某財產(chǎn)保險公司安裝工程一切險合同條款(中英文)ERECTIONALLRISKSCLAUSES第一部分物質(zhì)損失Ⅰ.SECTIONⅠ-MATERIALDAMAGE（一）責(zé)任范圍1.Coverage1、在本保險期限內(nèi)，若本保險單明細表中分項列明的保險財產(chǎn)在列明的工地范圍內(nèi)，因本保險單除外責(zé)任以外的任何自然災(zāi)害或意外事故造成的物質(zhì)損壞或滅失（以下簡稱“損失”），本公司按本保險單的規(guī)定負責(zé)賠償。1.1TheCompanyshallindemnifytheInsuredinrespectofthephysicallossofordamagetothepropertyinsuredduringtheperiodofinsurancewithinthespecifiedwork-sitearisingfromanyNATURALHAZARDSorACCIDENTotherthanthosespecificallyexcluded,inthemannerandtotheextenthereinafterprovided.2、對經(jīng)本保險單列明的因發(fā)生上述損失所產(chǎn)生的有關(guān)費用，本公司亦可負責(zé)賠償。1.2TheCompanyshallalsoindemnifytheInsuredforthenecessarycostspecifiedintheScheduleandincurredfollowinguponanyeventgivingrisetoaclaimunderthisPolicy.3、本公司對每一保險項目的賠償責(zé)任均不得超過本保險單明細表中對應(yīng)列明的分項保險金額以及本保險單特別條款或批單中規(guī)定的其他適用的賠償限額。但在任何情況下，本公司在本保險單項下承擔(dān)的對物質(zhì)損失的最高賠償責(zé)任不得超過本保險單明細表中列明的總保險金額。1.3TheliabilityoftheCompanyinrespectofeachiteminsuredshallnotexceedthesumsetcorrespondingtheretospecifiedintheSchedule,northelimitofindemnityspecifiedintheSpecialProvisionsorEndorsementswhereapplicable.ButinnocaseshallthemaximumliabilityoftheCompanyinrespectofmaterialdamageunderthissectionexceedthetotalsuminsuredspecifiedintheSchedule.定義DEFINITIONS自然災(zāi)害：指地震、海嘯、雷電、颶風(fēng)、臺風(fēng)、龍卷風(fēng)、風(fēng)暴、暴雨、洪水、水災(zāi)、凍災(zāi)、冰雹、地崩、山崩、雪崩、火山爆發(fā)、地面下陷下沉及其他人力不可抗拒的破壞力強大的自然現(xiàn)象。Thewords“NATURALHAZARDS”shallforthepurposeofthisPolicy,meanearthquake,tsunami,thunder-and-lightning,hurricane,typhoon,tornado,storm,tempest,flood,inundation,frost,hailstorm,landslide,rockslide,avalanche,volcanicexplosion,subsidenceofgroundandanyotherphenomenaofnaturewithstrongdestructivepowerandbeyondhumancontrol.意外事故：指不可預(yù)料的以及被保險人無法控制并造成物質(zhì)損失或人身傷亡的突發(fā)性事件，包括火災(zāi)和爆炸。TheWord：“ACCIDENT”shallforthepurposeofthisPolicy,meananyunforeseen,uncontrollableandsuddeneventwhichleadstomaterialdamageorbodilyinjury,includingfireandexplosion.（二）除外責(zé)任2.Exclusions本公司對下列各項不負責(zé)賠償：TheCompanyshallnotbeliablefor:1、因設(shè)計錯誤、鑄造或原材料缺陷或工藝不善引起的保險財產(chǎn)本身的損失以及為換置、修理或矯正這些缺點錯誤所支付的費用；2.1lossofordamagetotheinsureditemsthemselvesduetofaultydesign,defectivecastingormaterialorbadworkmanshipandexpensesincurredforreplacing,repairingorrectifyingsuchdefectsormistakes;2、由于超負荷、超電壓、碰線、電弧、漏電、短路、大氣放電及其他電氣原因造成電氣設(shè)備或電氣用具本身的損失；2.2lossofordamagetotheinsuredelectricequipmentorapparatusduetooverloading,overvoltage,electriclinecontact,arcing,leakageofelectricity,shortcircuiting,electricitydischargedfromatmosphereandotherelectricphenomena;3、施工用機具、設(shè)備、機械裝置失靈造成的本身損失；2.3lossofordamagetotheconstructionplantandequipmentnotcausedbyexteriorinfluence;4、自然磨損、內(nèi)在或潛在缺陷、物質(zhì)本身變化、自燃、自熱、氧化、銹蝕、滲漏、鼠咬、蟲蛀、大氣（氣候或氣溫）變化、正常水位變化或其他漸變原因造成的保險財產(chǎn)自身的損失和費用；2.4lossofordamagetotheinsureditemsthemselvesorexpensesarisingtherefromduetowearandtear,inherentorlatentdefect,changeinsubstance,spontaneouscombustion,naturalheating,oxidation,rustandcorrosion,leakage,mice,insectsorvermin,changeinatmosphere,（climaticortemperature）conditions,changeinnormalwaterleveloranyotherprogressivelyoperatingcause;5、維修保養(yǎng)或正常檢修的費用；2.5expensesofmaintenanceorupkeepornormaloverhaul;6、檔案、文件、帳薄、票據(jù)、現(xiàn)金、各種有價證券、圖表資料及包裝物料的損失；2.6lossofordamagetofiles,documents,accountbooks,bills,cash,securities,charts,dataandpackingmaterials;7、盤點時發(fā)現(xiàn)的短缺；2.7shortagediscoveredatthetimeoftakinganinventory;8、領(lǐng)有公共運輸行駛執(zhí)照的，或已由其他保險予以保障的車輛、船舶和飛機的損失；2.8lossofordamagetovehicles,shiporaircraftlicensedforgeneraltransportuseorhavingbeencoveredbyanyotherinsurance;9、除非另有約定，在保險工程開始以前已經(jīng)存在或形成的位于工地范圍內(nèi)或其周圍的屬于被保險人的財產(chǎn)的損失；2.9unlessotherwiseagreedbytheCompanyinwritinglossofordamagetothepropertybelongingtotheInsuredwhichisexistingorformedwithinorinthevicinityofthesitebeforethecommencementoftheerectionwork;10、除非另有約定，在本保險單保險期限終止以前，保險財產(chǎn)中已由工程所有人簽發(fā)完工驗收證書或驗收合格或?qū)嶋H占有或使用或接收的部分。2.10unlessotherwiseagreedbytheCompanyinwritinglossofordamagetoanypartorpartsofthepropertyinsuredforwhichacertificateofcompletionhasbeenissuedorwhichhavebeentestedaftercompletionoractuallyoccupiedorputintoserviceortakenoverbythePrincipalbeforetheexpirydateofthisPolicy.二、第二部分第三者責(zé)任險Ⅱ.SECTIONⅡ-THIRDPARTYLIABILITY（一）責(zé)任范圍1.Coverage1、在本保險期限內(nèi)，因發(fā)生與本保險單所承保工程直接相關(guān)的意外事故引起工地內(nèi)及鄰近區(qū)域的第三者人身傷亡、疾病或財產(chǎn)損失，依法應(yīng)由被保險人承擔(dān)的經(jīng)濟賠償責(zé)任，本公司按下列條款的規(guī)定負責(zé)賠償。1.1TheCompanyshallinthemannerhereinafterprovidedindemnifytheInsuredagainstsuchsumswhichtheInsuredshallbecomelegallyliabletopayasdamagesinrespectofdeathoforbodilyinjurytoorillnessofthirdparties,orlossofordamagetopropertybelongingtothirdpartiesinconsequenceofanaccidentoccurringindirectconnectionwiththeperformanceoftheerectionworkinsuredandhappeningonorinthevicinityofthesiteduringtheperiodofinsurance.2、對被保險人因上述原因而支付的訴訟費用以及事先經(jīng)本公司書面同意而支付的其他費用，本公司亦負責(zé)賠償。1.2InrespectofanyclaimcoveredunderthisSection,theCompanyshallinadditionindemnifytheInsuredagainsttherelevantlegalcostspayablebytheInsuredandotherexpensesincurredwiththepriorwrittenconsentoftheCompany.3、本公司對每次事故引起的賠償金額以法院或政府有關(guān)部門根據(jù)現(xiàn)行法律裁定的應(yīng)由被保險人償付的金額為準(zhǔn)。但在任何情況下，均不得超過本保險單明細表中對應(yīng)列明的每次事故賠償限額。在本保險期限內(nèi)，本公司在本保險單項下對上述經(jīng)濟賠償?shù)淖罡哔r償責(zé)任不得超過本保險單明細表中列明的累計賠償限額。1.3TheindemnificationmadebytheCompanyforanyoneaccidentshallbesubjecttotheamountstobepayablebytheInsuredwhicharedecidedinaccordancewiththelawbythecourtorthegovernmentaldepartmentconcerned.ProvidedalwaysthattheliabilityoftheCompanyunderthissectionshallinnocaseexceedthelimitsofindemnityforanyoneaccidentstatedintheSchedule,andduringthewholeperiodofinsurance,themaximumliabilityoftheCompanyunderthissectionshallinnocaseexceedthelimitofindemnityinaggregateasstatedintheSchedule.