房屋買賣居間協(xié)議BROKERAGECONTRACTOFREALPROPERTYPURCHASE甲方（賣方）：PartyA(Seller):乙方（買方）：PartyB(Buyer):丙方（居間方）：PartyC(Agent):根據(jù)中華人民共和國(guó)有關(guān)法律、法規(guī)和北京市有關(guān)規(guī)定，甲、乙雙方遵照自愿、公平和誠(chéng)實(shí)信用的原則，共同委托丙方代理并見(jiàn)證甲乙雙方之間的買賣行為，經(jīng)甲、乙、丙三方協(xié)商一致，共同簽訂本協(xié)議，以茲各方共同遵守。PursuanttorelevantlawsandregulationsofthePeople’sRepublicofChinaandrelevantrulesofBeijingMunicipality,PartyAandPartyBentrustPartyCtoactastheiragentforthesalesbetweenPartyAandPartyBandbeartestimonytotheafore-saidtransactioninprincipleofvoluntary,fairnessandhonesty.Throughfriendlynegotiation,PartyA,PartyBandPartyCherebyagreetoenterintothisAgreementandabidebyitjointly.第一條房產(chǎn)成交Sales&purchaseoftheproperty甲方自愿將自有的房屋產(chǎn)權(quán)有償轉(zhuǎn)讓給乙方。該房產(chǎn)符合北京市建設(shè)管理委員會(huì)制定的房屋上市原則，甲方發(fā)售該房屋時(shí)亦同步將該房屋已分?jǐn)偟耐恋厥褂妹娣e和土地有效期限轉(zhuǎn)讓給乙方。房屋詳細(xì)狀況如下：PartyAagreestosellthepropertytoPartyB.ThepropertyisqualifiedforsaleinthemarketinaccordancewiththeregulationofBeijingMunicipalConstructionCommittee.Togetherwiththesalesoftheproperty,theallocatedlandareaforthepropertyandtheusabletermofthelandistransferredtoPartyBjointly.Thepropertyisdescribedas:1、甲方依法獲得的房屋產(chǎn)權(quán)證號(hào)為：；Serialno.ofthetitlecertificateofthepropertyis:______________;2、房產(chǎn)位于北京市區(qū)【縣】；Address:District(County),Beijing;房屋構(gòu)造：，房屋用途：；（有產(chǎn)權(quán)車位的請(qǐng)尤其注明）architecture:_________,purpose:_________(pleaseindicateifthereisparkinglotwithtitle);3、房屋建筑面積平方米；房屋使用面積平方米（可不填）；Constructionarea:_________m2;usablefloorspace:__________m2(optional);4、房產(chǎn)權(quán)屬轉(zhuǎn)移時(shí)，附帶附屬設(shè)施狀況及室內(nèi)裝飾狀況見(jiàn)（附件二）； Togetherwiththetitleoftheproperty,facilitiesandinteriordecorationstobetransferredareasdescribedinAppendix(1);5、甲方保證已如實(shí)陳說(shuō)該房產(chǎn)權(quán)屬狀況、裝飾狀況和有關(guān)關(guān)系，乙方對(duì)甲方上述轉(zhuǎn)讓房產(chǎn)的詳細(xì)狀況充足理解，自愿買受該房產(chǎn)；PartyAshallguaranteethatithascompletelydisclosedthefactsabouttheproperty,includingbutnotlimitedtothetitle,decorationandrelevantinformation;PartyBhasfullyunderstoodthefactsandagreestobuythepropertyvoluntarily.6、房屋共有人及共有人意見(jiàn)：Co-ownersofthepropertyandintentionforthesale房屋共有人：指對(duì)房屋共同享有所有權(quán)的兩個(gè)或兩個(gè)以上自然人、法人或其他組織的共有人。Co-ownersrefertomorethanoneperson,legalpersonororganization,whoownthetitleofthepropertytogether.