2、he following Employer and Employee in accordance with the Labour Law of People's Republic of China.一、勞動合同期限 Term of the Contract:第一條本合同期限類型為固定期限勞動合同雙方合同期為年,即從年月日起至年月日止,其中,從年月日起至年月日為試用期,試用期為 個月。在試用期內(nèi),乙方被證明不符合錄用條件的,甲方有權隨時解除勞動合同。The term of this con tract shall comme nee on, and shall con ti nue un

The Employee shall un dergo a probati onary period ofmon ths.所謂試用期不符合錄用條件包括:(一)乙方體檢或身體健康未能通過甲方入職前所要求的;(二)乙方不能達到所擔任崗位的績效指標或者相應的要求的;(三)乙方在試用期內(nèi)請假次數(shù)超過5天或者遲到早退超過6次的;(四)乙方的背景調查或者在履歷中發(fā)現(xiàn)有弄虛作假行為的;(五)乙方頂撞上司或在工作期間發(fā)生毆斗行為的;或者其他任何主管認為乙方不能符合該職位的要求的;(六)

4、An Employer may terminate an employment contract during the probation period if(1) Is proved not to satisfy the conditions for employment during the probation period;(2) Materially breaches the Employer' s rules and regulations;(3) Commits serious dereliction of duty or practices graft, causing

5、substantial damage to the Employer;(4) has additionally established an employment relationship with another Employer which materially affects thecompletion of his tasks with the first-mentioned Employer, or he refuses to rectify the matter after the same isbrought to his attention by the Employer;(5

6、) causes the employment contract to be invalid due to the circumstance specified in item(6)二、 工作內(nèi)容Job Description:第二條乙方同意根據(jù)甲方工作需要,承擔以下職責 The Employer agrees to employ Mr./Ms.(name) as(job title) inDepartment第三條甲方有權依據(jù)公司發(fā)展的需要對乙方的工作內(nèi)容進行變更Part A may change Part B s position according to the development

7、of the company.三、 勞動報酬Remuneration of Labour第四條乙方基本工資依據(jù)職位和崗位等級標準支付,正式錄用后每月基本工資為人民幣元,試用期工資為正式錄用后工資的 80%每年依據(jù)工作表現(xiàn)調整,但不低于國家所規(guī)定的最低工資標準。The salary of the Employee is ,and shall be monthly paid by the Employer in accordanee with regulationof the company.It shall be paid by legal tender and not less than th

9、th。 Part B should to raise an objection in three daysafter receiving the salary, or it means that Part B agrees with that.第六條甲方根據(jù)公司的經(jīng)營效益和乙方的個人表現(xiàn)和業(yè)績發(fā)放獎金,獎金的數(shù)額沒有明確的規(guī)定,完全根據(jù)甲方效益和乙方績效來確定。Part A may pay bonus accord ing to the performa nee of Part B四、勞動合同的變更、解除、終止、續(xù)訂Termination, Modification, Renew and Di

10、scharge of the Contract第八條 訂立本合同所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行的,經(jīng)甲乙雙方協(xié)商同意,可以變更本合同的相關內(nèi)容。Due to the force majeure, The relevant clauses of the Contract may be modified by the parties.第十條 經(jīng)甲乙雙方協(xié)商一致,本合同可以解除。The contract can be modified or terminated by the parties throughconsultation;第十一條 乙方有以下情形之一的,甲方有權解除勞動合

11、同并無須給乙方任何經(jīng)濟補償金:(一)嚴重違反公司員工手冊、人力資源管理制度、行政管理制度、崗位職責規(guī)定、上司任務安排等一系列公司規(guī)章制度的;(二)嚴重失職,營私舞弊,給甲方利益造成重大損害的;(三)被依法追究弄事責任的;(四)乙方同時在其他地方兼職或以任何形式,對甲方的工作任務造成嚴重影響,或者經(jīng)過甲方提出后仍不改正。(五) 在試用期被證明不錄用條件的;(六) 乙方被發(fā)現(xiàn)其存在虛假欺騙行為(包括但不限于其假工作經(jīng)歷、假學歷證、假身份證明等),使甲方違背真實意思的情況下與乙方訂立合同的;The Contract may be discharged by the Employer with imm

