orgrossnegligence,PartyBshallbeartheliabilityforpensation.##六、工作條件與勞動(dòng)保護(hù)1.甲方應(yīng)為乙方提供符合國家規(guī)定的安全、衛(wèi)生的工作條件和必要的勞動(dòng)保護(hù)用品，保障乙方在工作過程中的人身安全和健康。2.乙方在工作過程中應(yīng)正確使用甲方提供的勞動(dòng)保護(hù)用品，遵守安全操作規(guī)程，如因乙方違反規(guī)定導(dǎo)致自身傷亡事故的，由乙方自行承擔(dān)責(zé)任。1.PartyAshallprovidePartyBwithsafeandhygienicworkingconditionsandnecessarylaborprotectionarticlesinaccordancewithnationalregulationstoensurePartyB'spersonalsafetyandhealthduringtheworkprocess.2.PartyBshallcorrectlyusethelaborprotectionarticlesprovidedbyPartyAduringtheworkprocessandabidebythesafetyoperationprocedures.IfPartyBcausesitsowncasualtiesduetoviolationoftheregulations,PartyBshallbeartheresponsibilitybyitself.##七、協(xié)議的變更、解除與終止1.經(jīng)雙方協(xié)商一致，可以書面形式變更本協(xié)議的內(nèi)容。2.在履行本協(xié)議過程中，若一方提出解除協(xié)議，需提前[具體通知期限，如30天]書面通知對(duì)方，并經(jīng)對(duì)方書面同意。3.本協(xié)議在以下情形下終止：-本協(xié)議期滿且雙方未續(xù)簽的。-雙方協(xié)商一致解除本協(xié)議的。-因不可抗力或其他不可預(yù)見、不可避免的原因致使本協(xié)議無法繼續(xù)履行的。-一方嚴(yán)重違反本協(xié)議約定或法律法規(guī)規(guī)定，另一方依法解除本協(xié)議的。1.Withtheconsensusofbothparties,thecontentofthisagreementcanbechangedinwriting.2.Duringtheperformanceofthisagreement,ifeitherpartyproposestoterminatetheagreement,itshallgivetheotherpartyawrittennotice[specificnoticeperiod,suchas30days]inadvanceandobtainthewrittenconsentoftheotherparty.3.Thisagreementshallterminateunderthefollowingcircumstances:-Thetermofthisagreementexpiresandthetwopartiesdonotrenewit.-Thetwopartiesreachaconsensustoterminatethisagreement.-Duetoforcemajeureorotherunforeseeableandunavoidablereasons,thisagreementcannotbecontinuedtobeperformed.-Onepartyseriouslyviolatestheagreementortheprovisionsoflawsandregulations,andtheotherpartyterminatesthisagreementaccordingtolaw.##八、違約責(zé)任1.若甲方未按照本協(xié)議約定及時(shí)、足額向乙方支付勞務(wù)報(bào)酬，每逾期一天，應(yīng)按照未支付金額的[X%]向乙方支付違約金。2.若乙方未按照本協(xié)議約定履行勞務(wù)服務(wù)義務(wù)，給甲方造成損失的，應(yīng)承擔(dān)賠償責(zé)任。賠償金額以甲方因此遭受的實(shí)際損失為準(zhǔn)。3.雙方違反本協(xié)議約定的其他條款，應(yīng)承擔(dān)相應(yīng)的違約責(zé)任，賠償對(duì)方因此遭受的損失。1.IfPartyAfailstopaylaborremunerationtoPartyBinatimelyandfullamountinaccordancewiththeagreement,foreachdayofdelay,PartyAshallpayliquidateddamagestoPartyBattherateof[X%]oftheunpaidamount.2.IfPartyBfailstoperformthelaborserviceobligationsinaccordancewiththeagreementandcauseslossestoPartyA,PartyBshallbeartheliabilityforpensation.TheamountofpensationshallbebasedontheactuallossessufferedbyPartyA.3.Ifbothpartiesviolateothertermsofthisagreement,theyshallbearthecorrespondingliabilityforbreachofcontractandpensatetheotherpartyforthelossessufferedthereby.##九、爭議解決1.本協(xié)議的簽訂、履行、解釋及爭議解決均適用中華人民共和國法律。2.雙方在履行本協(xié)議過程中如發(fā)生爭議，應(yīng)首先通過友好協(xié)商解決；協(xié)商不成的，可以向有管轄權(quán)的人民法院提起訴訟。1.Thesigning,performance,interpretationanddisputeresolutionofthisagreementshallbegovernedbythelawsofthePeople'sRepublicofChina.2.Ifdisputesoccurbetweenthetwopartiesduringtheperformanceofthisagreement,theyshallfirstresolvethemthroughfriendlyconsultations;iftheconsultationsfail,theymayfilealawsuitwiththepeople'scourtwithjurisdiction.##十、其他條款1.本協(xié)議自雙方簽字（或蓋章）之日起生效，有效期為[具體協(xié)議有效期，
