7、se con tract.Terms: The lease term will start from 2008 year 5on th 1 date to 2009 yearA mon th 13 date, totali ng 1_2_ mon th.If Party A would like to con ti nue the term of leas ing, prior one mon th is required to no tify Party B to sig n the lease exte nsion agreeme nt and 10 days in adva nee is

8、 requested to complete the payme nt of ren tal for the exte nded con tract.Rental: Party A shall pay the rental as 3100 RMB / Month.Dow n Payme nt: The rental of payme nt will be settled at a two months basis. Upon sig ning the lease con tract, Party A needs to pay the guara ntee deposit of 6200 RMB

11、he below guida nee:Party A provides the copy version of the available Peony Debit Cards issued by the In dustrial and Commercial Bank of China ,Beijing Branch ; the copy of citizen identity card and signed with Party B.If Party A (who pays successive in stallme nt more tha n twice with the amount ex

12、ceedi ng two -month ren tal per payme nt) authorizes Party B to issue Peony Debit Card in In dustrial and Commercial Bank of China ,Beiji ng Bran ch, Party A n eeds to provide citize n ide ntity card copy and sig n with Party B. Upon the completi on of process ing Peony Debit Card, Party B will send

13、 the card to Party A in the way of Registered Letter. Party B shall not take responsibility for the failed process ing of ren tal withholdi ng service caused by the in accurate address.Party A should deposit the sufficie nt ren tal in the desig nated acco unt accord ing to successive in stallme nt t

14、erms.The Commercial and In dustrial Bank of China will start to con duct withholdi ng process ing with in the week of defi ned successive in stallme nt date or the week followed.The registered name of Debit Card should be in accordance with the name in If there is not sufficie nt amount of money wit

15、hi n the desig nated Debit Card, the Commercial and In dustrial Bank of China shall suspe nd the withhold ing process. If Party A fails to deposit sufficie nt amount of money for ren tal, Party B shall have the right to charge the overdue fine and take back the premises after 15 days of the overdue.

16、Optio n 2.Pay cash in the desig nated Wo Ai Wo Jia Real Estate bus in ess outlets. Party A should keep the proofs of ren tal payme nt and other expe nsesImporta nt Notice:Regardless of the method applied to pay, Party A should reta in the payme nt proofs.Guara ntying the legitimate rights and in ter

17、ests of both sides, any suppleme ntary content to the con tract should be issued in written notice with the stamp from Party B to take affect. The oral agreement or the agreeme nt without stamp betwee n Party A and Party B shall not be accepted and approved.Commissi on: Party A should pay 1500 RMB t

18、o Party B as the in termediary services fee. Maintenance Fee: Party A shall pay / RMB to pay the maintenance fee during the term of rental.Other expe nses: 1. Party A shall pay the Cable TV service fee totali ng 216 RMB. Up on the term of ren tal exte nsion, the extension fee for Cable TV should be

19、paid together with rental.2. If Party A authorizes Party B to issue the receipts, Party A should pay comprehe nsive realestate tax. The tax is /RMB. (Current comprehensive real estate tax equal to 5 % of thetotal ren tal.)Responsibilities of Obligation of Party A1. Party A should present temporary c

20、itizen card, temporary residence card and employment proof etc. If Party A is not native Beijing citizen, Party A should register in a local police station within three days commencing effectiveness date of the house lease contract. Party A should guarantee the provided documents are faithful to the

21、 truth. Party B is allowed to examine and retain the copies of all the documents provided by Party A. If the documents provided by Party A disobedient to the truth, Party B has the right to take back the premises and terminate the house lease contract. Party A shall take responsibilities to the fina

22、ncial lost caused by the house lease termination. The copies of documents provided by Party A are applied solely for this lease agreement.2. Prior to acknowledging the content of this house lease contract, Party A should check and identify the status of furniture, fixtures and fittings within the ho

23、use and agree to use the premises for residential purpose.3. Party A should guarantee that the house is used for Party A s residence. Without the written approval fro B, Party B shall not transfer or sublet the lease of premises.4. Within the term of this agreement, Party A should obey statutory law

24、s, decrees and pertinent rules and regulations.5. During the term of this agreement, Party A shall take good care of and be responsible for maintaining the house in good conditions.6. Party A should pay the sufficient rental to Party B strictly in line with the agreed payment clauses. Under no circu

25、mstances that should Party A apply the deposit to offset the rental.7. During the term of this agreement, Party A shall bear all expenses of utilities including tap water / electricity /gas fee, teleph one fee internet fee , Cable TV fee , environment maintenance fee, security fee , public -use elec

26、tricity fee and pay all the due rental and expenses upon the termination of the house lease . Party A should retain all the payment proofs and present the proofs to Party B to settle accounts. Party B will be responsible for heat fee.8. Within the term of this agreement, Party B shall be entitled to

27、 claim compensation from the deposit for any loss caused by Party As faults or behaviors of selling ,damaging and losing the in-house equipments without authorization from Party B. If the deposit is not sufficient for the loss, Party B shall reserve the right to pursue. Meanwhile, Party A should fil

28、l the deposit within five days upon receiving the notice from Party B.9. Any damage or loss within the house is incurred due to the impropriate use of the house or as a result of manmade reasons, Party A will bear the cost of repairing and inconvenience caused by the repairing requirement.10. The da

