進(jìn)出境動(dòng)植物檢疫法（中英文）歡迎來到CN人才網(wǎng)，下面是小編精心為大家整理收集的進(jìn)出境動(dòng)植物檢疫法(中英文)，希望對(duì)大家有幫助。進(jìn)出境動(dòng)植物檢疫法(中英文)中華人民共和國進(jìn)出境動(dòng)植物檢疫法Lawofpeople'sRepublicofChinaontheEntryandExitAnimalandPlantQuarantine第一章總則CHAPTERIGENERALPROVISIONS第一條為防止動(dòng)物傳染病、寄生蟲病和植物危險(xiǎn)性病、蟲、雜草以及其他有害生物(以下簡(jiǎn)稱病蟲害)傳入、傳出國境，保護(hù)農(nóng)、林、牧，漁業(yè)生產(chǎn)和人體健康，促進(jìn)對(duì)外經(jīng)濟(jì)貿(mào)易的發(fā)展，制定本法。Article1ThisLawisformulatedforthepurposeofpreventinginfectiousorparasiticdiseasesofanimals,diseases,insectpestsandweedsdangeroustoplants,andotherharmfulorganisms(hereinafterreferredto,forshort,asdiseases,insectpestsandharmfulorganisms)fromspreadingintooroutofthecountry,protectingtheproductionofagriculture,forestry,animalhusbandryandfisheryaswellashumanhealth,andpromotingthedevelopmentofforeigneconomicrelationsandtrade.第二條進(jìn)出境的動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，裝載動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物的裝載容器、包裝物，以及來自動(dòng)植物疫區(qū)的運(yùn)輸工具，依照本法實(shí)施檢疫。Article2Animalsandplants,theirproductsandotherquarantineobjects,containersandpackagingmaterialsusedforcarryinganimalsandplants,theirproductsorotherquarantineobjects,aswellasmeansoftransportfromanimalorplantepidemicareasshall,onentryorexit,besubjecttoquarantineinspectioninaccordancewiththisLaw.第三條國務(wù)院設(shè)立動(dòng)植物檢疫機(jī)關(guān)(以下簡(jiǎn)稱國家動(dòng)植物檢疫機(jī)關(guān))，統(tǒng)一管理全國進(jìn)出境動(dòng)植物檢疫工作。Article3AnanimalandplantquarantinedepartmentshallbeinstitutedundertheStateCouncil(hereinafterreferredto,forshort,astheStateanimalandplantquarantinedepartment),whichshallconductaunifiedadministrationoftheentryandexitanimalandplantquarantineinthewholecountry.國家動(dòng)植物檢疫機(jī)關(guān)在對(duì)外開放的口岸和進(jìn)出境動(dòng)植物檢疫業(yè)務(wù)集中的地點(diǎn)設(shè)立的口岸動(dòng)植物檢疫機(jī)關(guān)，依照本法規(guī)定實(shí)施進(jìn)出境動(dòng)植物檢疫。PortanimalandplantquarantineofficessetupbytheStateanimalandplantquarantinedepartmentatportsopentotheoutsideworldandatplacesbusywithentryandexitanimalandplantquarantineshall,inaccordancewiththisLaw,carryoutentryandexitanimalandplantquarantine.貿(mào)易性動(dòng)物產(chǎn)品出境的檢疫機(jī)關(guān)，由國務(wù)院根據(jù)實(shí)際情況規(guī)定。ThedepartmentinchargeofthequarantineofanimalproductsleavingthecountryfortradepurposesshallbedesignatedbytheStateCouncilasitdeemsappropriate.國務(wù)院農(nóng)業(yè)行政主管部門主管全國進(jìn)出境動(dòng)植物檢疫工作。ThedepartmentofagricultureadministrationundertheStateCouncilshallbeinchargeoftheentryandexitanimalandplantquarantineinthewholecountry.