（二）除外責(zé)任2.Exclusions本公司對下列各項不負責(zé)賠償：TheCompanyshallnotbeliablefor:1、本保險單物質(zhì)損失項下或本應(yīng)在該項下予以負責(zé)的損失及各種費用；2.1lossordamageandexpensescoveredorcoverableunderSectionIofthisPolicy;1）工程所有人、承包人或其他關(guān)系方或他們所雇用的在工地現(xiàn)場從事與工程有關(guān)工作的職員、工人以及他們的家庭成員的人身傷亡或疾病；2.2.1deathoforbodilyinjurytoorillnessofthePrincipal（s）ortheContractor（s）oranyotherparty（ies）ortheiremployeesorworkmenengagedinconnectionwiththecontractworkonthesite,ormembersoftheirfamilies;2）工程所有人、承包人或其他關(guān)系方或他們所雇用的職員、工人所有的或由其照管、控制的財產(chǎn)發(fā)生的損失；2.2.2lossofordamagetopropertybelongingtoorheldincare,custodyorcontrolofthePrincipal（s）ortheContractor（s）oranyotherparty（ies）concernedortheiremployeesorworkmen;3）領(lǐng)有公共運輸行駛執(zhí)照的車輛、船舶、飛機造成的事故；2.2.3anyaccidentcausedbyvehicles,shiporaircraftlicensedforgeneraltransportuse;4）被保險人根據(jù)與他人的協(xié)議應(yīng)支付的賠償或其他款項，但即使沒有這種協(xié)議，被保險人仍應(yīng)承擔(dān)的責(zé)任不在此限。2.2.4indemnificationorpaymentmadebytheInsuredinaccordancewithanyagreementbetweentheInsuredandotherparties,unlesssuchliabilitywouldhavebeenattachedtotheinsurednotwithstandingsuchagreement.三、總除外責(zé)任Ⅲ.GENERALEXCLUSIONS在本保險單項下，本公司對下列各項不負責(zé)賠償：TheCompanyshallnotindemnifytheInsuredunderthisPolicyinrespectofloss,damage,expenses,orliabilitydirectlyorindirectlycausedbyorarisingoutoforaggravatedby:（一）1、戰(zhàn)爭、類似戰(zhàn)爭行為、敵對行為、武裝沖突、恐怖活動、謀反、政變引起的任何損失、費用和責(zé)任；1.1war,warlikeoperation,hostilities,armedconflicts,terrorism,conspiracyinsurrection,coupd'etat;2、政府命令或任何公共當(dāng)局的沒收、征用、銷毀或毀壞；1.2confiscation,requisition,destructionordamagebyanyactionororderofanygovernmentdejureordefactoorbyanypublicauthorities;3、罷工、暴動、民眾騷亂引起的任何損失、費用和責(zé)任；1.3strike,riot,civilcommotion;（二）被保險人及其代表的故意行為或重大過失引起的任何損失、費用和責(zé)任；2.intentionalactorgrossnegligenceoftheInsuredorhisrepresentative;（三）核裂變、核聚變、核武器、核材料、核幅射及放射性污染引起的任何損失、費用和責(zé)任；3.nuclearfission,nuclearfusion,nuclearweapon,nuclearmaterial,nuclearradiationandradioactivecontamination;（四）大氣、土地、水污染及其他各種污染引起的任何損失、費用和責(zé)任；4.pollutionofanykindordescriptionwhatsoeversuchasatmosphere,landandwaterpollutions;（五）工程部分停工或全部停工引起的任何損失、費用和責(zé)任；5.cessationofworkwhethertotalorpartial;（六）罰金、延誤、喪失合同及其他后果損失；6.consequentiallossofanykindordescriptionwhatsoeverincludingpenalties,lossesduetodelayorlossofcontract;（七）保險單明細表或有關(guān)條款中規(guī)定的應(yīng)由被保險人自行負擔(dān)的免賠額。7.thedeductiblesstatedintheScheduletobebornebytheInsured.四、保險金額Ⅳ.SUMINSURED（一）本保險單明細表中列明的保險金額應(yīng)不低于：1.ItisabasicrequirementofthisinsurancethatthesumsinsuredstatedintheScheduleshallnotbelessthan:1、安裝工程—保險工程安裝完成時的總價值，包括設(shè)備費用、原材料費用、安裝費、建造費、運輸費和保險費、關(guān)稅、其他稅項和費用，以及由工程所有人提供的原材料和設(shè)備的費用；1.1Forerectionwork-thefullvalueoftheinsuredprojectatthecompletionoftheerectionincludingcostofequipments,materials,erectionandconstruction,freightandpremium,customsduty,anyotherduesandexpenses,andthecostofmaterialsorequipmentssuppliedbythePrincipal;2、施工用機器、裝置和機械設(shè)備—重置同型號、同負載的新機器、裝置和機械設(shè)備所需的費用；1.2Forconstructionplantandequipment-thereplacementcostoftheinsureditemsbynewonesofthesamesizeandsamecapacity;3、其他保險項目—由被保險人與本公司商定的金額。