第二條成交價(jià)格及付款方式Salespriceandtermsofpayment一、成交價(jià)格SalesPrice甲、乙雙方經(jīng)協(xié)商一致，同意上述房產(chǎn)成交價(jià)格為人民幣元；上述交易總價(jià)款包括：【房?jī)r(jià)款】【公共維修基金】【室內(nèi)不可移動(dòng)之裝修】【空調(diào)】及其他PartyAandPartyBagreethatthesalespriceofthepropertybeRMB______;Thepriceincludes:[priceoftheproperty],[publicmaintenancefund],[permanentinteriordecoration],[air-conditioners]andothers.1. 二、付款方式TermsofPayment甲乙雙方經(jīng)協(xié)商一致，甲方承認(rèn)乙方采用如下第種方式付款：PartyBshallmakethepaymentinaccordancewith________asfollow:A. 1、現(xiàn)金支付Cash乙方應(yīng)在簽訂本協(xié)議當(dāng)日，預(yù)先支付總房款的%，作為保證雙方履行協(xié)議的定金，該筆款項(xiàng)連同剩余款項(xiàng)經(jīng)甲乙雙方協(xié)商，決定采用下列第種方式：UponsigningofthisAgreement,PartyBshallpay10%oftheprice(sayRMB________)asthedeposit.Thispaymentshallbemadeinaccordancewith______asfollow:i. 所有支付給甲方，甲方開(kāi)具對(duì)應(yīng)的收款憑證；PaidtoPartyAinfullandPartyAshallissueaninvoice;b) 臨時(shí)存入二十一世紀(jì)不動(dòng)產(chǎn)北京區(qū)域分部在特定銀行開(kāi)立的監(jiān)管賬戶內(nèi)，由該銀行監(jiān)管該部分資金，待該房屋權(quán)屬過(guò)戶手續(xù)辦理完畢及物業(yè)交割后，連同剩余房款一并支付給甲方。此業(yè)務(wù)須由甲乙雙方與二十一世紀(jì)不動(dòng)產(chǎn)北京區(qū)域分部另行簽訂交易資金監(jiān)管委托協(xié)議；DepositedtemporarilytotheescrowaccountofCentury21BeijingRegion.ThisdepositwillbereleasedonlywhenthetitletransferfromPartyAtoPartyBiscompletedandthepropertyhandoverhasbeenconcluded,andthedepositwillbereleasedtogetherwiththeremainingpaymenttoPartyA.Todothis,PartyAandPartyBneedtosignaseparateEscrowAgreementwithCentury21BeijingRegion.剩余款項(xiàng)的支付：Paymentmethodoftheremainingamount監(jiān)管賬戶即視同乙方已履行向甲方給付定金和房款的義務(wù)。PartyAandPartyBherebyagreethat,fortheafore-saidmethod(b),oncetheescrowfundisdepositedintheescrowaccountofCentury21BeijingRegion,itisdeemedthatPartyBhasperformeditspaymentobligationofdepositandthesalesprice.2、銀行貸款Mortgage（1）乙方應(yīng)在簽訂本協(xié)議當(dāng)日，預(yù)先支付總房款的%，作為保證雙方履行協(xié)議的定金；UponsigningofthisAgreement,PartyBshallpay______%oftheprice(sayRMB________)asthedeposit,whichwillbepartofthedownpayment.（2）乙方應(yīng)在簽訂本協(xié)議日內(nèi)，另行支付元整，連同先前支付的定金（定金折抵首付款），一并作為首付款（首付款金額按照貸款銀行的貸款條件不得低于房屋總價(jià)款的%）。Within____daysaftersigningofthisAgreement,PartyBshallmakeuptherestpartofthedownpayment(thedownpaymentshallbenolessthan%ofthepriceinaccordancewithmortgagebank’srequirement).上述（1）、（2）款項(xiàng)經(jīng)甲乙雙方協(xié)商一致，決定采用下列第種方式：Throughthenegotiation,PartyBagreestomaketheafore-saidpaymentin______wayasfollow:a) 所有支付給甲方，甲方開(kāi)具對(duì)應(yīng)的收款憑證；PaidinfullamounttoPartyAandPartyAshallissueaninvoice;b) 臨時(shí)存入二十一世紀(jì)不動(dòng)產(chǎn)北京區(qū)域分部在特定銀行開(kāi)立的監(jiān)管賬戶內(nèi)，由該銀行監(jiān)管該部分資金，待該房屋權(quán)屬過(guò)戶手續(xù)辦理完畢及物業(yè)交割后，連同剩余房款一并支付給甲方。