12、ediate effect and the Employee will not be compensated if the employee :(1 Materially breaches the Employer ' s rules and regulations ;(2) Commits serious dereliction of duty or practices graft, causing substantial damage to the Employer;(3) has additionally established an employment relationshi

13、p with another Employer which materially affects the completion of his tasks with the first-mentioned Employer, or he refuses to rectify the matter after the same is brought to his attention by the Employer(4) The Employee is being charged with criminal offences:第十二條 有下列情況之一的,甲方提前三十天以書面形式通知乙方本人或者額外支

14、付乙方一個月工資后,可以解除勞動合同:(一)乙方患病或者非因工負傷,在規(guī)定的醫(yī)療期滿后不能從事原工作,也不能從事單位另行安排的工作的;(二)乙方不能達到所擔任崗位的績效指標或者相應的要求的,經(jīng)過培訓或者調整工作崗位,仍不能達到的;(三)勞動合同訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使勞動合同無法履行,經(jīng)甲乙雙方協(xié)商,未能就變更勞動合同內(nèi)容達成協(xié)議的。An Employer may terminate an employment contract by giving the Employee himself 30 days ' prior written notice, or one m

15、onth ' s wage in lieu of notice, if:(1)after the set period of medical care for an illness or non-work-related injury, the Employee canengage neitherin his original work nor in other work arranged for him by his Employer;(2)The Employee is incompetent and remains incompetent after training or ad

16、justment of his position; or(3) A major change in the objective circumstances relied upon at the time of conclusion of the employment contractrenders it unperformable and, after consultations, the Employer and Employee are unable to reach agreement on amending the employment contract.第十三條 乙方提前三十日以書面

17、形式通知甲方,可以解除勞動合同,但雙方有服務期約定的除外。A Employee may terminate his employment contract upon 30 days' prior written notice to his Employer. Duringhis probation period, a Employee may terminate his employment contract by giving his Employer three days' priornotice.第十四條 本合同期限屆滿,勞動合同即終止。甲乙雙方經(jīng)協(xié)商同意,可以續(xù)訂勞動合

18、同;若甲方維持或者提高勞動合同約 定條件續(xù)訂勞動合同,乙方不同意續(xù)訂的,甲方將根據(jù)勞動合同法第四十六條第 5 點的規(guī)定不向乙方支付經(jīng)濟補償金。The Contract may be renewed at the expiration through consultation by the parties with the fulfillment of theprocedure within 15 days to the expiration;第十五條 有下列情形之一的,勞動合同終止:(一)勞動合同期滿;(二)勞動者已開始依法享受基本養(yǎng)老保險待遇的;(三)勞動者死亡,或者被人民法院宣告死亡或者失

19、蹤的;(四)用人單位被依法宣告破產(chǎn)的;(五)用人單位解散、被吊銷營業(yè)執(zhí)照或者責令關閉的;(六)有法律、行政法規(guī)規(guī)定的其他情形的。An employment contract shall end if:(1) Its term expires;(2) The Employee has commenced drawing his basic old age insurance pension in accordance with the law;(3) The Employee dies, or is declared dead or missing by a People' s Cour

20、t;(4) The Employer is declared bankrupt;(5) The Employer has its business license revoked, is ordered to close or is closed down, or the Employer decideson early liquidation; or(6) Another circumstance specified in laws or administrative statutes arises.五、勞動爭議處理 setllment of disputes第十六條 因履行本合同發(fā)生的勞動爭議,雙方應積極協(xié)商解決;解決不成,當事人一方要求仲裁的,應當自勞動爭議發(fā) 生之日起六十日內(nèi)向 佛山市禪城區(qū) 勞動爭議仲裁委員會申請仲裁。當事人一方也可以直