1.3ForotherItemsInsured-thesumsagreeduponbetweentheInsuredandtheCompany.（二）若被保險人是以保險工程合同規(guī)定的工程概算總造價投保，被保險人應(yīng)：2.Ifthesuminsuredinrespectoferectionworkisbasedontheestimatedcontractvaluestatedintheerectioncontract,theInsuredshall:1、在本保險項下工程造價中包括的各項費用因漲價或升值原因而超出原保險工程造價時，必須盡快以書面通知本公司，本公司據(jù)此調(diào)整保險金額；2.1immediatelynotifytheCompanyinwritingifthecontractvalueincludingallexpensesunderthisinsuranceexceedstheoriginalinsuredcontractvalueduetoriseinpriceorincrement,andtheCompanyshallthenadjustthesuminsuredaccordingly;2、在保險期限內(nèi)對相應(yīng)的工程細節(jié)作出精確記錄，并允許本公司在合理的時候?qū)υ擁椨涗涍M行查驗；2.2keepapreciserecordinwritingontheparticularsoftheworkconcernedduringtheperiodofinsuranceandallowtherepresentativeoftheCompanytoinspectandexaminesuchrecordatanyreasonabletime;3、若保險工程的安裝期超過三年，必須從本保險單生效日起每隔十二個月向本公司申報當(dāng)時的工程實際投入金額及調(diào)整后的工程總造價，本公司將據(jù)此調(diào)整保險費；2.3iftheerectionperiodoftheinsuredprojectislongerthanthirty-six（36）months,declaretotheCompanyatanintervalofeverytwelve（12）monthsfromtheinceptiondateofthePolicy,theactualamountoffundputintotheprojectbythetimeofdeclarationaswellasthenewestimatecontractvalue,ifitisrevisedtheCompanyshalladjustthepremiumaccordingly;4、在本保險單列明的保險期限屆滿后三個月內(nèi)向本公司申報最終的工程總價值，本公司據(jù)此以多退少補的方式對預(yù)收保險費進行調(diào)整。2.4providetheCompanywiththeactualfinalcontractvaluewithinthree（3）monthsaftertheexpirydateofthisinsurance,andanydifferencebetweenthepremiumpaidinadvanceandthatpayableshallbepaidtoorrefundedbytheCompanyasthecasemaybe.否則，針對以上各條，本公司將視為保險金額不足，一旦發(fā)生本保險責(zé)任范圍內(nèi)的損失時，本公司將根據(jù)本保險單總則中第（六）款的規(guī)定對各種損失按比例賠償。Otherwise,theCompanyshalltakeitthattheSumsInsuredarelessthantheamountsrequiredtobeinsuredandincaseoflossordamagefallingwithintheCoverage,theindemnificationshallbemadeproportionatelyaccordingtotheProvision（6）oftheGeneralConditionsofthisPolicy.五、保險期限Ⅴ.PERIODOFINSURANCE（一）安裝期物質(zhì)損失及第三者責(zé)任保險：1.MaterialDamageandThirdPartyLiabilityInsuranceduringtheErectionPeriod:1、本公司的保險責(zé)任自保險工程在工地動工或用于保險工程的材料、設(shè)備運抵工地之時起始，至工程所有人對部分或全部工程簽發(fā)完工驗收證書或驗收合格，或工程所有人實際占有或使用或接收該部分或全部工程之時終止，以先發(fā)生者為準(zhǔn)。但在任何情況下，安工期保險期限的起始或終止不得超出本保險單明細表中列明的安工期保險生效日或終止日。1.1TheliabilityoftheCompanyshallcommencenotwithstandinganydatetothecontraryspecifiedintheSchedule,directlyuponcommencementoftheprojectoraftertheunloadingoftheinsuredprojectmaterialsorequipmentsatthesiteandshallexpireimmediatelyafteracertificateofcompletionhasbeenissuedforpartorwholeoftheinsuredprojectorpartorwholeoftheinsuredprojecthasbeentestedaftercompletionoractuallyoccupiedorputintoserviceortakenoverbythePrincipal,whicheveristheearlier.InnocaseshalltheeffectivedatebeearlierorexpirydatebelaterrespectivelythanbothdatesspecifiedintheSchedule.2、不論安裝的保險設(shè)備的有關(guān)合同中對試車和考核期如何規(guī)定，本公司僅在本保險單明細表中列明的試車和考核期限內(nèi)對試車和考核所引發(fā)的損失、費用和責(zé)任負責(zé)賠償；若保險設(shè)備本身是在本次安裝前已被使用過的設(shè)備或轉(zhuǎn)手設(shè)備，則自其試車之時起，本公司對該項設(shè)備的保險責(zé)任即行終止。