第四條口岸動(dòng)植物檢疫機(jī)關(guān)在實(shí)施檢疫時(shí)可以行使下列職權(quán)：Article4Aportanimalandplantquarantineofficemayexercisethefollowingfunctionsandpowerswhenperformingquarantineinspection:(一)依照本法規(guī)定登船、登車、登機(jī)實(shí)施檢疫;(1)Embarkingonaship,avehicleoranairplanetoperformquarantineunderthisLaw;(二)進(jìn)入港口、機(jī)場(chǎng)、車站、郵局以及檢疫物的存放、加工、養(yǎng)殖、種植場(chǎng)所實(shí)施檢疫，并依照規(guī)定采樣;(2)Enteringaseaport,anairport,arailwayorcoachstation,apostofficeorasitewherequarantineobjectsarestored,processed,bredorcultivated,toperformquarantineinspectionandcollectsamplesaccordingtorelevantregulations;(三)根據(jù)檢疫需要，進(jìn)入有關(guān)生產(chǎn)、倉庫等場(chǎng)所，進(jìn)行疫情監(jiān)測(cè)、調(diào)查和檢疫監(jiān)督管理;(3)Enteringasiterelatingtoproductionorstorageaccordingtotheneedsofquarantine,tocarryoutepidemicmonitoringandinvestigationsorquarantinesupervisionandcontrol;(四)查閱、復(fù)制、摘錄與檢疫物有關(guān)的運(yùn)行日志、貨運(yùn)單、、發(fā)票以及其他單證。(4)Consulting,makingcopiesoforexcerptsfromoperationaldiaries,billsoflading,contracts,invoicesorotherdocumentsrelatingtothequarantineobjects.第五條國家禁止下列各物進(jìn)境：Article5TheStateshallprohibitthefollowingobjectsfromenteringthecountry:(一)動(dòng)植物病原體(包括菌種、毒種等)、害蟲及其他有害生物;(1)Pathogenicmicro-organisms(includingseedculturesofbacteriaandviruses)ofanimalsandplants,insectpestsandotherharmfulorganisms;(二)動(dòng)植物疫情流行的國家和地區(qū)的有關(guān)動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物;(2)Relevantanimalsandplants,theirproductsandotherquarantineobjectsfromcountriesorregionswithprevalentepidemicanimalorplantdiseases;(三)動(dòng)物尸體;(3)Animalcarcasses;and(四)土壤。(4)Soil.口岸動(dòng)植物檢疫機(jī)關(guān)發(fā)現(xiàn)有前款規(guī)定的禁止進(jìn)境物的，作退回或者銷毀處理。Whenaportanimalandplantquarantineofficediscoversanyobjectsprohibitedfromenteringthecountryasprescribedintheprecedingparagraph,suchobjectsshallbereturnedordestroyed.因科學(xué)研究等特殊需要引進(jìn)本條第一款規(guī)定的禁止進(jìn)境物的，必須事先提出申請(qǐng)，經(jīng)國家動(dòng)植物檢疫機(jī)關(guān)批準(zhǔn)。Whoever,becauseofspecialneedssuchasscientificresearch,importsanyobjectsprohibitedfromenteringthecountryasprescribedinthefirstparagraphofthisArticle,mustsubmitanapplicationinadvance,whichshallbesubjecttotheapprovalbytheStateanimalandplantquarantinedepartment.本條第一款第二項(xiàng)規(guī)定的禁止進(jìn)境物的名錄，由國務(wù)院農(nóng)業(yè)行政主管部門制定并公布。Thecataloguesofobjectsprohibitedfromenteringthecountryasprescribedin(2)ofthefirstparagraphofthisArticleshallbeworkedoutandannouncedbythedepartmentofagricultureadministrationundertheStateCouncil.第六條國外發(fā)生重大動(dòng)植物疫情并可能傳入中國時(shí)，國務(wù)院應(yīng)當(dāng)采取緊急預(yù)防措施，必要時(shí)可以下令禁止來自動(dòng)植物疫區(qū)的運(yùn)輸工具進(jìn)境或者封鎖有關(guān)口岸;Article6Intheeventthataseriousanimalorplantepidemicoccursabroadandisliabletospreadintothecountry,theStateCouncilshalladoptemergentpreventivemeasuresandmay,whennecessary,issueorderstoprohibitmeansoftransportfromanimalorplantepidemicareasfromenteringthecountryortoblockadetherelevantports;受動(dòng)植物疫情威脅地區(qū)的地方人民政府和有關(guān)口岸動(dòng)植物檢疫機(jī)關(guān)，應(yīng)當(dāng)立即采取緊急措施，同時(shí)向上級(jí)人民政府和國家動(dòng)植物檢疫機(jī)關(guān)。