此業(yè)務(wù)須由甲乙雙方與二十一世紀(jì)不動(dòng)產(chǎn)北京區(qū)域分部另行簽訂交易資金監(jiān)管委托協(xié)議；DepositedtemporarilyintotheescrowaccountofCentury21BeijingRegion.ThisdepositwillbereleasedonlywhenthetitletransferfromPartyAtoPartyBiscompletedandthepropertyhandoverhasbeenconcluded,andthedepositwillbereleasedtogetherwiththeremainingpaymenttoPartyA.Todothis,PartyAandPartyBneedtosignaseparateEscrowAgreementwithCentury21BeijingRegion.同步，甲、乙雙方在此鄭重確認(rèn)：前述由二十一世紀(jì)不動(dòng)產(chǎn)北京區(qū)域分部進(jìn)行的資金監(jiān)管款項(xiàng)，一經(jīng)進(jìn)入資金監(jiān)管賬戶即視同乙方已履行向甲方給付定金和首付房款的義務(wù)。PartyAandPartyBherebyagreethat,fortheafore-saidmethod(b),oncetheescrowfundisdepositedintheescrowaccountofCentury21BeijingRegion,itisdeemedthatPartyBhasperformeditspaymentobligationofdepositandthedownpayment.乙方采用銀行貸款的方式支付剩余房款，由二十一世紀(jì)不動(dòng)產(chǎn)北京區(qū)域分部提供統(tǒng)一的金融按揭服務(wù)，乙方須與二十一世紀(jì)不動(dòng)產(chǎn)北京區(qū)域分部另行簽訂貸款委托協(xié)議。IfPartyBmakestheremainingpaymentwithbankmortgage,PartyBshallsignaseparateEntrustedPaymentAuthorizationwithCentury21BeijingRegionforitsmortgageservices.1） 經(jīng)辦理貸款的銀行審批，乙方符合貸款條件的，貸款銀行根據(jù)乙方簽訂的《委托付款授權(quán)書(shū)》將款項(xiàng)一次性劃至甲方在同行開(kāi)設(shè)的專用結(jié)算帳戶。IfPartyBsatisfiesthecriteriaofgettingthemortgageloanthroughtheexaminationofthelendingbank,thelendingbankshallremittheloaninlumpsumtothespecialsettlementaccountopenedbyPartyAatthebankinaccordancewiththeEntrustedPaymentAuthorization.2） 經(jīng)辦理貸款的銀行審批，乙方因自身原因尚不符合貸款條件的，雙方經(jīng)協(xié)商，選擇方式處理：IncasePartyBdoesnotsatisfythecriteriaofgettingtheloanthroughtheexaminationofthelendingbank,PartyBwillchoose_______ofthefollowingmethodsasthesolution:A. 自銀行做出不予批貸的決定起日內(nèi)，乙方自行籌集剩余房款，按照現(xiàn)金支付的形式支付給甲方，乙方承擔(dān)在此期間發(fā)生的各項(xiàng)費(fèi)用；Within______daysafterthebankdecidesnottoprovidetheloan,PartyBshallraisetheremainingpaymentbyhimselfandpayincashtoPartyA.PartyBshallbearalltheexpensesoccurredduringthisperiod;B.終止本協(xié)議的履行，由甲乙雙方返還對(duì)應(yīng)款項(xiàng)，期間發(fā)生的各項(xiàng)費(fèi)用由乙方承擔(dān)。TerminatethisAgreement,andPartyAandPartyBshallrefundthemoneywhichhavebeenpaidtoeachother.PartyBshallbearalltheexpensesoccurredduringthisperiod.三、有關(guān)稅費(fèi)有關(guān)規(guī)定 Taxesandfees1、本協(xié)議履行期間內(nèi)，甲、乙雙方自行按國(guó)家及地方有關(guān)規(guī)定自行繳納各項(xiàng)稅、費(fèi)，丙方協(xié)助甲乙雙方進(jìn)行有關(guān)稅費(fèi)確實(shí)認(rèn)及計(jì)算工作。