1.2Notwithstandinganythingtothecontrarycontainedinthecontractconcerned,theCompanyshallonlybeliableforlossordamage,expensesandliabilitycausedorincurredbytestingorcommissioningarisingduringthetestingorcommissioningperiodstatedintheSchedule.Inthecaseofusingsecond-handitemsorequipments,theinsurancetosuchequipmentsshall,however,ceaseimmediatelyonthecommencementofthetest.3、上述保險期限的展延，須事先獲得本公司的書面同意，否則，從本保險單明細表中列明的安工期保險期限終止日起至保證期終止日止期間內(nèi)發(fā)生的任何損失、費用和責(zé)任，本公司不負責(zé)賠償。1.3AnyextensionsoftheperiodofinsuranceshallbesubjecttotheCompany'spriorconsentinwriting.Otherwise,theCompanyshallnotbeliableforanylossordamage,expenseandliabilityarisingduringtheperiodfromtheexpirydateoftheerectionperiodstatedintheScheduletotheexpirydateofthemaintenanceperiodspecifiedbelow.（二）保證期物質(zhì)損失保險：2.MaterialDamageInsuranceduringtheMaintenancePeriod保證期的保險期限與工程合同中規(guī)定的保證期一致，從工程所有人對部分或全部工程簽發(fā)完工驗收證書或驗收合格，或工程所有人實際占有或使用或接收該部分或全部工程時起算，以先發(fā)生者為準(zhǔn)。但在任何情況下，保證期的保險期限不得超出本保險單明細表中列明的保證期。Theperiodofinsurance,beingsubjecttothemaintenanceperiodspecifiedintheinsuredcontract,shallcommenceatthetimewhenacertificateofcompletionhasbeenissuedforpartorpartsoftheinsuredprojectorpartorpartsoftheinsuredprojecthavebeentestedaftercompletionoractuallyoccupiedorputintoserviceortakenoverbythePrincipal,whicheveristheearlier.Itishoweverprovidedthat,undernocircumstancesshallsuchperiodgobeyondthemaintenanceperiodstatedintheSchedule.六、賠償處理Ⅵ.TREATMENTOFCLAIM（一）對保險財產(chǎn)遭受的損失，本公司可選擇以支付賠款或以修復(fù)、重置受損項目的方式予以賠償，但對保險財產(chǎn)在修復(fù)或重置過程中發(fā)生的任何變更、性能增加或改進所產(chǎn)生的額外費用，本公司不負責(zé)賠償。1.TheCompanyshall,atitsoption,indemnifytheInsuredinrespectoflossofordamagetotheinsuredpropertyeitherbywayofpaymentincashorbywayofrepairorreplacementoftheitemslostordamaged;nevertheless,theextracostofanyalterations,additionsorimprovementsoccurringinthecourseofrepairorreplacementshallnotberecoverableunderthisPolicy.（二）在發(fā)生本保險單物質(zhì)損失項下的損失后，本公司按下列方式確定賠償金額：2.IncaseofanylossordamagerecoverableundertheSectionIofthePolicy,theCompanyshallascertaintheamountofindemnityonthefollowingbasis:1、可以修復(fù)的部分損失——以將保險財產(chǎn)修復(fù)至其基本恢復(fù)受損前狀態(tài)的費用扣除殘值后的金額為準(zhǔn)。但若修復(fù)費用等于或超過保險財產(chǎn)損失前的價值時，則按下列第2項的規(guī)定處理；2.1Incaseofdamagewhichcanberepaired,theCompanyshallpaythecostofrepairsnecessarytorestorethedamageditemtoitsnearestconditionimmediatelyprecedingthedamageafterdeductingthesalvagevalue.If,however,thecostofrepairsequalsorexceedsthevalueoftheitemimmediatelybeforetheoccurrenceofthedamage,thesettlementsshallbemadeaccordingtotheprovisions2.2.2、全部損失或推定全損——以保險財產(chǎn)損失前的實際價值扣除殘值后的金額為準(zhǔn)，但本公司有權(quán)不接受被保險人對受損財產(chǎn)的委付；2.2Incaseofatotalorconstructivetotalloss,theCompanyshallpaytheamountoftheactualvalueoftheinsureditemsimmediatelybeforetheoccurrenceofthelossafterdeductingthesalvagevalue.However,theCompanymay,atitsoption,declinetheabandonmentofanydamagedpropertybytheInsured.3、任何屬于成對或成套的設(shè)備項目，若發(fā)生損失，本公司的賠償責(zé)任不超過該受損項目在所屬整對或整套設(shè)備項目的保險金額中所占的比例；2.3Intheeventoflossofordamagetoanyequipmentiteminsuredformingpartofapairorset,theCompanyshallnotbeliableinrespectofeachofsuchitemlostordamagedformorethanitsproportionatepartofthesuminsuredonthecompletepairorset.4、發(fā)生損失后，被保險人為減少損失而采取必要措施所產(chǎn)生的合理費用，本公司可予以賠償，但本項費用以保險財產(chǎn)的保險金額為限。2.4Intheeventofanylossoccurrence,theCompanyshallalsopaytheInsuredfortheexpensesreasonablyincurredfortakingnecessarymeasurestominimizelossordamagetotheleastextent,butinnocaseshalltheaggregateamountoftheindemnityandsuchexpensesreferredheretoexceedthesuminsuredoftheitemssustaininglossordamage.（三）本公司賠償損失后，由本公司出具批單將保險金額從損失發(fā)生之日起相應(yīng)減少，并且不退還保險金額減少部分的保險費。如被保險人要求恢復(fù)至原保險金額，應(yīng)按約定的保險費率加繳恢復(fù)部分從損失發(fā)生之日起至保險期限終止之日止按日比例計算的保險費。3.Uponsettlementofaclaim,anendorsementshallbeissuedbytheCompanytoreducethesuminsuredcorrespondingtothepropertylostordamagedbytheamountsosettledfromthedateofloss,andnopremiumshallberefundedfortheamountsoreduced.IfreinstatementofthesuminsuredisrequiredbytheInsureduponsettlementoftheclaim,anadditionalpremiumforthereinstatedamountshallbechargedatanagreedrat,andbecalculatedonproratadailybasisfromthedateoflosstotheexpiryoftheinsurance.（四）在發(fā)生本保險單第三者責(zé)任項下的索賠時：4.IntheeventofanyclaimrecoverableundertheSectionIIofthisPolicy:1、未經(jīng)本公司書面同意，被保險人或其代表對索賠方不得作出任何責(zé)任承諾或拒絕、出價、約定、付款或賠償。在必要時，本公司有權(quán)以被保險人的名義接辦對任何訴訟的抗辯或索賠的處理；4.1Noadmission,rejection,offer,promise,paymentorindemnityshallbemadeorgivenbyoronbehalfoftheInsuredorhisrepresentativewithoutthewrittenconsentoftheCompany.AndtheCompanyshallbeentitled,ifitsodesires,totakeoverandconductinthenameoftheInsuredthedefenceorsettlementofanyclaim;2、本公司有權(quán)以被保險人的名義，為本公司的利益自付費用向任何責(zé)任方提出索賠的要求。未經(jīng)本公司書面同意，被保險人不得接受責(zé)任方就有關(guān)損失作出的付款或賠償安排或放棄對責(zé)任方的索賠權(quán)利，否則，由此引起的后果將由被保險人承擔(dān)；4.2TheCompanyshallbeentitled,atitsownexpenseandforitsownbenefit,toprosecuteinthenameoftheInsuredanyclaimforindemnityagainstanypersons.WithoutthewrittenconsentoftheCompany,theInsuredshallnotacceptthepaymentorarrangementofindemnityinrespectofthelossordamageofferedbyanypartyheldresponsibleforsuchlossordamageandshallnotabandontherightofrecoveryfromsuchparty,otherwise,theInsuredshallbeliableforanyconsequencearisingtherefrom;3、在訴訟或處理索賠過程中，本公司有權(quán)自行處理任何訴訟或解決任何索賠案件，被保險人有義務(wù)向本公司提供一切所需的資料和協(xié)助。4.3TheCompanyshallhavefulldiscretiontoconductanyproceedingsorsettleanyclaim,andtheInsuredshallgiveallsuchinformationandassistanceastheCompanymayrequire.（五）被保險人請求索賠的權(quán)利，自其知道或者應(yīng)當(dāng)知道保險事故發(fā)生之日起二年不行使而消滅。5.Thetimeofvalidityofaclaimunderthisinsuranceshallnotexceedaperiodoftwoyearscountingfromthedateofloss.