10、Article 4The quality of project一. 本工程質(zhì)量經(jīng)雙方研究要求達到雙方約定之驗收標準。The quality of project should achieve therequirements of acceptance agreed by both parties.二. 乙方必須嚴格按照施工圖紙、說明文件和國家頒發(fā)的建 筑工程規(guī)范、規(guī)程和標準進行施工并接受甲方的監(jiān)督。Party B should carry on the construetion in strict accordanee with drawing, specification file and

11、regulations and specifications outhorized by the petent authorities and be under the supervision of Party A.三. 乙方在施工過程中必須遵守下列規(guī)定：Party B should, during the constnaction, ply with the provisions as follows：1. 由乙方提供給甲方的所有材料必須經(jīng)甲方同意方可使用未 按要求購買嚴禁使用；All materials provided by Party B should be subject to th

15、 Construction and Design一. 乙方交付的設計圖紙、說明和有關(guān)技術(shù)資料作為施工的 有效依據(jù)開工前由甲方組織簽字認同作為施工的補充依據(jù)甲、乙 雙方均不得擅自修改。Design drawing, illustration and relevant technical data consigned by party B are the basis for construetion and shall be confirmed by party As signature, which is deemed as the supplementary basis and shall b

16、e modified by any party without authorization.二. 施工中如發(fā)現(xiàn)因甲方要求而發(fā)生的設計錯誤或嚴重不合 理的地方乙方應及時以書面形式通知甲方由甲方及時會同乙方等 有關(guān)單位研究確定修改意見或變更設計文件乙方按修改或變更的 設計文件進行施工。若發(fā)生增加費用（包括返工損失、停工、窩 工、人員和機構(gòu)設備調(diào)遷、材料構(gòu)配件積壓的實際損失）由甲方負責并調(diào)整 合同（協(xié)議）造價。If and when any error or material unreasonable problem of design due to party A令s requirement, P

18、ease （ineluding the actual loss of rework loss, stoppage or slowdown, persormel and machine equipment relocated, material struetures, fi_tures backlog), shall be responsib訂ity by Party A, and be adjusted the contract price together with Party B.三. 乙方在保證工程質(zhì)量和不降低設計標準的前提下提出修 改設計、修改工藝的合理化建議經(jīng)甲方、設計單位或有關(guān)技術(shù)

19、部 門同意后采取實滋。Any reasonable suggestion on the modifications of design and craft proposed by Party B, subject to the quality and without reducing standards of design, could be carried out upon the approval of Party A, design unit or concerned technical department.四. 甲方如需設計變更必須作出正式修改通知書和修改圖紙 乙方才予實施。重大修改

20、和增加造價時必須另行協(xié)商乙方才予實 施。Party A should, if any necessary design change, make the formal amendment and modify drawings for Party Bs implementation. Material changes and cost increased must be negotiated by both parties before Party B implement the same第七條工程驗收Article 7Acceptance of project一. 工程施工中地下工程、結(jié)構(gòu)工

21、程必須具有隱蔽驗收簽 證、試水、抗?jié)B等驗收合格記錄。甲方須及時辦理驗收簽訂手 續(xù)。The underground engineering, structural engineering in the construetion of project should be checked and with issue of certificate and the record of acceptance of water test, anti-permeability and so on. Party A should deal with the acceptance signed formalit

22、ies timely.二. 工程竣工驗收后甲方才可使用Party A can use the project after pietion acceptsnee在規(guī)定的保修期內(nèi)凡因施工造成的質(zhì)量缺陷應由乙方無償保 修。其保修條件、范圍和期限按城鄉(xiāng)建設環(huán)境保護部(84)城建 字第79號通知印發(fā)的建筑工程保修辦法(試行)執(zhí)行。In the provision warranty period, any construetion quality defects, Party B should make meiintenanee free of the quality defect due to cons

24、lity of Party B：一. 工程質(zhì)量不符合合同（協(xié)議）規(guī)定的負責無償修理和返 XoTake charge of gratis repair and rework if project quality doesnut meet contactus stipulation二. 工程不能按合同（協(xié)議）規(guī)定的工期交付使用的按合同 （協(xié)議）中關(guān)于建設工期提交或拖后的獎罰規(guī)定償付逾期罰款。If fail to deliver the construetion according to the contract on time, The overdue fines according to pun
