10、6 XXag化妝品標識管理規(guī)定（國家質量監(jiān)督檢驗檢疫總局令第 100號）化妝品標識管理規(guī)定已經 2007年7月24日國家質量監(jiān)督檢驗檢疫總 局局務會議審議通過，現(xiàn)予公布，自 2008年9月1日起施行。二。七年八月二十七日 第一章總則第一條 為了加強對化妝品標識的監(jiān)督管理， 規(guī)范化妝品標識的標注，防止 質量欺詐，保護消費者的人身健康和安全，根據(jù)中華人民共和國產品質量法、 中華人民共和國標準化法、中華人民共和國工業(yè)產品生產許可證管理條例、 國務院關于加強食品等產品安全監(jiān)督管理的特別規(guī)定 等法律法規(guī)，制定本規(guī) 定。第二條 在中華人民共和國境內生產（含分裝）、銷售的化妝品的標識標注 和管理，適用本規(guī)定

11、。第三條 本規(guī)定所稱化妝品是指以涂抹、噴、灑或者其他類似方法，施于人 體（皮膚、毛發(fā)、指趾甲、口唇齒等），以達到清潔、保養(yǎng)、美化、修飾和改變 外觀，或者修正人體氣味，保持良好狀態(tài)為目的的產品。本規(guī)定所稱化妝品標識是指用以表示化妝品名稱、品質、功效、使用方法、 生產和銷售者信息等有關文字、符號、數(shù)字、圖案以及其他說明的總稱。第四條國家質量監(jiān)督檢驗檢疫總局（以下簡稱國家質檢總局）在其職權范 圍內負責組織全國化妝品標識的監(jiān)督管理工作?？h級以上地方質量技術監(jiān)督部門在其職權范圍內負責本行政區(qū)域內化妝品標識的監(jiān)督管理工作。第二章化妝品標識的標注內容第五條化妝品標識應當真實、準確、科學、合法。第六條化妝品標

12、識應當標注化妝品名稱?；瘖y品名稱一般由商標名、通用名和屬性名三部分組成，并符合下列要求：（一）商標名應當符合國家有關法律、行政法規(guī)的規(guī)定；（二）通用名應當準確、科學，不得使用明示或者暗示醫(yī)療作用的文字，但可以使用表明主要原料、主要功效成分或者產品功能的文字；（三）屬性名應當表明產品的客觀形態(tài)，不得使用抽象名稱；約定俗成的產品名稱，可省略其屬性名。國家標準、行業(yè)標準對產品名稱有規(guī)定的，應當標注標準規(guī)定的名稱。第七條 化妝品標注“奇特名稱 ”的，應當在相鄰位置，以相同字號，按照本規(guī)定第六條規(guī)定標注產品名稱；并不得違反國家相關規(guī)定和社會公序良俗。同一名稱的化妝品，適用不同人群，不同色系、香型的，應當

23、產加工地?；瘖y品實際生產加工地應當按照行政區(qū)劃至少標注到省級地域。第九條化妝品標識應當標注生產者的名稱和地址。生產者名稱和地址應當是依法登記注冊、能承擔產品質量責任的生產者的名稱、地址。有下列情形之一的，生產者的名稱、地址按照下列規(guī)定予以標注：依法獨立承擔法律責任的集團公司或者其子公司，應當標注各自的名稱和地址；依法不能獨立承擔法律責任的集團公司的分公司或者集團公司的生產基地，可以標注集團公司和分公司（生產基地）的名稱、地址，也可以僅標注集團公司的名稱、地址；實施委托生產加工的化妝品，委托企業(yè)具有其委托加工的化妝品生產許可證的，應當標注委托企業(yè)的名稱、地址和被委托企業(yè)的名稱，或者僅標注委托企業(yè)

24、的名稱和地址；委托企業(yè)不具有其委托加工化妝品生產許可證的，應當標注委托企業(yè)的名稱、地址和被委托企業(yè)的名稱；分裝化妝品應當分別標注實際生產加工企業(yè)的名稱和分裝者的名稱及地址，并注明分裝字樣。第十條化妝品標識應當清晰地標注化妝品的生產日期和保質期或者生產批號和限期使用日期。第十一條化妝品標識應當標注凈含量。凈含量的標注依照定量包裝商品計量監(jiān)督管理辦法執(zhí)行。 液態(tài)化妝品以體積標明凈含量；固態(tài)化妝品以質量標明凈含量；半固態(tài)或者粘性化妝品，用質量或者體積標明凈含量。第十二條化妝品標識應當標注全成分表。標注方法及要求應當符合相應的標準規(guī)定。第十三條化妝品標識應當標注企業(yè)所執(zhí)行的國家標準、行業(yè)標準號或者經

25、備案的企業(yè)標準號?；瘖y品標識必須含有產品質量檢驗合格證明。第十四條化妝品標識應當標注生產許可證標志和編號。生產許可證標志和編號應當符合中華人民共和國工業(yè)產品生產許可證管理條例實施辦法的有關規(guī)定。第十五條化妝品根據(jù)產品使用需要或者在標識中難以反映產品全部信息時，應當增加使用說明。使用說明應通俗易懂，需要附圖時須有圖例示。凡使用或者保存不當容易造成化妝品本身損壞或者可能危及人體健康和人身安全的化妝品、適用于兒童等特殊人群的化妝品，必須標注注意事項、中文警示說明，以及滿足保質期和安全性要求的儲存條件等。第十六條化妝品標識不得標注下列內容：（一）夸大功能、虛假宣傳、貶低同類產品的內容；In order

36、；（四）其他法律、法規(guī)和國家標準禁止標注的內容。第三章 化妝品標識的標注形式第十七條化妝品標識不得與化妝品包裝物（容器）分離。第十八條化妝品標識應當直接標注在化妝品最小銷售單元（包裝） 上。 化妝品有說明書的應當隨附于產品最小銷售單元（包裝）內。第十九條透明包裝的化妝品，透過外包裝物能清晰地識別內包裝物或者容器上的所有或者部分標識內容的，可以不在外包裝物上重復標注相應的內容。第二十條化妝品標識內容應清晰、醒目、 持久， 使消費者易于辨認、識讀。第二十一條化妝品標識中除注冊商標標識之外，其內容必須使用規(guī)范中文。使用拼音、少數(shù)民族文字或者外文的，應當與漢字有對應關系，并符合本規(guī)定第六條規(guī)定的要求。

37、第二十二條化妝品包裝物（容器）最大表面面積大于20 平方厘米的，化妝品標識中強制標注內容字體高度不得小于1.8毫米。除注冊商標之外，標識所使用的拼音、外文字體不得大于相應的漢字?；瘖y品包裝物（容器）的最大表面的面積小于10 平方厘米且凈含量不大于15克或者 15毫升的，其標識可以僅標注化妝品名稱，生產者名稱和地址，凈含量， 生產日期和保質期或者生產批號和限期使用日期。產品有其他相關說明性資料的，其他應當標注的內容可以標注在說明性資料上。第二十三條化妝品標識不得采用以下標注形式：（一）利用字體大小、色差或者暗示性的語言、圖形、符號誤導消費者；（二） 擅自涂改化妝品標識中的化妝品名稱、生產日期和保
