1、垃圾管理計(jì)劃 MARPOL 73/78 ANNEX V，REG. 10前言INTRODUCTION1. 于2013年1月1日生效的經(jīng)修訂的MARPOL附則，除非附則明確許可，禁止將任何種類的垃圾排放入海。The revised MARPOL Annex V with an entry into force date of 1 January 2013, prohibits the discharge of all types of garbage into the sea unless explicitly permitted under the Annex.2. MARPOL附則規(guī)定，除了M

2、ARPOL附則第3、4、5和6條的特殊許可外，禁止排放一切垃圾。MARPOL附則推翻了歷史上按垃圾性質(zhì)來認(rèn)定哪些垃圾可以排放入海的規(guī)定方式以及距岸距離的定義。第7條規(guī)定了應(yīng)急和非正常情況下的例外情況。原則上排放限于食品廢棄物、標(biāo)明的貨物殘余、動物尸體以及洗滌水中包含的標(biāo)明的對環(huán)境無害的清潔劑、添加劑和貨物殘余。建議船舶使用港口接收設(shè)施作為排放所有垃圾的首選方式。Under the revised MARPOL Annex V, discharge of all garbage is now prohibited, except as specifically permitted in regu

3、lations 3, 4, 5 and 6 of MARPOL Annex V. MARPOL Annex V reverses the historical presumption that garbage may be discharged into the sea based on the nature of the garbage and defined distances from shore. Regulation 7 provides limited exceptions to these regulations in emergency and non-routine situ

4、ations. Generally, discharge is restricted to food wastes, identified cargo residues, animal carcasses, and identified cleaning agents and additives and cargo residues entrained in washwater which are not harmful to the marine environment. It is recommended that ships use port reception facilities a

6、中的要求和有關(guān)國內(nèi)法規(guī)。The main objectives of this plan are to assist shipowners, ship operators, ships' crew, in complying with requirements set forth in Annex V and relevant domestic laws.5. 本計(jì)劃根據(jù)國際海事組織制定的經(jīng)1978年議定書修訂的1973年國際防止船舶造成污染公約（以下簡稱MARPOL73/78公約）經(jīng)修訂的附則V第10條的要求和我國有關(guān)規(guī)定編寫的。This plan is written in acc

7、ordance with the requirements Regulation 10 of Revised MARPOL Annex V of the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto (MARPOL73/78) by the International Maritime Organization and the domestic laws requirements.6.

9、idance on shipboard garbage handling such as, ISO 21070 "Standard for the Management and handling of shipboard garbage"7. 本計(jì)劃是為本船船員在船上使用，以船員使用的工作語言和英文編寫。This plan is used for the crew onboard, and written in both the working language of the crew and English.8. 本船船員應(yīng)嚴(yán)格按照本“計(jì)劃”的規(guī)定有效地管理垃圾，防止水域

10、污染。Crew onboard should observe the requirements of the Plan in order to prevent garbage pollution.第一章 垃圾管理計(jì)劃實(shí)施人員職責(zé)Duties of the persons of the implementation of the plan1 總負(fù)責(zé)人職責(zé)Duties of the persons in full charge of carrying out the plan本船垃圾管理計(jì)劃實(shí)施總負(fù)責(zé)人是本船船長，其主要職責(zé)是：The ships master is in full charge

His duties will include:(1). 負(fù)責(zé)垃圾管理計(jì)劃在船上的全面貫徹實(shí)施；overall implementation of the plan on board.(2). 負(fù)責(zé)組織全體船員的培訓(xùn)、教育工作；training and education for the crew;(3). 船舶發(fā)生垃圾污染事故時，組織船員進(jìn)行應(yīng)急處理并及時報(bào)告主管機(jī)關(guān)。Muster the crew to take emergency action when garbage pollution happens.2. 具體實(shí)施負(fù)責(zé)人

12、職責(zé)The duties of the designated person本船垃圾管理計(jì)劃具體實(shí)施負(fù)責(zé)人是本船大副，其主要職責(zé)是：The chief officer is the designated person of the implementation of the plan, his duties will include:(1). 檢查“垃圾公告牌”是否符合要求；ensuring placards are displayed in accordance with the Regulations specified in MARPOL 73/78(2). 教育船員遵守船上垃圾管理計(jì)劃；

