16、一切相關法律要求,并全面符合中國安康平安環(huán)境規(guī)范。This Employee Manual (Manual for short) is based on the Chinese Law and its relevant regulations. Gestamp Metal Forming (Wuhan) Ltd. is fully committed to follow all legal labor requirements, and fully comply with Chinese health.適用范圍 Application Scope本手冊就海斯坦普金屬成型(武漢)以下簡稱“海斯坦

17、普武漢公司或公司的勞動條件及公司員工以下簡稱“員工的任務職責做出規(guī)定。其他未在本手冊里規(guī)定的事宜應按照海斯坦普武漢公司和員工簽署的書面勞動合同的條款執(zhí)行。海斯坦普武漢公司的員工應遵守本手冊。This Employee Manual regulates the employment conditions and job responsibilities of employees of Gestamp Metal FormingWuhanLtd. (GMF WUHAN or Company for short). The Employee Manual is the basis of employ

18、ment at GMF WUHAN. Additional and individual conditions are agreed upon in he written labor contract signed between the Company and every employee. All employees of GMF WUHAN must obey these rules.雇傭程序 Employment根據(jù)中國法律規(guī)定,海斯坦普武漢公司作為一家外商獨資企業(yè)擁有其相關的管理權限。公司有權按中國勞動法自行聘用和解雇員工或終止勞動合同。According to relevant C

19、hinese Legislation, as a wholly-foreign owned enterprise, GMF WUHAN enjoys certain management rights. The Company has the right to employ and dismiss employees or terminate their labor contracts, restricted only by the Chinese labor law. 公司員工數(shù)及其任職要求由公司根據(jù)公司業(yè)務開展需求決議。According to the companys business

20、and development, the management determines the number of employees and their required qualifications.試用期 Probation period試用期根據(jù)詳細情況為1-6個月根據(jù)勞動合同商定。試用期屆滿,由員工上級完成試用期回想并給予反響。The probation period is 1 to 6 months, according to the individual situation (Based on labor contract). At the end of the probation

21、 period, the superior of this employee will review the probation development and provide feedback.公司應與每位員工簽署個人勞動合同。The Company signs an individual labor contract with every employee.公司每年將免費給員工提供一次安康體檢效力。The Company will provide the employee a free medical check every year.員工需在上崗第一天提交以下文件的復印件一份;同時需查驗

22、原件。假設沒有原件,需求提交經證明核準的復印件。Employees must submit the following items to GMF WUHAN at the 1st day of work. Documents must be presented in original and 1 copy. In cases where original documents are not on hand, certified copies must be presented.a) 與先前公司解除勞動合同的文件;A document confirming the termination of

23、the labor contract with the previous company;b) 以下證書原件及復印件:學位證書、畢業(yè)證書、職業(yè)資歷證書、特殊工種的操作證書、技術等級證書、外語等級證書、前公司公積金證明等;公司有權對證書進展核實;Certificates and its certified copies of the following documents: education or graduation certificates, employment certificates , specific machine operating certificates and tech

24、nical skills certificates,foreign language certificates, housing fund information; The Company has right to check the authenticity of these certificates.c) 一份身份證或護照復印件;A passport or ID card photocopy;d) 體檢報告Health report;e) 在海斯坦普武漢公司任職時或在海斯坦普武漢公司任職前,海斯坦普武漢公司能夠要求的其他信息或文件。GMF WUHAN may request any oth

25、er messages and documents before or during the employment of the employee.f) 根據(jù)需求將人事檔案轉到“武漢光谷人才效力中心的公司人事代理專戶下。Transfer the official personnel registration record to Wuhan East Lake HR Service Centre with the support of the Companys HR Dept if necessary.海斯坦普武漢公司會根據(jù)個人數(shù)據(jù)維護規(guī)定及公司員工個人檔案管理的有關規(guī)定來擔任搜集、堅持、處置和

26、運用員工的個人資料。個人數(shù)據(jù)的搜集權限于合法的以及與員工的聘用相關的目的,直接主管、部門經理、總經理有權了解這些資料。海斯坦普武漢公司將采取一真實踐可行的措施以保證員工個人資料的平安性,并防止未經授權的人員接觸,銷毀或運用這些資料。GMF WUHAN will file, keep, handle and use the employees personal information according to the document management rules and privacy protection regulation. The right to compile individu

27、al statistics is restricted by the law and can only be for purposes related to employment. Direct Supervisors, Department Managers and the General Manager have the right to see some of those documents. GMF WUHAN takes all the necessary measures to protect individual information and prevents unauthor

28、ized persons from accessing, removing or using this information.本手冊將提供應員工每人一份。A copy of this manual is handed to every employee.每位員工應將以下任何事項的變動, 提交書面證明文件給人力資源部以更新員工信息:In case any of the following conditions change, the employee should inform HR department of the change by submitting relevant documen