thelocalpeoples'governmentsinareasthreatenedbytheanimalorplantepidemicaswellastheportanimalandplantquarantineofficesconcernedshallimmediatelytakeemergencymeasures,and,atthesametime,reporttothePeople'sgovernmentsathigherlevelsandtheStateanimalandplantquarantinedepartment.郵電、運(yùn)輸部門對(duì)重大動(dòng)植物疫情報(bào)告和送檢材料應(yīng)當(dāng)優(yōu)先傳送。Thedepartmentsofpostsandtelecommunicationsanddepartmentsoftransportationshallgiveprioritytotransmittingortransportingreportsconcerningseriousanimalorplantepidemicormaterialstobesentforquarantineinspection.第七條國家動(dòng)植物檢疫機(jī)關(guān)和口岸動(dòng)植物檢疫機(jī)關(guān)對(duì)進(jìn)出境動(dòng)植物、動(dòng)植物產(chǎn)品的生產(chǎn)、加工、存放過程，實(shí)行檢疫監(jiān)督。Article7TheStateanimalandplantquarantinedepartmentandportanimalandplantquarantineofficesshallpractiseaquarantinesupervisionsysteminrelationtotheproceduresintheproduction,processingandstorageofanimalsandplantsandtheirproductsforentryorexit.第八條口岸動(dòng)植物檢疫機(jī)關(guān)在港口、機(jī)場(chǎng)、車站、郵局執(zhí)行檢疫任務(wù)時(shí)，海關(guān)、交通、民航、鐵路、郵電等有關(guān)部門應(yīng)當(dāng)配合。Article8Whenaportanimalandplantquarantineofficeiscarryingoutitstasksofquarantineinspectioninseaports,airports,railwayorcoachstations,orpostoffices,relevantdepartmentssuchastheCustoms,departmentsofcommunications,civilaviation,orrailways,andpostalservicesshallcoordinatetherewith.第九條動(dòng)植物檢疫機(jī)關(guān)檢疫人員必須忠于職守，秉公執(zhí)法。Article9Anyquarantinefunctionaryofananimalandplantquarantineorganmustbedevotedtohisorherdutiesandenforcethelawimpartially.動(dòng)植物檢疫機(jī)關(guān)檢疫人員依法執(zhí)行公務(wù)，任何單位和個(gè)人不得阻撓。Nounitorindividualmayobstructaquarantinefunctionaryofananimalandplantquarantineorganfromcarryingouthisorherdutiesaccordingtolaw.第二章進(jìn)境檢疫CHAPTERIIENTRYQUARANTINE第十條輸入動(dòng)物、動(dòng)物產(chǎn)品、植物種子、種苗等其他繁殖材料的，必須事先提出申請(qǐng)，辦理檢疫審批手續(xù)。Article10Whoeverimportsanimals,animalproducts,plantseeds,seedlingsorotherpropagatingmaterialsmustsubmitanapplicationinadvanceandgothroughtheformalitiesforexaminationandapprovalofquarantineinspection.第十一條通過貿(mào)易、科技合作、交換、贈(zèng)送、援助等方式輸入動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物的，應(yīng)當(dāng)在合同或者協(xié)議中訂明中國法定的檢疫要求，并訂明必須附有輸出國家或者地區(qū)政府動(dòng)植物檢疫機(jī)關(guān)出具的檢疫證書。Article11Whoeverimportsanimalsandplants,theirproductsorotherquarantineobjectsthroughtrade,scientificandtechnologicalcooperation,exchanges,donationsoraidshallspecifyinthecontractsoragreementstherequirementsforquarantineinspectionprescribedbyChina'slawandthenecessityofquarantinecertificatesissuedbytheanimalandplantquarantinedepartmentunderthegovernmentoftheexportingcountryorregionbeingappendedtherewith.