13、monitoring the crew to comply with the Plan(3). 根據(jù)設(shè)備功能進(jìn)行垃圾焚燒；incineration of wastes in accordance with the equipment manufacturers instructions;(4). 聯(lián)系垃圾的岸上回收業(yè)務(wù)；liaison the shore authorities for port reception facilities;(5). 按照規(guī)則的要求在記錄簿上填寫并簽字。Signing the garbage record book as required by the regul

16、. 嚴(yán)格遵守垃圾管理計(jì)劃的要求；observe the plan strictly;(2). 認(rèn)真參加垃圾管理計(jì)劃的培訓(xùn)和演習(xí)；take part in the training and drilling (3). 船舶發(fā)生垃圾污染事故時， 按大副指令參加應(yīng)急處理工作。Take emergency actions when garbage pollution happens.第二章 法定要求Chapter II REGULATORY REQUIREMENTASMARPOL 73/78 附則V第10條Regulation 10 of Annex V of MARPOL 73/78 reads a

Garbage management plans and garbage recording-keeping(1)(a) 總長度為 12 m 或以上的船舶和固定或浮動平臺均應(yīng)張貼告示以使船員和乘客知曉本附則第 3、4、5和6條中適用的排放要求。Every ship of 12 m or more in length overall and fixed or floating platforms shall display placards which notify the crew a

20、ove, and every ship which is certified to carry 15 or more persons, and fixed or floating platforms shall carry a garbage management plan which the crew shall follow. This plan shall provide written procedures for minimizing, collecting, storing, processing and disposing of garbage, including the us

21、e of the equipment on board. It shall also designate the person or persons in charge of carrying out the plan. Such a plan shall be based on the guidelines developed by the Organization 2 and written in the working language of the crew.(3) 在公約其他締約國管轄下的港口或近海裝卸站之間從事運(yùn)輸?shù)乃?00總噸及以上的船舶和經(jīng)核定可載運(yùn)15人或以上的船舶以及用于

23、 fixed and floating platform engaged in exploration and exploitation of the sea-bed, shall be provided with a garbage record book. The garbage record book, whether as a part of the ships official logbook or otherwise, shall be in the form specified in the Appendix to this Annex.(a) 每次排放入海或至接收設(shè)備或完成的焚

The entries in the Garbage Record Book shall be at least in English, French or Spanish.Where the entries are also made in an official language of the S

26、tate whose flag the ship is entitled to fly, the entries in that language shall prevail in case of a dispute or discrepancy.(b)每次排放或焚燒的記錄都應(yīng)寫明日期與時間、船舶位置、垃圾種類和焚燒或排放垃圾的估計(jì)數(shù)量；The entry for each incineration or discharge shall include date and time, position of the ship, category of the garbage and the es

27、timated amount incinerated or discharged;(c)垃圾記錄簿應(yīng)保存在船上或固定或浮動平臺上的合適的位置以使在合理的時間內(nèi)可隨時取來接受檢查。垃圾記錄簿應(yīng)自最后一次記錄日期起保存2年；The garbage record book shall be kept on board the ship or the fixed or floating platform, and in such a place as to be available for inspection in a reasonable time. This document shall be

28、preserved for a period of two years from the date of the last entry is made on the record;(d) 如發(fā)生本附則第7條所指的任何排放或意外落失，垃圾記錄簿上應(yīng)予以記錄，或?qū)θ魏涡∮?00總噸的船舶，應(yīng)在該船的正式航海日志中記錄該排放或落失的地點(diǎn)、情況和原因、排放或落失的物品細(xì)目、以及為防止或盡量減少這種排放或意外落失業(yè)已采取的合理預(yù)防措施。In the event of any discharge or accidental loss referred to in regulation 7 of this

29、Annex an entry shall be made in the Garbage Record Book, or in the case of any ship of less than 400 gross tonnage, an entry shall be made in the ship's official log-book, of the location, circumstances of, and the reasons for the discharge or loss, details of the items discharged or lost, and t