29、ts:a) 合法送達地址;Legal contact address;b) 教育程度、資歷證明;Level of education and qualification;c) 姓名;Surname and given name;d) 婚姻情況;Marriage status;e) 其它重要個人資料或事宜。Other important personal issues.員工辭職退程序 Procedure of leaving the Company3.1 員工提出離任,須提早三十日以 HYPERLINK baike.baidu/view/1015221.htm t _blank 書面方式通知公司

30、。試用期內的員工提出離任,須提早三日以書面方式通知公司。 An employee may terminate his employment contract upon 30 days prior written notice to the company. During his probation period, an Employee may terminate his employment contract by giving the company three days prior notice.3.2 假設員工離任,無論任何緣由勞動合同到期、員工提出或公司提出解除勞動合同都必需履行正常

31、的離任手續(xù),包括把與任務相關的文件含電子文件上交給他/她的上司,歸還公司的物品手機、電腦、文具、洗凈的任務服、勞保用品、工具等,并向他/她的上司或被上司指定的同事闡明任務的進展情況。離任前確保一切交接任務完成,在完成程序的同時,填寫,獲得相關人員及經理的簽字贊同,公司才為其辦理其他離任手續(xù)。If an employee leaves the Company, no matter for what reason (e.g. expiration of labor contract, notice by the employee or by the Company to terminate the

32、 contract), he or she has to complete the proper leaving procedures. These include handing over all work-related documents (including electronic documents) to his or her superior, returning all Company objects that he or she may have used during work (e.g. mobile phone, computer, stationary, the was

33、hed work uniform, safety items, tools etc.), and explaining the status of his or her work to his or her superior or a colleague designated by the superior. A proper and complete handover to a colleague or superior is an important matter when terminating the employment. After completing all these pro

34、cedures, the employee should fill in and sign the Leaving Employee Checklist and submit it for approval by signature to his superior and relevant manager. Then Company can deal with the leaving procedures.勞動合同 Labor Contract本手冊任何一條規(guī)定,假設與員工和海斯坦普武漢公司之間勞動合同不一致或有沖突,所涉及的員工的事宜應該遵照或服從勞動合同的條款執(zhí)行。If there is

35、a conflict between any of these rules in this manual and the labor contract signed between GMF WUHAN and the employee, the issue shall be handled according to the individual labor contract.公司規(guī)定 Company Regulations員工必需遵守海斯坦普武漢公司的規(guī)定,聽從上級管理人員的任務要求,盡職盡責。The employees must obey the company regulations, f

36、ollow the instructions and orders of their superiors, and fulfill their duties and responsibilities as best they can.上級管理人員必需耿直地履行他們的職責,以寬厚和指點的方式指點其下屬。Superiors must fulfill their responsibilities in a fair manner, manage their subordinates in an honest and kind way and provide guidance to them.遵守職責

37、 Responsibilities of employees一切員工有同樣的義務遵守本手冊規(guī)定。All employees have the same duty to obey the rules in this manual.員工必需遵守以下事宜并且盡職盡責:The employees must fulfill their duties and responsibilities and act according to the following arrangements:儀表端莊,留意個人衛(wèi)生,留意平安,堅持任務服的整潔,并按規(guī)定穿戴勞保用品。Be orderly and correct

42、 sharp work piece from be hut沖壓車間、焊接車間手工焊崗位Press and manual welding position任務服Uniform車間任何區(qū)域 Any place in the workshop 正確有效地履行職責,并且不斷盡力提高其任務效率,堅持積極的任務態(tài)度。在履行職責時,員工必需努力為公司的開展做出奉獻,個人利益服從公司利益。Carry out their duties in a proper and efficient way and constantly aim to increase work efficiency, have an act

43、ive work attitude. When fulfilling their duties, the employees must work diligently in order to make contributions to the development of the Company. Personal benefit comes after the Companys benefit.在履行職責時,員工應尊重海斯坦普武漢公司的政策,相互協(xié)作,積極努力推進業(yè)務順利進展。When carrying out their duties, employees should respect G

44、MF WUHANs policy, support each other, and do their best to facilitate the successful development of the business.不要做有損海斯坦普武漢公司的榮譽和信譽的事情。Not do anything that might damage the reputation and credit of GMF WUHAN.不要在授權之外武斷專行。每位員工的授權范圍在其任務范圍及核準的技藝中做了界定。Not do anything they are not authorized to do. The a

45、uthorization scope of every employee is described in his job scope and approved skill level. 每位員工應遵守商業(yè)事務絕對嚴密的規(guī)定。合同、圖紙等只可以在相關上級管理人員允許的情況下復印。不要泄漏公司商業(yè)或任何能夠損害海斯坦普武漢公司的其他事情。Every employee shall respect the rule that business issues are strictly confidential. Documents such as contracts and drawings may o

46、nly be copied with the relevant superiors permission. Do not disclose any confidential information on the Company or anything that might harmGMF WUHAN.除非與海斯坦普武漢公司的任務有關,否那么在私人買賣中不許運用海斯坦普武漢公司的名字。Apart from carrying out official GMF WUHAN work, the employee is not allowed to use GMF WUHANs name for per