第十二條貨主或者其代理人應(yīng)當(dāng)在動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物進(jìn)境前或者進(jìn)境時(shí)持輸出國家或者地區(qū)的檢疫證書、貿(mào)易合同等單證，向進(jìn)境口岸動(dòng)植物檢疫機(jī)關(guān)報(bào)檢。Article12Theownerorhisorheragentshallapplytotheportanimalandplantquarantineofficeattheportofentryforquarantineinspectionoftheanimalsandplants,theirproductsorotherquarantineobjects,beforeorontheirentry,onthestrengthofdocumentssuchasthequarantinecertificatesissuedbytheexportingcountryorregionandthetradecontracts.第十三條裝載動(dòng)物的運(yùn)輸工具抵達(dá)口岸時(shí)，口岸動(dòng)植物檢疫機(jī)關(guān)應(yīng)當(dāng)采取現(xiàn)場(chǎng)預(yù)防措施，對(duì)上下運(yùn)輸工具或者接近動(dòng)物的人員、裝載動(dòng)物的運(yùn)輸工具和被污染的場(chǎng)地作防疫消毒處理。Article13Onarrivalataportofameansoftransportforcarryinganimals,theportanimalandplantquarantineofficeshallforthepreventionofepidemicsadopton-the-spotpreventivemeasuresandconductdisinfectionofpersonsembarkingonordisembarkingfromthemeansoftransportorhavingcontractswiththeanimals,themeansoftransportforcarryingtheanimalsandthecontaminatedfields.第十四條輸入動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，應(yīng)當(dāng)在進(jìn)境口岸實(shí)施檢疫。Article14Importanimalsandplants,theirproductsandotherquarantineobjectsshallbequarantinedattheportofentry;未經(jīng)口岸動(dòng)植物檢疫機(jī)關(guān)同意，不得卸離運(yùn)輸工具。withoutconsentoftheportanimalandplantquarantineoffice,thesameshallnotbeunloadedfromthemeansoftransport.輸入動(dòng)植物，需隔離檢疫的，在口岸動(dòng)植物檢疫機(jī)關(guān)指定的隔離場(chǎng)所檢疫。Theimportanimalsandplantsthatneedtobeplacedinisolationforquarantineinspectionshallbequarantinedinanisolationcourtdesignatedbytheportanimalandplantquarantineoffice.因口岸條件限制等原因，可以由國家動(dòng)植物檢疫機(jī)關(guān)將動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物運(yùn)往指定地點(diǎn)檢疫。Byreasonoflimitedconditionsattheportofentry,theStateanimalandplantquarantinedepartmentmaydecidetohavetheanimalsandplants,theirproductsorotherquarantineobjectstransportedtoadesignatedplaceforquarantineinspection.在運(yùn)輸、裝卸過程中，貨主或者其代理人應(yīng)當(dāng)采取防疫措施。Inthecourseoftransportation,loadingandunloading,theownerorhisorheragentshalltakepreventivemeasuresagainstepidemics.指定的存放、加工和隔離飼養(yǎng)或者隔離種植的場(chǎng)所，應(yīng)當(dāng)符合動(dòng)植物檢疫和防疫的規(guī)定。Designatedplacesforstorage,processing,isolatedfeedingorplantingshallconformtotheprovisionsonanimalandplantquarantineandepidemicprevention.第十五條輸入動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，經(jīng)檢疫合格的，準(zhǔn)予進(jìn)境;Article15Theimportanimalsandplants,theirproductsorotherquarantineobjectsthatpassthequarantineinspectionareallowedtoenterthecountry;海關(guān)憑口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)的檢疫單證或者在報(bào)單上加蓋的印章驗(yàn)放。