8、b.五、社會保險及其他保險福利待遇Social Welfare and Ben efits第八條 甲方按國家和地方政策規(guī)定為乙方辦理社會保險有關(guān)手續(xù),并 承擔(dān)相應(yīng)的義務(wù)。Article 8: Party A shall deal with the releva nt formalities ofsocial security for Party B according to the country and local policies and take up the releva nt liabilities.第九條 乙方患職業(yè)病或因工負(fù)傷后的工資和醫(yī)療補助執(zhí)行按照國家和 地方的有關(guān)法律法規(guī)執(zhí)
9、行。Article 9:The salary and Medicare ben efits of Party B in case ofoccupati onal diseases or work-related in juriesshall be paid in accorda nee with the relevant national and local laws and regulations.第十條 乙方患職業(yè) 病或因工負(fù)傷的待遇按國家的 有關(guān)規(guī)定 執(zhí)行。 Article 10: If Party B suffers illness or non-work related injury
10、, Party A shall implement relevant state provisions.六、勞動保護、勞動條件和職業(yè)危害防護Labor protection, labor condition and occupational harm prevention andcure第十一條 甲方根據(jù)生產(chǎn)崗位 的需要 ,按照國家有 關(guān)勞動 安全、衛(wèi) 生的規(guī)定為乙方配備必要的安全防護措施,發(fā)放必要的勞動保護用 品。Article 11: Party A shall equip Party B with the necessary safety protection measures and
11、issue the necessary labor protection articles according to the needs of the post and the rules of the labor safety and hygiene.第十 二條 甲 方應(yīng)當(dāng)建立、 健全 職業(yè)病防治責(zé)任制 度, 加強 對職 業(yè)病防治的管理,提高職業(yè)病防治水平。Article 12 : Party A shall set up and optimize the occupational disease cure responsibility system, enforce the managem
12、ent over the occupational disease and promote the cure level of the occupational disease.七、勞動合同的解除、終止和經(jīng)濟補償Change, Cancellation, Termination and Renewal of the LaborContract第十 三條 甲乙雙方解除、變更、終止、續(xù)訂勞動合同應(yīng)當(dāng)依照勞動 合同法和國家及省、市等有關(guān)規(guī)定執(zhí)行。Article 13 :If the parties revoke, modify, terminate and extent the labor cont
13、ract, they shall perform them according to the relevant rules of the Labor Contract Law and the country, province and city etc.第十 四條 甲方應(yīng)在解除或者終止勞動合同時,為乙方出具解除或者終 止勞動合同的證明,并在 15 日內(nèi)為勞動者辦理相關(guān)手續(xù)。乙方應(yīng)在甲方出具 解除或者終止勞動合同的證明后 10 日內(nèi)辦理工作移交,如涉及經(jīng)濟補償?shù)陌?國家有關(guān)規(guī)定在辦結(jié)工作交接時支付。Article 14 :Uponthe revocation or termination of
14、the labor contract, Party A shall issue the certification for revocation or termination of the labor contract to Party B and deal with the relevant formalities for the laborer within fifteen (15)days. Party B shall make the work handover within ten (10) days after issuance by Party A of the certific
15、ate of revocation or termination of the labor contract. Regarding any economic compensation, they shall be paid upon the handover of the work according to the rules of the country.八、勞動爭議處理Labor Dispute Resolutions第十五條 雙方發(fā)生爭議,任何一方當(dāng)事人可向甲方所在地的勞動爭議仲裁 委員會申訴,由仲裁委員會依法調(diào)解或裁決。 如對仲裁不服, 向甲方所在地人 民法院起訴, 一方當(dāng)事人期滿不起
16、訴但又不執(zhí)行裁決的, 另方當(dāng)事人可向人民 法院申請強制執(zhí)行。Article 15 :In case disputes arise between two parties, either party can appeal to labour disputes arbitration commission at party A' slocation, subject to mediation or adjudication by arbitration commission. In case of disobedience of arbitration result, either par
17、ty can sue to the court at party A's location. Either party neither brings the lawsuit during the valid period nor performs the adjudication; the other party has the right to apply for forcible execution to the court.第十六條 乙方承諾本合同乙方通訊地址為甲方向乙方寄送郵件信函的 地址,甲方按該地址寄送的郵件信函如無法送達(dá)被退回即視為該郵件已送達(dá)乙 方。Article 16
18、: Party B promises his correspondence address of thecontract shall be the address that Party A sends the letters or mails to Party B. If any letters or mails are not returned or undeliverable after Party A sends them, it is deemed that they have arrived at Party B.第十七條 本合同未盡事宜,應(yīng)按國家現(xiàn)行法律、法規(guī)、規(guī)章執(zhí)行。本 合同條款如與國家法律、法規(guī)、政策相抵觸時,以國家規(guī)定為準(zhǔn)。Article 17: Affairs unmentioned in this