29、mage parts incurred due to the improper use of the house shall be renewed or repaired by Party A. If anyassistance to maintenance issues required from Party B, Party B shall take action within 5 days upon receiving the repairing request from Party A. Party A should pay the related expenses to Party

30、B. Any natural damage found in the house will be subjected to Party Bs obligation, Party A shall then notify Party B of such damageand actively coordinate with Party B in examining and repairing the damaged parts. If maintenance affects the normal use of the house due to uncooperative manners from P

31、arty A on the matters, Party B will not be responsible for the inconvenience. In case any loss of assets occurred on the third party, Party A shall be liablefor compensations.11. During the term of this agreement, Party A shall not erect, install or remove any fixtures or make any structural additio

32、ns or alternation without the prior written consent from Party B.12. Upon the termination of the contract, Party A should handover the house to Party B in accordance with In-house Handover List) and clears the premises in time. Any remained belongings will be deemed to be abandoned by Party A. Party

33、 B will have the right to deal with.13. When one month prior the contract expires, Party A should notify Party if it intends to extend the house lease contract and discusses the extension matters with Party B.14. If Party A intends to extend the house lease contract, Party A should sign the renewed

34、lease contract with PartyB in 10 days prior to the original contract expiry date. Otherwise, Party A will be regarded as intending toterminate the contract.15. Upon the completion of the house lease , Party A should clear the premises and keep the house tidy and in good conditions.16. Party A will n

35、eed to notify Party B about adding additional facilities to the house and get the written approval from Party B to proceed. Party A is liable for the cost. When adding additional in-house equipment, Party A should not change or damage the structure of the house and original facilities.17. Without th

36、e written consent from Party B, Party A should not raise any pets or animals.Responsibilities and Obligations of Party B18. Party B should guarantee that Party B is authorized by landlord of the house to exercise the right of rent agents. During the term of this agreement, if Party A would like to r

37、efer the personal documents of landlord, Party A should notify Party B in advance and check the documents with the permission from landlord.19. Within the term of this agreement, Party B should guarantee the house could be used safely and properly.20. During the term of this agreement, Party B is li

38、able for repairing the damage of in-house equipment caused by natural reasons or aging of equipments.21. Upon the termination of contract, after Party A clears the premises and settle the bills with relevant payment proofs provided, Party B should be liable for returning the deposit to Party A. Give

39、n that the internet fee is scheduled to pay in the following month, Party B should not delay returning the depositlonger than 32 dayscommencing the expiry date of the contract.22. After Party B takes back the house in accordance with the defined clauses, any remained belongings of Party A shall be d

40、eemed to be abandoned and Party B will be entitled to deal with accordingly.House Handover23. Party B should organize and carry out house inspection according to . Inspection and examination to in - house equipment should be participated by both parties. Party A should question the status of the equ

41、ipment on the spot. For any problems difficult to judge on the spot, Party A should notify the problems of the facilities within 3 days afterward.24. Upon the termination of this house lease contract, Party A should conduct handover with Party B in accordance to .Liability for Breach of Contract25.

42、If Party A fails to pay the rental before the agreed time or clear the premises and return the house to Party B on expiry date, Party A shall pay penalty to Party B by 1% of the rental of current month for each day in excess of the paying time as agreed and also the rental for that month. If such ov

43、erdue rental remains 15 days unpaid, Party B shall have the right to take back the house and terminate the contract. Any related loss of Party B will be subjected to Party A.26. Party B shall be allowed to take back the house and terminate the contract and Party A will have to pay penalty to Party B

44、 equivalent to two months rental if below listed actions seriously disobedient to the agreement happen:a) Without the recognition from Party B, Party A terminates the contract.b) Without written approval from Party B, Party A changes the purpose of using the house.c) Party A sublets or transfers the

45、 lease of contract. (Includes the situation of paying rental in the name of Party A, but in reality to have somebody else live in the house)d) Without the permission from Party B, Party A converts the house into a public dormitory or have more than defined people reside in the house. (One bedroom ho

46、use: 1- 3 pax; two bed room house: 1-5 pax; three bedroom house:1-8 pax)e) Party A uses the house for the purpose of carrying out activities with threat to the safety of the public ordistract ing the n eighborhood com mun ity.f) Party A damages the internal structure of the house or its attached equ

47、ipment and doesn repair the damaged parts as per the agreed date.g) Delay pay ing the ren tal for 15 daysh) Delay pay ing other defi ned expe nses of the house, which causes the loss of Party B or Lan dlord.i) Submit the false pers onal docume nts to Party Bj) Store any hazardous materials, toxic go

48、ods or other prohibited goods by laws or statutory regulati ons.27. After the term in ati on of the con tract, Party A shall be liable for the loss of PartyB caused by Party A s actiondisobedie nt to the agreed Clauses. 12 and the sec ond provisi on of Clause.16.28. Party A shall be allowed to term

49、in ate the con tract and Party B will have to pay pen alty to Party A equivale nt to twomon ths ren tal if below listed acti ons seriously disobedie nt to the agreeme nt happe n:a) Party B fails to han dover the house to Party A for 7 days comme ncing the effective day of the con tract.b) Party B takes back the hous