七、被保險人的義務(wù)Ⅶ.INSURED’SOBLIGATIONS被保險人及其代表應(yīng)嚴格履行下列義務(wù)：ThefollowingObligationsshallbestrictlyfulfilledbytheInsuredandhisrepresentative:（一）在投保時，被保險人及其代表應(yīng)對投保申請書中列明的事項以及本公司提出的其他事項作出真實、詳盡的說明或描述；1.TheInsuredandhisrepresentative,whenapplyingforinsuranceshallmaketrueanswersordescriptionstothequestionsintheProposalandQuestionnaireortoanyotherquestionsraisedbytheCompany.（二）被保險人或其代表應(yīng)根據(jù)本保險單明細表和批單中的規(guī)定按期繳付保險費；2.TheInsuredandhisrepresentativeshallpaytotheCompanyinduecoursetheagreedpremiuminthemannerasprovidedintheScheduleandEndorsement.（三）在本保險期限內(nèi)，被保險人應(yīng)采取一切合理的預(yù)防措施，包括認真考慮并付諸實施本公司代表提出的合理的防損建議，謹慎選用施工人員，遵守一切與施工有關(guān)的法規(guī)和安全操作規(guī)程，由此產(chǎn)生的一切費用，均由被保險人承擔(dān)；3.Duringtheperiodofinsurance,theInsuredshallathisownexpensetakeallreasonableprecautions,includingpayingsufficientattentiontoandputtingintopracticethereasonablerecommendationsoftheCompany,prudentlyselectingtheworkmenandemployeesandcomplyingwithallstatutoryregulationsandsafetyoperationproceduresrelativetotheperformanceoftheprojectinsured.（四）在發(fā)生引起或可能引起本保險單項下索賠的事故時，被保險人或其代表應(yīng)：4.InthheeveentoffanyoccurrrenceewhicchgivvesorrmighhtgivverissetoaclaaimunndertthisPPolicyy,theeInsuuredoorhissreprresenttativeeshalll:1、立即通知本公司司，并在七天天或經(jīng)本公司司書面同意延延長的期限內(nèi)內(nèi)以書面報告告提供事故發(fā)發(fā)生的經(jīng)過、原原因和損失程程度；4.1NotiifythheCommpanyimmeddiatellyanddwithhinseeven（7）dayssoraanyfuurtherrperiiodassmaybeaggreedbythheCommpanyinwrritingg,furrnishawriittenreporrttoindiccatetthecoourse,,probbablereasoonanddexteentofflosssorddamagee;2、采取一切必要措措施防止損失失的進一步擴擴大并將損失失減少到最低低程度；4.2Takeeallnecesssarymeasuuresttoavooidagggravaationofthhelosssordamaggeanddminiimizeittooleasstexttent;3、在本公司的代表表或檢驗師進進行勘查之前前，保留事故故現(xiàn)場及有關(guān)關(guān)實物證據(jù)；；4.3PresservethesspotaaffecttedannddeffectivveparrtsbeeforeaninnspecttioniiscarrriedoutbbyarrepressentattiveoorsurrveyorrfrommtheCompaany;4、在保險財產(chǎn)遭受受盜竊或惡意意破壞時，立立即向公安部部門報案；4.4InfoormthhePubblicSSecuriityBuureauimmeddiatellyincaseofloossorrdamaageduuetothefttorbburglaaryorrmaliicioussactss;5、在預(yù)知可能引起起訴訟時，立立即以書面形形式通知本公公司，并在接接到法院傳票票或其他法律律文件后，立立即將其送交交本公司；4.5ImmeediateelygiivenooticetothheCommpanyinwrritinggwhenneverhavinngknoowledggeofanyiimpenddingpproseccutionnincconnecctionwithanyaaccideentfoorwhiichthheremmaybeeliabbilityyundeerthiisPollicy,andfforwarrdtotheCCompannyeveeryleetterwrit,,summmonsoorproocessorottherccourtdocummentsonreeceiptttherreof;6、根據(jù)本公司的要要求提供作為為索賠依據(jù)的的所有證明文文件、資料和和單據(jù)。4.6furnnishaallsuuchinnformaationandddocumeentaryyeviddenceasthheCommpanymayrrequirreforrsuppportinngtheeclaiim.（五）若在某一保保險財產(chǎn)中發(fā)發(fā)現(xiàn)的缺陷表表明或預(yù)示類類似缺陷亦存存在于其他保保險財產(chǎn)中時時，被保險人人應(yīng)立即自付付費用進行調(diào)調(diào)查并糾正該該缺陷。否則則，由類似缺缺陷造成的一一切損失應(yīng)由由被保險人自自行承擔(dān)。5.Ifdiiscoveeryoffadeefectinannyproopertyyinsuuredsshallindiccateoorsugggestthatsimillardeefectexisttsinotherrproppertyinsurred,ttheInnsureddshalll,atthisowneexpensses,iinvesttigateeandrectiifyfoorthwiiththhedeffectiinsucchothherprropertty.Ottherwiise,aallloossorrdamaagearrisinggoutofthhesaiiddeffectsshallbeboornebbytheeInsuured.