Whiletheseappshaveagreatdealtooffer,itisnotalwaysclearhowthepersonalinformationweinputiscollected,safeguardedandsharedonline.Existinghealthprivacylaw,suchastheHealthInsurancePortabilityandAccountabilityAct,isprimarilyfocusedonthewayhospitals,doctors'offices,clinicsandinsurancecompaniesstorehealthrecordsonline.Thehealthinformationtheseappsandhealthdatatrackingwearablesarecollectingtypicallydoesnotreceivethesamelegalprotections.

Withoutadditionalprotectionsinplace,companiesmayshare(andpotentiallymonetize)personalhealthinformationinawayconsumersmaynothaveauthorizedoranticipated.In2021,FloHealthfacedaFederalTradeCommissionFTC)investigation.TheFTCallegedinacomplaintthat"despiteexpressprivacyclaims,thecompanytookcontrolofusers'sensitivityfertilitydataandshareditwiththirdparties."FloHealthandtheFTCsettledthematterwithaConsentOrderrequiringthecompanytogetappusers'expressaffirmativeconsentbeforesharingtheirhealthinformationaswellastoinstructthethirdpartiestodeletethedatatheyhadobtained.