30、he reasonable precautions taken to prevent or minimize such discharge or accidental loss.(4) 主管機(jī)關(guān)可以對下述船舶免除垃圾記錄簿要求The Administration may waive the requirements for garbage record books for:(i) 核準(zhǔn)載運(yùn)15名或以上人員，航行持續(xù)時間為1h或以下的船舶；或Any ship engaged on voyages of one (1) hour or less in duration which is certi

31、fied to carry 15 persons or more; or(ii) 從事海床勘探與開發(fā)的固定或浮動的平臺。fixed or floating platforms while engaged in exploration and exploitation of the sea-bed.(5) 本公約締約國政府的主管機(jī)關(guān)，可檢查停靠其港口或近海裝卸站的適用本規(guī)定的任何船舶的垃圾記錄簿或船舶的正式航海日志，并可將記錄簿或日志中的任何記錄制成副本并要求船長證明該副本是該項(xiàng)記錄的真實(shí)副本。這種經(jīng)船長證明為船上垃圾記錄簿 或船舶的正式航海日志中某項(xiàng)記錄的真實(shí)的副本在任何法律訴訟中應(yīng)作為該項(xiàng)記

33、 terminals and may make a copy of any entry in those books, and may require the master of the ship to certify that the copy is a true copy of such an entry. Any copy so made , which has been certified by the master of the ship as a true copy of an entry in the ships garbage record book or ship's

34、 official log-book, shall be admissible in any judicial proceedings as evidence of the facts stated in the entry. The inspection of a garbage record book or ship's official log-book and the taking of a certified copy by the competent authority under this paragraph shall be performed as expeditio

36、ne environment or navigation shall be reported to the State whose flag the ship is entitled to fly, and, where the loss or discharge occurs within waters subject to the jurisdiction of a coastal State, also to that coastal State.第三章 船舶垃圾及防污染Chapter III PREVENTION OF POLLUTION FROM GARBAGE1. 為了確保經(jīng)濟(jì)效益

37、和環(huán)境保護(hù)，船舶垃圾管理人員應(yīng)合理調(diào)節(jié)以下工作：To achieve cost-effective and environmentally sound results, many garbage management planners use a combination of three complementary techniques to manage garbage:1.1 減少垃圾產(chǎn)生的來源reduction at source 1.2 垃圾再利用或再循環(huán)reusing or recycling 1.3 船上垃圾加工（處理）onboard processing (treatment)1

38、.4允許排放時按限制條件排放入海；和discharge into the sea in those limited situations where it is permitted; and1.5排入港口接收設(shè)施discharge to a port reception facility.2. 當(dāng)船舶提出供應(yīng)備件/伙食時，航運(yùn)公司應(yīng)在早期階段鼓勵供應(yīng)商去除、減少包裝，限制產(chǎn)生船舶垃圾。When requisitioning stores and provisions, shipping companies should encourage their suppliers to remove,

39、reduce, all packaging, at an early stage, to limit the generation of garbage on board ships.3. 應(yīng)制定程序使船員在船上產(chǎn)生垃圾時對垃圾進(jìn)行分類，哪些船上可重復(fù)使用，哪些可由合適的港口接收設(shè)施回收再循環(huán)利用。When garbage is generated aboard a ship, procedures should be defined to enable the crew to sort the material that can be reused onboard the ship or r

40、ecycled at an appropriate port reception facility.4. 船上的垃圾種類，部分根據(jù)MARPOL73/78附則V規(guī)定進(jìn)行分類。但有些可根據(jù)地區(qū)、國家或地方，另分類，如：生活、航行、貨物、食品、檢修方面所產(chǎn)生的垃圾。船舶的垃圾按MARPOL73/78附則V第10條的規(guī)定，下方第5.1段將垃圾分成9大類。The ships garbage is made up of distinct components, some of which are regulated in MARPOL73/78, whilst others may be regulate

54、garbage on board should be estimated in cubic metres, if possible separately according to category. The Garbage Record Book contains many references to estimated amount of garbage. It is recognized that the accuracy of estimating amounts of garbage is left to interpretation. Volume estimates will di

55、ffer before and after processing. Some processing procedures may not allow for a usable estimate of volume, e.g., the continuous processing of food waste. Such factors should be taken into consideration when making and interpreting entries made in a record. 5.4 收據(jù)Receipts 船長必須從港口垃圾接收設(shè)施操作人員或從接收船舶的船長處
