(8)QualityandWeight:Forthequanlityandweightofthegoodsshipped,theinspection

certificate(s)issuedbytheImportandExportCommodityInspectionBureauofthePeople’sRepublicofChinaattheportofshipmentshallbepartofthedocumentstobepresentedfornegotiationundertherelevantletterofcredit.

品質(zhì)與重量：中華人民共和國(guó)進(jìn)出口商品檢查局應(yīng)就出口商品的品質(zhì)與重量出具檢查證書，該檢查證書應(yīng)作為議付單據(jù)在信用證中有所提示。

(9)DiscrepancyandClaims:Shouldthequalityand/orquantity(weight)befoundnotin

conformitywiththatofthecontract,theBuyersareentitledtolodgewiththeSellersaclaimwhichshouldbesupportedbysurveyreportsissuedbuarecognizedsurveyorapprovedbytheSellers.Theclaim,ifany,shallbelodgedwithin30daysafterarrivalofthecargoattheportofdestination.

不符與索賠：若發(fā)現(xiàn)品質(zhì)、數(shù)量或重量與合同不符，買方應(yīng)于貨到目的港后30天內(nèi)提出索賠，并同時(shí)提交由權(quán)威部門或賣方提供的勒察報(bào)告。

(10)ForceMajeure:Thesellersshallnotbeheldliablefornon-deliveryordelayeddeliveryofthe

goodsduetoaccidentsbeyondtheircontrol.However,theSellersshalldelivertotheBuyersthedocumentaryevidence(s)offorcemajeurecause(s).

不可抗力：如因不可抗力因素致使賣家無法交貨或延遲交貨，賣方概不負(fù)責(zé)，但賣方應(yīng)就不可抗力因素向買方提交證明材料。

(11)Arbitration:Alldisputesinconnectionwiththiscontractoritsexecutionshallbesettledby

negotiation.Incasenosettlementcanbereached,thecaseunderdisputeshallthenbesubmittedtoChinaInternationalEconomicandTradeCommissioninBeijingforarbitrationinaccordancewithitsArbitrationRules.Thedecisionshallbefinalandbindinguponbothparties.Thearbitrationfeesshallbebornebythelosingparty.

ForceMajeure:

executiveorjudicialdecisionsorpronouncementsbindingoneitherPartyorinrelationtothesubjectmatterofthisContract.“有關(guān)法律”指對(duì)本合同一方或本合同標(biāo)的合用的法律、法規(guī)、規(guī)章，以及立法、行政或司法機(jī)關(guān)頒布的告知、命令、決定或其它公示文獻(xiàn)。
