賣方索賠：買方遲開、拒開信用證；不按時付款贖單，無理拒收貨物；(FOB)不按時派船或簽訂運輸合同、指定交貨地點。

如貨物損失屬輪船公司或保險公司責(zé)任范圍，則受損方應(yīng)及時提出索賠。

1.2ReasonsofClaim1.3Responsibility(a)Claimsagainsttheseller.Aclaimmaybefiledbythebuyeragainstthesellerwherethesellerfailstomaketimelydeliveryorrefusestomakedelivery;wherethegoodsdeliveredbythesellerisnotinaccordancewiththecontractedquantity,quality,specification;andthegoodsaredamagedduetoimproperpackingetc.

(b)Claimsagainsttheshippingcompany.Theshippingcompanyisresponsiblefortherelevantlossesanddamageswhereshippingcompanyisresponsibleforcircumstancessuchas:thequantityofthegoodsislessthanthatstatedintherelevantB/L;thegoodshavetracesofdamagesunderacleanB/L.