稅費(fèi)分擔(dān)經(jīng)甲乙雙方協(xié)商，決定按照如下方式進(jìn)行分擔(dān)：A. PartyAandPartyBshallpayallthetaxesandfeesrespectivelyinaccordancewithrelevantregulationsofthestateandlocalgovernments.PartyCshallassistPartyAandPartyBtocalculaterelevanttaxesandfees.Throughnegotiation,PartyAandPartyBagreetobearthetaxesandfeesasfollows:雙方對(duì)前述稅費(fèi)未約定、約定不明或遇政策調(diào)整的，雙方應(yīng)在權(quán)屬過(guò)戶之日前日內(nèi)協(xié)商并到達(dá)一致，否則，按國(guó)家有關(guān)法律規(guī)定繳納；Foranytaxesorfeesunspecified,unclear,orchangedwiththepolicy,PartyAandPartyBshallreachaconsensusdaysbeforethetitletransfer,orPartyAandPartyBshallmakethepaymentinaccordancewiththegovernmentregulation.在上述房屋交付前未支付的物業(yè)管理費(fèi)、水、電、燃?xì)?、通信費(fèi)等其他費(fèi)用，由甲方承擔(dān)，房屋交付之后發(fā)生的前述費(fèi)用，由乙方承擔(dān)；Feesincludingbutnotlimitedtopropertymanagementfee,utilityfeesforwater,electricity,gas,telephoneandothersbeforethehandoverofthepropertyisconcludedshallbebornbyPartyA.AndthefeesaftershallbebornbyPartyB.2、上述稅費(fèi)可在丙方向應(yīng)付費(fèi)方預(yù)收后裔為繳納，有關(guān)部門(mén)所開(kāi)具的完稅憑證、行政事業(yè)性收據(jù)、工本費(fèi)發(fā)票等單據(jù)，待代理事項(xiàng)完畢后，由丙方交付給付費(fèi)的一方。PartyAandPartyBmayentrustPartyCtopaytheaforesaidtaxesandfeesandPartyCshalltransferthepaymentproof,receiptsandinvoicesissuedbyrelevantgovernmenttothepartiesthatmakethepayment.第三條居間酬勞的金額及支付方式Commissionandtermsofpayment因甲乙雙方基于丙方的媒介服務(wù)而簽訂房屋買賣協(xié)議，丙方有權(quán)收取對(duì)應(yīng)的居間酬勞，因此甲乙雙方在簽訂房屋買賣協(xié)議步，約定選擇下列第種方式支付丙方的居間酬勞：PartyAandPartyBagreetopayPartyCthecommissionforprovidingtheagencyservicesinaccordancewithofthefollowingpaymentmethods:1、居間酬勞由一方支付，即方應(yīng)于本協(xié)議簽訂當(dāng)日按照房屋總價(jià)款的％，即人民幣元向丙方支付居間酬勞；Bornbyoneparty.Partyshallpay%ofthepropertyprice(sayRMB________)toPartyCuponsigningofthisAgreement;2、居間酬勞由甲乙雙方分?jǐn)?，即甲方按照房屋總價(jià)款的％，即人民幣元向于本協(xié)議簽訂當(dāng)日丙方支付居間酬勞，乙方按照房屋總價(jià)款的％，即人民幣元于本協(xié)議簽訂當(dāng)日向丙方支付居間酬勞。甲乙雙方的房屋買賣協(xié)議簽訂后，因甲方或/和乙方的原因致使協(xié)議未履行的，居間酬勞不予退還。Sharedbytwoparties.PartyAshallpay%ofthepropertyprice(sayRMB________),andPartyBshallpay%ofthepropertyprice(sayRMB________)toPartyCuponsigningoftheagreement.Theafore-saidcommissionshallnotberefundedbyPartyCtoanypartyifthisagreementfailtobeperformedduetodefaultofeitherPartyAorPartyBoncethisAgreementisenteredbythethreeparties.第四條權(quán)屬過(guò)戶代理Titletransferagencyservices甲乙雙方辦理權(quán)屬過(guò)戶的所有證件資料準(zhǔn)備齊全，由丙方為甲乙雙方提供有償?shù)倪^(guò)戶委托代理服務(wù)。丙方提供權(quán)屬過(guò)戶代理服務(wù)，權(quán)屬過(guò)戶的代理服務(wù)費(fèi)金額為人民幣元，由方于本協(xié)議簽訂當(dāng)日支付給丙方，（或甲方支付元，乙方支付元）；PartyAandPartyBshallpreparethecertificatesandmaterialsfortitletransferandPartyCshallprovidechargeabletitletransferservicesforPartyAandPartyBwithfees.TheservicefeefortitletransferagencyservicesisRMB______.ThefeeshallbepaidbyParty___toPartyCuponsigningofthisAgreement(or,PartyApayRMBandPartyBpayRMBtoPartyC).