1、 英文雇傭合同模板Employment Contract甲方(用人單位)Party A:地址:法定代表人:乙方(勞動者)Party B:身份證號碼:ID No:住址:依照中華人民共和國勞動法有關(guān)規(guī)定,結(jié)合本公司實際,甲乙雙方本著平等、自愿、協(xié)商一致的原則達成如下協(xié)議According to the Labor Law of PRC China, Party A and Party B agree as follows:一、合同期限 Contract Period本合同期_年_ 月 _日起至_年 _月_日或本合同約定終止條件出現(xiàn)時止。This agreement is valid from (Y
2、/M/D) until (Y/M/D) or terminated by either party二、工作內(nèi)容和工作時間 Responsibility & working hours1. 甲方聘請乙方擔任 部門 職務(wù),詳見職務(wù)說明書。Party Bs Department: Party Bs position:Please refer to the job description for details.2. 乙方須完成甲方安排的生產(chǎn)(工作)任務(wù)Party B must accomplish his/her regular work and additional assignments on
3、time3. 每天工作8小時,每周工作共40小時。There are 8 working hours a day, 40 working hours a week.4. 甲方如因業(yè)務(wù)拓展變化需要對乙方的工作崗位及工作區(qū)域進行調(diào)整,乙方應(yīng)當接受。如因甲方公司業(yè)務(wù)擴展需要或公司合并分立等變更,乙方同意按照法律規(guī)定延續(xù)此合同,并接受甲方安排,在_(某地區(qū))工作。If Party A needed to adjust Party Bs position and working area for business development variety, Party B should accept it
4、.三、工資 Salary乙方每月的基本工資:RMB 績效工資:RMB 綜合福利金:RMB ,工資總額為RMB 元(該金額尚未扣除稅金、住房費用以及社會保險中個人應(yīng)繳的部份),另甲方予以乙方工資總額7%的住房公積金(如法律規(guī)定住房公積金繳交基數(shù)有上限,則依照法規(guī)執(zhí)行)試用期滿,經(jīng)考核后,根據(jù)考核結(jié)果確定是否正式錄用,正式錄用后薪金保持不變。甲方將視公司的盈利情況和乙方的考核結(jié)果,于每年的三月份進行薪金調(diào)整。Party Bs monthly total revenue (before the deduction of tax, housing fund, social insurance paid

After probation total revenue would be

Party Bs salary will be reviewed annually in March and adjusted in light of Party Bs performance and prevailing conditions.四、工資的發(fā)放 Payment甲方于每月_日前通過銀行轉(zhuǎn)帳支付發(fā)放上月工資。Salary will be paid to Party Bs account by T/T before the _th of the following month.五、超時工作 Over Time乙方應(yīng)致力于提高工作效率,按時完成生產(chǎn)、工作任務(wù)。如因
7、特殊情況需要加班,可自行安排。如乙方希望通過自行安排加班取得加班費,則乙方必須在加班前四小時填寫加班申請表呈總經(jīng)理審批。否則,視為無效加班,詳見員工手冊。Party B must try his best to increase the working efficiency to meet Party As requirement. If there are special circumstances that Party B has to work overtime, Party B can arrange by themselves. If Party B requests OT paym
8、ent, he/she must fill in the OT application form and have it approved by GM. OT Application Form without authorized signature is not valid.六、加班費 OT Compensation乙方經(jīng)甲方批準在工作日加班,甲方必須支付給乙方基本工資150%的報酬;休息日被安排工作而甲方又不能夠給予乙方同等時間的補休,則甲方須支付給乙方基本工資200%的報酬;若在國家法定休假日被安排工作,甲方付給乙方基本工資300%的報酬。If Party B works over ti
9、me and has approved by Party A, he/she will be offered the same period of compensation leave or OT salary according to Labor Law of PRC China.七、假期與福利 Holiday & Benefits1. 有薪國家法定假日 Statutory Holiday of PRC China with pay2. 有薪婚假/產(chǎn)假/喪假 Leave for Marriage, Maternity and Mourning with pay.3. 有薪年假 Annual
10、leave with pay4. 社會保險 Social Insurance5. 年度獎金Annual bonus (based on the months worked with party A at the rate of one months wage for each full year worked. )詳情請參照員工手冊Please refer to Party As employee manual for detail info.八、勞動紀律 Discipline乙方應(yīng)嚴格遵守甲方制定的各項規(guī)章制度和勞動紀律(詳請請參照員工手冊執(zhí)行)Party B shall strictly
11、obey Party A regulations and discipline. Please refer to Party As employee manual.九、保密協(xié)議 Confidentiality乙方需嚴格保守工作過程中接觸和了解到的公司商業(yè)秘密(包括生產(chǎn)技巧、工藝流程、技術(shù)秘密、管理方法、產(chǎn)銷策略、貨源情報、設(shè)計圖紙、成本價格和客戶資料),否則將受到行政處罰(如無條件解雇、賠償?shù)龋?;觸犯刑法的,甲方將有權(quán)移交司法機關(guān)處理。乙方調(diào)離甲方,應(yīng)得到甲方同意,并將所有商業(yè)秘密資料移交甲方,同時承擔不向外泄露的義務(wù),并保證半年內(nèi)不得利用甲方商業(yè)秘密在生產(chǎn)同類且與甲方有競爭關(guān)系的產(chǎn)品的其他企
12、業(yè)內(nèi)任職。否則,甲方有權(quán)要求乙方賠償因此而帶來的一切經(jīng)濟損失。The recipient shall undertake the obligation to keep confidential, in accordance with the scope and duration agreed upon by both parties, the technical secrets contained in the technology provided by the supplier, which have not been made public.十、合同終止 Termination1. 終止
13、本合同條件 Termination conditionsA. 試用期間,雙方皆可即時通知對方解除本合同;During the probation period, either side can terminate the contract by immediate effect.B. 試用期滿后,任何一方欲解除合同,須提前三十日以書面形式通知對方。否則,違約方須向守約方支付違約金(違約金為乙方一個月的工資),若造成守約方經(jīng)濟損失的,應(yīng)依法承擔賠償責任。Either side can terminate the contract by giving 30 days notice in writt
14、en form after probation period.2. 甲方在下列情況下可隨時直接地通知乙方解除本合同,無須履行任何法定義務(wù)和手續(xù),無須向乙方補償If any case of the following circumstances, Party A has the right to inform Party B rescission of the contract:A. 乙方在試用期間達不到甲方的要求;Party Bs performance cant meet Party As requirement.B. 乙方嚴重失職,給甲方利益造成重大損失的;The other party
15、has breached the contract, to the extent that such breach has seriously affected the economic benefits expected when concluding the contractC. 違反甲方有關(guān)規(guī)定,應(yīng)予開除的,詳情請參照員工手冊執(zhí)行。The condition agreed on in the Party As employee manual for rescission of the contract has arisen3. 乙方在下列情況下終止本合同不需向甲方補償If any one
16、 of the following circumstances, Party B has the right of inform Party A rescission of the contract without any compensation:A. 被非法限制人身自由的手段強迫勞動的;Party B is forced to work by illegal means.B. 未按本合同約定支付勞動報酬或勞動條件的;Party B cannot get the salary or working conditions which agreed in the contract.十一、甲、乙雙方須共同遵守國家有關(guān)法規(guī)以及甲方員工手冊的有關(guān)規(guī)定。Both Party A and Party B shall obey the related regulation of PRC China and Party As employee manual.十二、本合同自甲方蓋章、乙方簽署之日起生效。This contract shall come into effect since both sides sign th
