1、房屋租賃合同tenancy agreement一、出租人(以下簡稱甲方)landlord (hereinafter referred to as party a)二、承租人(以下簡稱乙方)tenant(hereinafter referred to as party b)三、租賃范圍和用途tenancy:甲方同意將其所有的位于 北京市朝陽區(qū)光華路 2 號陽光 100 座 2001 室的房 屋和其設(shè)施(包括家具和電器)在良好和可租賃的狀態(tài)下租給乙方為 居住 使用, 出租房的面積總計約 110 平方米。party a hereby agrees to lease its property loca
2、ted at and the related facilities(including furniture and appliances) in good tenantable condition to party b for size of the leased property is approximately spm.四、租賃期:term of tenancy:4.1 租賃期為年,自年月日起至 月 14 日止。 續(xù)租或退租,應(yīng)提前壹個月通知甲方。upon expiration of the tenancy, party a has the right to take back the e
3、ntireleased property, and party b shall deliver the leased property to party a on time. alternatively, party b have the opton to renew this agreement or quit this agreement upon giving one month prior notice to party a before the expiration of this agreement.五、租金和付款方式rent and the way of payment5.1 雙
4、方談定的租金為每月元。the rent, agreed by both parties, is per month.5.2 應(yīng) 在每月日之前。party b shall pay month' s rent in advance, on or before thofeachcalendar month.a : 匯至甲方指定的銀行賬號,支付租金日期以乙方匯出日期為準。by transferring the amount or such rent to a bank account designated by partya and the date of transfer shall be
5、the date of payment.b : 以現(xiàn)金方式支付 payment in cash c: 以支票方式支付 payment in check5.3 由于乙方原因未能按期支付租金,乙方須按日加付其月租金0.5 %的滯納金。if the rent remain being unpaid on time, party b shall be liable to pay a latepenalty fee equal to 0.5% of the month rent per day.六、保證金(押金):security desposit:6.1 為確保出租房屋和其設(shè)施之安全并完好和租賃期內(nèi)相
6、關(guān)費用之如期結(jié)算,乙方同意于簽訂合同當日支付給甲方的租賃押金5300 元作為乙方確保合同履行之保證XtZ oto ensure the welfare and good condition of the leased property and the relatedfacilities as well as the prompt payment and settlement of all related charges durning the term of tenancy, party b agrees to pay to party a within one day after the a
7、greement signed a security desposit in the amount of as security for party b ' s obligations hereunder.6.2 除合同另有約定外,乙方應(yīng)于租賃期滿之日與甲方點清室內(nèi)設(shè)施,并付清 所有應(yīng)付費用后,甲方當天將保證金全額無息退還乙方。unless other provided in agreement, party a shall return to party b the entiresecurity desposit without interest thereon upon expir
8、ation of the tenancy or sooner determination of this agreement after party b settled all charges of leased property with party a.七、費用擔保:payment:7.1 租賃期間物業(yè)費和取暖費由甲方承擔。 durning the term of the tenancy, the property management fees and theheat-preservation fees shall be paid by party a.7.2 房屋的冷、熱水、電、天然氣
9、消耗按每月查表實數(shù)由乙方支付。the cold, hot water, electricity, and gas payment(for water and tear) of theproperty shall be paid by party b according to its actual payment per month.7.3 電話費、有線收視費按實際費用由乙方交付。party b according to its zctual payment shall pay the payment for telephoneand international channel.八、出租人的責任
10、landlord ' s obligations:8.1 甲方須按時將出租房屋和其設(shè)施以良好的狀態(tài)交付乙方使用。 party a shall deliver the leased property and the related facilities in good condition to party b on schedule.8.2 租賃期內(nèi)甲方不得收回出出租房屋(除非本合同另有規(guī)定) party a shall not take back the leased property durning the term of the tenancy.(unless otherwise