八、總則Ⅷ.GGENERAALCONNDITIOONS（一）保單效力1.PoolicyEffecct被保險人嚴格地遵遵守和履行本本保險單的各各項規(guī)定，是是本公司在本本保險單項下下承擔(dān)賠償責(zé)責(zé)任的先決條條件。ThedueobserrvanceeandfulfiilmenttofttheteermsaandcoonditiionsoofthiisPollicyiinsofaraastheeyrellatettoanyythinggtobbedonneorcomplliedwwithbbytheeInsuuredsshallbeacondiitionpreceedenttoannyliaabilittyoftheCCompannyundderthhisPoolicy..（二）保單無效2.PoolicyVoidaance如果被保險人或其其代表漏報、錯錯報、虛報或或隱瞞有關(guān)本本保險的實質(zhì)質(zhì)性內(nèi)容，則則本保險單無無效。ThisPollicysshallbevooidablleintheeeventofmiisreprresenttationn,missdescrriptioonornon-ddiscloosuremadebythheInssuredorhiisreppresenntativveinanymmateriialpaarticuulariinresspectofthhisinnsurannce.（三）保單終止3.PoolicyTermiinatioon除非經(jīng)本公司書面面同意，本保保險單將在下下列情況下自自動終止；UnlessiitscoontinuuancebeaddmitteedbytheCCompannyinwritiing,tthisPPolicyyshalllbeautommaticaallytterminnatedif:1.被保險人喪失保險險利益；3..1theeinsuurableeinteerestofthheInssuredisloost;2.承保風(fēng)險擴大。33.2thherisskoflossordaamageisinncreassed.本保險單終止后，本本公司將按日日比例退還被被保險人本保保險單項下未未到期部分的的保險費。AfterteerminaationofthhePollicy,theppremiuumshaallbeerefuundedtothheInssuredcalcuulateddonpproraatadaailybbasisfortthepeeriodtheddateoofterrminattionttotheedateeofeexpiryy.（四）權(quán)益喪失4.FoorfeittofBBenefiit如果任何索賠含有有虛假成分，或或被保險人或或其代表在索索賠時采取欺欺詐手段企圖圖在本保險單單項下獲取利利益，或任何何損失是由被被保險人或其其代表的故意意行為或縱容容所致，被保保險人將喪失失其在本保險險單項下的所所有權(quán)益。對對由此產(chǎn)生的的包括本公司司已支付的賠賠款在內(nèi)的一一切損失，應(yīng)應(yīng)由被保險人人負責(zé)賠償。Ifthecclaimisinnanyrespeectfrraudullent,oriffanyfrauddulenttmeannsordeviccesarreuseedbytheIInsureedorhisrrepressentattivettoobttainaanybeenefittundeerthiisPollicyoorifanyllossoordammageiisocccasionnedbyytheintenntionaalacttoriintheeconnnivancceoftheIInsureedorhisrrepressentattive,theninannyoftheseecasees,allltheerighhtsanndbennefitssofttheInnsureddundeerthiisPollicysshallbefoorfeitted,aandalllconnsequeentloossesarisiingthherefrrominncludiingthheamoountoofclaaimpaaidbyytheCompaanyshhallbbeinddemniffiedbbytheeInsuured.（五）合理查驗5.ReeasonaableIInspecction本公司的代表有權(quán)權(quán)在任何適當(dāng)當(dāng)?shù)臅r候?qū)Ρ１ｋU財產(chǎn)的風(fēng)風(fēng)險情況進行行現(xiàn)場查驗。被被保險人應(yīng)提提供一切便利利及本公司要要求的用以評評估有關(guān)風(fēng)險險的詳情和資資料。但上述述查驗并不構(gòu)構(gòu)成本公司對對被保險人的的任何承諾。ThereprresenttativeeofttheCoompanyyshalllatanyssuitabbletiimebeeentiitledtoatttendthessiteaandinnspecttoreexaminnetheeriskkexpoosureofthheproopertyyinsuured.Fortthisppurposse,thheInssuredshalllprovvideffullaassisttanceandaalldeetailssandinforrmatioonreqquireddbyttheCoompanyyasmmaybeeneceessaryyfortheaassesssmentofthherissk.ThheaboovemeentionnedinnspecttionoorexaaminattionsshallinnoocirccumstaancesbeheeldassanyadmisssiontothheInssuredbythheCommpany..（六）比例賠償6.Avveragee在發(fā)生本保險物質(zhì)質(zhì)損失項下的的損失時，若若受損保險財財產(chǎn)的分項或或總保險金額額低于對應(yīng)的的應(yīng)保險金額額（見四、保保險金額），其其差額部分視視為被保險人人所自保，本本公司則按本本保險單明細細表中列明的的保險金額
