ImporterSecurityFilingandAdditionalCarrierRequirementsDocketNumber:USCBP-2007-0077CBPhasconcludedthattheproposedregulationswiththemodificationsdiscussedintheRuleshouldbeadoptedasfollows:Therequirementsinsection149.2(b)regardingthetimingoftransmissionfor2ofthe10ImporterSecurityFilingelementsandsection149.2(f)regardingtheflexiblerequirementsfor4ofthe10elementsareadoptedasaninterimfinalrule.Allotherrequirementsinthisruleareadoptedasafinalrule.

CBPisnotinvitingcommentsontheserequirements.Flexibilitiesfor6ElementsCBPhasaddedflexibilityforfourImporterSecurityFilingelementsastotheinterpretationofthedata:Manufacturer(Supplier)name/address,ShiptoParty,CountryofOriginandCommodityHTSUSnumberTheseelementsarestillrequired24hourspriortovessellading.Importers,intheirinitialfiling,willbepermittedtoprovidearangeofacceptableresponsesbasedonfactsavailableatthetime,inlieuofasinglespecificresponse.

Importerswillberequiredtoupdatetheirfilingsassoonasmorepreciseormoreaccurateinformationisavailable.Inaddition,CBPhasaddedflexibilityfortwoImporterSecurityFilingelementsintermsoftimingoftheprovisionofthedata:ContainerStuffingLocationandConsolidator(Stuffer)name/address.ISFImportermustfilethisdataassoonaspossible,butnolaterthan24hourspriortoU.S.arrival.StructuredReviewPeriodDuringthefirstyear,CBPwillmonitorallISFsubmissionsfortimeliness,accuracyandcompletenessandwillworkwithanynon-complyingISFfilerinordertohelpthemadheretothenewrequirements.CBPwillconsideranentity’sprogressintheimplementationoftheruleduringthedelayedenforcementperiodasamitigatingfactorinanyenforcementactionfollowingthedelayedenforcementperiod.Onthebasisofinformationobtainedduringthestructuredreviewandpubliccomments,DHSwillundertakeananalysisoftheelementssubjecttoflexibilities.DHS,incoordinationwithotherpartsoftheExecutiveBranch,willdeterminewhethertoeliminate,modify,orleaveunchangedtheserequirements.Thisonlyappliestotheflexiblerequirements.
