房屋租賃合同(英文)

HousingLeaseAgreement

ThisHousingLeaseAgreement(the"Agreement")ismadeandenteredintoasof[Date],byandbetween[LandlordName],a[State]resident,whoseaddressis[LandlordAddress](hereinafterreferredtoas"Landlord"),and[TenantName],a[State]resident,whoseaddressis[TenantAddress](hereinafterreferredtoas"Tenant").

WHEREAS,Landlordistheownerofthepropertylocatedat[PropertyAddress](the"Premises"),anddesirestoleasethePremisestoTenant;and

WHEREAS,TenantdesirestoleasethePremisesfromLandlordforthepurposessetforthherein.

NOW,THEREFORE,inconsiderationofthemutualcovenantsandagreementscontainedinthisAgreement,thepartiesheretoagreeasfollows:

1.LeaseTerm

Thetermofthisleaseshallcommenceon[StartDate]andshallexpireon[EndDate],unlesssoonerterminatedasprovidedherein(the"Term").

2.Rent

TenantshallpaytoLandlordamonthlyrentof[RentAmount],payableinadvanceonorbeforethefirstdayofeachcalendarmonthduringtheTerm.Timeisoftheessencewithrespecttothepaymentofrent.Ifanyrentisnotpaidwhendue,Tenantshallpayalatechargeequalto[LateFeePercentage]%oftheoverduerent,whichshallbeconsideredearnedatthetimetherentisdueandnotasapenalty.

3.SecurityDeposit

TenantshallpaytoLandlordasecuritydepositintheamountof[SecurityDepositAmount],whichshallbeappliedtowardsthelastmonth'srentoranydamagescausedbyTenantbeyondnormalwearandtear.ThesecuritydepositshallbereturnedtoTenantwithin[NumberofDays]daysaftertheterminationofthisAgreement,providedthatTenanthascompliedwithalltermsandconditionshereof.

4.UseofPremises

TenantshallusethePremisesonlyforresidentialpurposesandshallnotusethePremisesforanyillegalorimmoralpurposes.TenantshallnotassignthisAgreementorsubletthePremiseswithoutthepriorwrittenconsentofLandlord.

5.MaintenanceandRepairs

LandlordshallkeepthePremisesingoodrepair,reasonablewearandtearexcepted.TenantshallgiveLandlordpromptwrittennoticeofanyneedforrepairforwhichLandlordisresponsible.TenantshallkeepthePremisescleanandsanitaryandshallnotdefaceordamagethePremises.TenantshallberesponsibleforallrepairsnecessitatedbyTenant'smisuseornegligence.

6.Utilities

TenantshallpayforallutilitiesusedinthePremises,includingbutnotlimitedtoelectricity,gas,water,andsewage.Landlordshallpayforanyotherutilitieswhicharenottypicallytheresponsibilityofthetenantunderlocallaw.

7.Insurance

LandlordshallmaintaininsurancecoverageonthePremisesinanamountnotlessthan[InsuranceAmount],coveringfire,extendedcoverage,andanyotherriskscustomaryforresidentialproperties.Tenantshallmaintainrenter'sinsurancecoveringpersonalpropertyandliability.

8.CompliancewithLaws

Tenantshallcomplywithallfederal,state,andlocallaws,ordinances,andregulationsapplicabletotheuseandoccupancyofthePremises.

9.QuietEnjoyment

LandlordcovenantsthatTenantshallpeaceablyandquietlypossessandenjoythePremisesduringtheTerm,subjecttothetermsandconditionsofthisAgreement.

10.Access

LandlordshallhavetherighttoenterthePremisesatreasonabletimesforthepurposeofmakingnecessaryoragreeduponrepairsorinspections,providedthatLandlordgivesTenantatleast[NoticePeriod]noticeofsuchentry.

11.AlterationsandImprovements

TenantshallnotmakeanyalterationsorimprovementstothePremiseswithoutthepriorwrittenconsentofLandlord.AnyalterationsorimprovementsmadewithLandlord'sconsentshallbemadeatTenant'sexpenseandshallbecomethepropertyofLandlorduponcompletion.

12.HoldHarmless

Tenantherebyagreestoindemnify,defend,andholdharmlessLandlordfromandagainstanyandallclaims,demands,causesofaction,liabilities,losses,damages,costs,andexpenses,includingwithoutlimitationreasonableattorneys'fees,arisingoutoforinconnectionwithTenant'suseoroccupancyofthePremises.

13.Default

IfTenantfailstopayrentwhendue,orifTenantbreachesanyothertermorconditionofthisAgreement,Landlordmay,atitsoption,terminatethisAgreementandrecoverpossessionofthePremises.Insuchevent,Tenantshallbeliableforallrentdueandowing,aswellasanyotherdamagessufferedbyLandlordasaresultofTenant'sdefault.

14.Attorney'sFees

IntheeventanyactionorproceedingisbroughttoenforceorinterpretthetermsofthisAgreement,theprevailingpartyshallbeentitledtorecoverreasonableattorney'sfeesandcosts.

15.GoverningLaw

ThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsoftheStateof[State].

16.Severability

IfanyprovisionofthisAgreementisheldtobeinvalidorunenforceable,suchprovisionshallbestruckandtheremainingprovisionsshallbeenforced.

17.EntireAgreement

ThisAgreementconstitutestheentireagreementbetweenthepartiesandsupersedesallpriornegotiations,representations,andagreements,whetheroralorwritten.

18.Modification

ThisAgreementmaynotbemodifiedoramendedexceptbyawritteninstrumentsignedbybothparties.

19.Notices

AllnoticesrequiredorpermittedunderthisAgreementshallbeinwritingandshallbedeemedeffectiveuponpersonaldeliveryorthreedaysafterdepositintheUnitedStatesmail,certifiedorregistered,returnreceiptrequested,tothepartytowhomthenoticeisaddressedat