47、sonal financial transactions.未經海斯坦普武漢公司允許,不得從海斯坦普武漢公司的商業(yè)聯(lián)絡人處接受金錢或向他們借錢;對于禮物,必需回絕或退回,除非價值很小,不影響員工服從海斯坦普的運營目的及品德規(guī)范Without the permission of GMF WUHAN, the employee is not allowed to accept monetary gifts or borrow money from business contact people of GMF WUHAN. The employee has to reject or return pr

48、esents, except when they are of small value and do not harm the employees loyalty to Gestamps business goals and ethical standard.未經上級管理人員同意,不許在任務時間分開任務場所。Except with the permission of the superior, the employee is not allowed to leave the work place during working hours.未經海斯坦普武漢公司的允許不得以雇員、承包商、管理人員或

49、董事的名義為其它公司任務,也不允許從事能夠影響海斯坦普武漢公司利益的私人業(yè)務。只需在公司事先允許的情況下,員工才干從事私人業(yè)務,第二份職業(yè),或任何方式的其他業(yè)務。Without the permission of GMF WUHAN, the employee must not work for other companies pretending to act on behalf of business partners, contractors, the management or directors of GMF WUHAN. The employee must not engage i

50、n personal business that might have an impact on GMF WUHANs benefits. An employee is only allowed to have a private business, secondary employment or ownership of any kind in another business if it has been permitted by the company. 堅持任務場所整潔有序,盡力防止盜竊、火災或其它損失,遵守有關衛(wèi)生平安規(guī)定。The work place has to be kept

51、clean and tidy. The utmost has to be done to prevent theft, fire, or other damages. The hygiene and safety regulations have to be respected.維護好設備和配備以及其它海斯坦普武漢公司的財富、節(jié)約用水、電和文具用品等。Protect the facilities, equipment and other possessions of GMF WUHAN. Do not waste water, power or stationary etc.雇員不得在任務場所

52、飲酒或濫用其他藥物;并不得在醉酒或處于任何其它藥物控制情況下開展任務。操作員工不允許在工位因個人目的運用手機。Employees are not permitted to consume alcohol or abuse other substances at the work place, and must not carry out their tasks when they are drunk or under the influence of any other drug / substance. The personal use of mobile phone is forbidde

53、n in shopfloor workstation.員工有什么埋怨,可以向上級管理人員或海斯坦普武漢公司總經理申訴。If employees have any complaints, they can appeal to their superior or the General Manager of GMF WUHAN.任何盜竊,損害公司財富,任務場所運用暴力,參與暴動的行為都需求承當相應的損失賠償,嚴禁未經允許進展大規(guī)模集會,違反將能夠導致其雇傭關系的終止。Theft, damage of company property, engaging in physical violence,

54、participating in riots, organizing large meeting in the company without permit, will trigger compensation claims and possible dismissal.出勤 Attendance任務時間 Working Hours公司應該根據(jù)中國政府有關任務時間的規(guī)定,設立根本任務周的任務時間以到達充分的消費才干。The Company determines the working hours of the regular working week so that optimum produ

55、ction capacity is achieved. The working hours must be in line with the relevant regulations of the Chinese Government.如無特殊緣由,正常任務時間為每周40 小時,消費部員工的正常班次任務時間根據(jù)消費部的詳細安排。任務時間始于員工開場正式任務勞保用品,任務服穿戴終了,任務時間終了于員工分開任務崗位。改換衣服,個人衛(wèi)生,休憩時間不視作任務時間。The normal working hours of staff and workers related to production ar

56、e 40 hours a week. For the actual shift schedule refers to the plan of the production department. The work time starts when the employee is ready to carry out his/her task, i.e. fully dressed in work uniform including necessary PPE. The work time ends when the employee leaves his/her job position an

57、d intends to terminate work for the day. Time spent in the company for changing clothes, personal hygiene or rest are not work time.如遇特殊情況,如電力供應缺乏,公司將暫時調整一切員工的任務時間,包括周末任務。In the event of exceptional circumstances, such as power shortage, the working hours of all employees can be temporarily adjusted

58、 accordingly, including work at the weekend.根據(jù)消費運營的需求或由于不可控情況,在遵守勞動法的前提下,公司可以改動部分或全部員工的任務時間表,包括周末任務。變動之后的任務時間表應成為員工正常的任務時間。If required by production needs or when uncontrollable circumstances occur, the company can change the time schedule of part of or all of the employees at any time, including wo

59、rk at the weekend, in line with the Labour Law. In this case, the changed working time schedule becomes the regular working schedule of the employees.加班程序 Overtime procedures公司可以按勞動法的相關規(guī)定與員工協(xié)商之后延伸任務時間或加班。 除非雙方另行書面贊同,海斯坦普武漢公司應根據(jù)中國相關法律補休或支付加班工資,補償方式由海斯坦普武漢公司決議。According to the relevant regulations of

60、the Labour Law, the Company can extend the working hours or arrange overtime after consulting with the employees. Except when a written agreement exists between the Company and the employee, GMF WUHAN compensates overtime by time off on another day, or by paying overtime compensation. GMF WUHAN deci
