployment.7.ConfidentialityandNon-CompetitionDuringtheTermofthisAgreementandthereafter,theEmployeeagreestokeepconfidentialallconfidentialandproprietaryinformationoftheEmployerandtorefrainfromdisclosingsuchinformationtoanythirdpartywithoutthepriorwrittenconsentoftheEmployer.TheEmployeealsoagreesthatforaperiodof[insertduration]followingtheterminationofthisAgreement,theEmployeeshallnotengageinanybusinessthatisincompetitionwiththeEmployerorthatcompeteswithanyaspectoftheEmployer’sbusiness.8.GoverningLawandJurisdictionThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsof[insertcountry],withoutgivingeffecttoanyprinciplesofconflictsoflaw.Thepartiesagreetosubmittotheexclusivejurisdictionofthecourtsof[insertcountry]fortheresolutionofanydisputesarisingunderorinconnectionwiththisAgreement.9.EntireAgreementThisAgreementconstitutestheentireagreementbetweenthepartiesandsupersedesallprioragreements,understandings,negotiations,anddiscussions,whetheroralorwritten,betweenthepartieswithrespecttothesubjectmatterhereof.10.AmendmentsandWaiversNoamendment,modification,orwaiverofanyprovisionofthisAgreementshallbeeffectiveunlessitisinwritingandsignedbybothparties.ThefailureofeitherpartytoenforceanyprovisionofthisAgreementshallnotbedeemedawaiverofsuchprovisionoranyotherprovisionofthisAgreement.11.CounterpartsandElectronicSignaturesThisAgreementmaybeexecutedinanynumberofcounterparts,eachofwhichshallbedeemedanoriginal,andallofwhichtogethershallconstituteoneandthesameinstrument.ThisAgreementmaybeexecutedanddeliveredbyelectronicsignatures,whichshallhavethesameeffectforallpurposesasoriginalsignatures.INWITNESSWHEREOF,thepartieshaveexecutedthisEmploymentContractasof