11、stipulated in this agreement)8.3 在乙方遵守本合同的條款和交付租金的前提下,乙方有權(quán)于租賃期內(nèi)拒絕 甲方或其他人騷擾而安靜享用出租房屋。provided that party b abides and performs the appendixes of the agreement andthe payment for the tenancy, party b has the right to refuse the interruption from party a to enjoy the life satisfaction and peace.8.4 房屋基
12、本設(shè)施和結(jié)構(gòu),甲方有修繕的責任并承擔有關(guān)的費用,并對其做定 期修繕。 party a is responsible for repairing and maintaining the basic facilities of theleased property and for bearing all costs thereto.8.5 甲方謹在此聲明和保證甲方為出租房屋的合法擁有人并由合法地位出租此 房屋與乙方。party a hereby represents and warrants that party a is the legal owner of theleased property
13、 and has the necessary legal capacity to lease the property to party b.8.6 如在租賃期內(nèi),租賃房屋發(fā)生所有權(quán)全部或部分轉(zhuǎn)移、或其他影響乙方權(quán) 益的事情時,甲方應(yīng)保證所有權(quán)人或者其他影響乙方權(quán)益的第三者,能繼續(xù)遵守本合同所 有條款,如乙方與本合同的權(quán)益人首次等所有權(quán)人或第三者所影響或損害,甲方須負責任補償 乙方的所有損失、損害、支出和費用。if durning the term of the tenancy, allor part of the leased property istransferred or party
14、b' s right to use the leased property isattested, party a shall ensure that such transferee or third party h aving an effect on party b' s right to use the leased property willcontinue to abide by the terms of this agreement.party a shall also be liable to keep party b be fully indemnified a
15、gainst any costs,expenses,losses, and damages suffered by party b if any of party b ' s interests herein are affected or prejudiced by a third party.九、承租人的責任: tenant ' s obligatons:9.1 乙方應(yīng)按合同的規(guī)定,按時支付租金,保證金和其他各項應(yīng)付費用。party b shall be responsible to pay all rents and fees in at timely manneracc
16、ording to the terms of the contract.9.2乙方經(jīng)甲方事先同意,可在承擔租用房內(nèi)進行裝修和添置設(shè)備,租賃期滿必須恢復(fù)原狀(正常損耗除外),并承擔其費用,經(jīng)甲方驗收認可后歸還甲方。party b with the prior consent of party a, can renovate and install additionalfacilities in the leased property.upon expiration if the tenancy the leased property shall be resumed to party a in
17、its original conditions (fair wear and tear exempted)and all expenses arising there from shall be borne by party b.9.3 乙方應(yīng)愛護使用租賃的房屋,如因乙方的過失或過錯致使房屋和設(shè)施受到 損失(正常損耗除外)乙方應(yīng)負賠償責任。party b shall treat the leased property with care. because of party b's9.4 乙方應(yīng)按本合同的規(guī)定合法使用租賃房屋,不得擅自改變其性質(zhì),不應(yīng)存 放中華人民共和國法律下所禁止的危險
18、物品,如因此發(fā)生損害,乙方應(yīng)承擔全部責任。 party b shall use the leased property legally as agreed in this agreement andmay not change such use on its own.party b shall not store any dangerous items, which are prohibited by the laws in the people' srepublic of china in the leased property and shall be fully responsi
19、ble for any damages or a result thereof.9.5 租賃期即將結(jié)束之日,經(jīng)乙方同意,甲方可以帶其他客戶看房。upon expiration of the tenancy or sooner determination of this agreement,party a could take others to check the apartment with the party b agreement.9.6 中英文條款和意思如有不一致之處,雙方協(xié)調(diào)解決。in the event that there is the conflict between the
20、chinese version and englishversion, in such case party a and party b shall go together and resolve the problem.十、 違約處理: breach of agreement10.1 乙方如有下列行為之一的,甲方有權(quán)終止本合同,收回出租房屋,并且扣 除房屋保證金。party a shall have the right to terminate this agreement repossess the leaseda 、 未得甲方同意將承租房屋擅自拆改結(jié)構(gòu)改變用途alters the structure of the leased property without authorization or uses the leased property other than