theCustomsshall,afterverification,releasethesameonthestrengthofthequarantinecertificatesissued,orthestampsonthecustomsdeclarationformsaffixed,bytheportanimalandplantquarantineoffice.輸入動(dòng)植物、動(dòng)植物產(chǎn)品和其他檢疫物，需調(diào)離海關(guān)監(jiān)管區(qū)檢疫的，海關(guān)憑口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)的《檢疫調(diào)離單》驗(yàn)放。Inrespectoftheimportanimalsandplants,theirproductsorotherquarantineobjectsthatneedtobetransferredawayfromacustomssurveillancezoneforquarantineinspection,theCustomsshall,afterverification,releasethesameonthestrengthoftheQuarantineTransferenceNoticeissuedbytheportanimalandplantquarantineoffice.第十六條輸入動(dòng)物，經(jīng)檢疫不合格的，由口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)《檢疫處理通知單》，通知貨主或者其代理人作如下處理：Article16Inrespectoftheimportanimalsthatfailinthequarantineinspection,theportanimalandplantquarantineofficeshallissuetheQuarantineTreatmentNoticenotifyingtheownerorhisorheragenttodealwiththesaidanimalsineitherofthefollowingmanners:(一)檢出一類傳染病、寄生蟲病的動(dòng)物，連同其同群動(dòng)物全群退回或者全群撲殺并銷毀尸體;(1)TheanimalsthatarefoundsufferingfromClassAinfectiousorparasiticdiseases,shall,togetherwithalltheotherin-contactanimals,bereturnedorslaughteredwiththeircarcassesdestroyed;or(二)檢出二類傳染病、寄生蟲病的動(dòng)物，退回或者撲殺，同群其他動(dòng)物在隔離場(chǎng)或者其他指定地點(diǎn)隔離觀察。(2)TheanimalsthatarefoundsufferingfromClassBinfectiousorparasiticdiseasesshallbereturnedorslaughtered;andtheotherin-contactanimalsshallbeplacedinanisolationcamporanyotherdesignatedplaceforobservation.輸入動(dòng)物產(chǎn)品和其他檢疫物經(jīng)檢疫不合格的，由口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)《檢疫處理通知單》，通知貨主或者其代理人作除害、退回或者銷毀處理。經(jīng)除害處理合格的，準(zhǔn)予進(jìn)境。Inrespectofimportanimalproductsorotherquarantineobjectsthatfailinthequarantineinspection,theportanimalandplantquarantineofficeshallissuetheQuarantineTreatmentNoticenotifyingtheownerorhisorheragenttoconductsuchtreatmentsasdisinfectionanddisinfestation,returningordestruction.Theproductsorobjectsthatpassthequarantineinspectionafteratreatmentofdisinfectionanddisinfestationareallowedtoenterthecountry.第十七條輸入植物、植物產(chǎn)品和其他檢疫物，經(jīng)檢疫發(fā)現(xiàn)有植物危險(xiǎn)性病、蟲、雜草的，由口岸動(dòng)植物檢疫機(jī)關(guān)簽發(fā)《檢疫處理通知單》，通知貨主或者其代理人作除害、退回或者銷毀處理。Article17Ondiscoveringthroughquarantineinspectionthatimportplants,plantproductsorotherquarantineobjectsarecontaminatedwithdiseases,pestsorweedsdangeroustoplants,theportanimalandplantquarantineofficeshallissuetheQuarantineTreatmentNoticenotifyingtheownerorhisorheragenttoconductsuchtreatmentsasdisinfectionanddisinfestation,returningordestruction.經(jīng)除害處理合格的，準(zhǔn)予進(jìn)境。Thosethatpassthequarantineinspectionafteratreatmentofdisinfectionanddisinfestation