第五條房屋交付Handoveroftheproperty1、甲乙雙方同意，于辦理權(quán)屬過(guò)戶手續(xù)（□前/□后）日內(nèi)騰出該房屋，并由丙方協(xié)助甲乙雙方辦理該房產(chǎn)的物業(yè)交割手續(xù)。若甲乙雙方協(xié)商確定權(quán)屬過(guò)戶后辦理物業(yè)交割手續(xù)，則由甲方向丙方預(yù)留押金元，待物業(yè)交割完畢查對(duì)無(wú)誤后返還給甲方。.PartyAandPartyBagreethatPartyAshallvacatethepropertydaysbeforethetitletransfer.PartyCshallassistPartyAandPartyBwiththehandoveroftheproperty.IncasePartyAandPartyBagreetoconducthandoverofthepropertyafterthetitletransfer,PartyAshallpayPartyCadepositintheamountofRMB,andthisamountwillberefundedtoPartyBafterthehandoverofthepropertyiscompleted.2、甲方承諾，自本協(xié)議簽訂之日起至該房屋物業(yè)交割期間，凡已納入本協(xié)議（附件一）的各項(xiàng)房屋裝飾及附屬設(shè)施被損壞或被拆除的，甲方應(yīng)按被損壞或被拆除的房屋裝飾及附屬設(shè)施評(píng)估值，向乙方支付賠償金。PartyAshallpromisetocompensatePartyBforthedamagetoorthedismantlingofthedecorationsandaccessoriescoveredbyAppendixIoftheagreementfromthesigningoftheagreementtothehandoverofthepropertyinaccordancewiththeevaluationofthedamagedordismantleddecorationsandaccessories.3、甲方自行承擔(dān)該房產(chǎn)物業(yè)交割前所發(fā)生的，應(yīng)由甲方承擔(dān)的物業(yè)及有關(guān)費(fèi)用，物業(yè)交割手續(xù)辦理完畢后，上述費(fèi)用由乙方承擔(dān)。PartyAshallbearthepropertymanagementfeeandotherrelevantfeesbeforethehandoverofthepropertyandtheaforesaidfeesshallbepaidbyPartyBafterthehandoveroftheproperty.4、甲乙雙方同意在簽訂本協(xié)議后個(gè)工作日（以丙方告知為準(zhǔn)）,持本協(xié)議和有關(guān)證件共同到房地產(chǎn)交易管理部門(mén)辦理產(chǎn)權(quán)過(guò)戶手續(xù)。辦理產(chǎn)權(quán)過(guò)戶手續(xù)中所發(fā)生的有關(guān)稅費(fèi)、土地出讓金及手續(xù)費(fèi)按國(guó)家規(guī)定收費(fèi)原則由方支付。PartyAandPartyBagreetoconductthetitletransferdaysaftersigningofthisAgreementtakingtitlecertificateandrelevantmaterial.PartyCwillinformthespecificdate.Partyshallpaythetaxesandfeesfortitletransferinaccordancewiththegovernmentregulations.第六條甲方的權(quán)利和義務(wù)RightsandobligationsofPartyA（一）甲方的權(quán)利：RightsofPartyA1、甲方有查驗(yàn)乙方身份的權(quán)利；PartyAshallhavetherighttocheckPartyB’sidentification.2、甲方有按協(xié)議約定獲得定金、房款的權(quán)利；PartyAshallhavetherighttogetdepositandpropertysalespriceasstipulatedintheAgreement.3、甲方有追究乙方違約責(zé)任的權(quán)利。PartyAshallhavetherightoflawsuituponPartyB’sbreachtothisAgreement.（二）甲方的義務(wù)：DutiesofPartyA1、向乙方提供真實(shí)、完整和有效的房屋有關(guān)資料的義務(wù)；PartyAshallprovidePartyBwithtrue,completedandvalidinformationabouttheproperty;2、有向乙方告知房屋真實(shí)狀況包括但不限于出租、抵押、滲漏和其他瑕疵的義務(wù)；PartyAshalldisclosetoPartyBtherealfactsabouttheproperty,includingbutnotlimitedtotherental,colla
