ngoodcondition.5.全體船員職責(zé)Dutiesofthecrewonboard.(1).嚴(yán)格遵守《垃圾管理計(jì)劃》的要求；observetheplanstrictly;(2).認(rèn)真參加《垃圾管理計(jì)劃》的培訓(xùn)和演習(xí)；takepartinthetraininganddrilling(3).船舶發(fā)生垃圾污染事故時，按大副指令參加應(yīng)急處理工作。Takeemergencyactionswhengarbagepollutionhappens.第二章法定要求Chapter=2\*ROMANIIREGULATORYREQUIREMENTASMARPOL73/78附則=5\*ROMANV第10條Regulation10ofAnnex=5\*ROMANVofMARPOL73/78readsasfollows:第10條Regulation10公告標(biāo)牌、垃圾管理計(jì)劃和垃圾記錄保存Placards.Garbagemanagementplansandgarbagerecording-keeping(1)(a)總長度為12m或以上的船舶和固定或浮動平臺均應(yīng)張貼告示以使船員和乘客知曉本附則第3、4、5和6條中適用的排放要求。Everyshipof12mormoreinlengthoverallandfixedorfloatingplatformsshalldisplayplacardswhichnotifythecrewandpassengersofthedischargerequirementsofregulations3,4,5and6ofthisAnnex,asapplicable.(b)告示應(yīng)以船員的工作語言書寫，對航行于其他本公約締約國管轄權(quán)范圍內(nèi)的港口或近海裝卸站的船舶，告示還應(yīng)以英文、法文或西班牙文書寫。Theplacardsshallbewrittenintheworkinglanguageoftheship'screwand,forshipsengagedinvoyagestoportsoroffshoreterminalsunderthejurisdictionofotherPartiestotheConvention,shallalsobeinEnglish,FrenchorSpanish.(2)所有100總噸及以上的船舶和核準(zhǔn)載運(yùn)15名或以上人員的船舶以及固定或浮動平臺，均應(yīng)備有一份船員必須遵守的垃圾管理計(jì)劃。該計(jì)劃應(yīng)就減少、收集、儲藏、加工和處理垃圾以及船上設(shè)備使用等提供書面程序，還應(yīng)指定負(fù)責(zé)執(zhí)行該計(jì)劃的人員。該計(jì)劃應(yīng)基于本組織制定的指南，并用船員的工作語言書寫。Everyshipof100grosstonnageandabove,andeveryshipwhichiscertifiedtocarry15ormorepersons,andfixedorfloatingplatformsshallcarryagarbagemanagementplanwhichthecrewshallfollow.Thisplanshallprovidewrittenproceduresforminimizing,collecting,storing,processinganddisposingofgarbage,includingtheuseoftheequipmentonboard.Itshallalsodesignatethepersonorpersonsinchargeofcarryingouttheplan.SuchaplanshallbebasedontheguidelinesdevelopedbytheOrganization2andwrittenintheworkinglanguageofthecrew.(3)在公約其他締約國管轄下的港口或近海裝卸站之間從事運(yùn)輸?shù)乃?00總噸及以上的船舶和經(jīng)核定可載運(yùn)15人或以上的船舶以及用于勘探和開發(fā)海床的固定或浮動平臺都應(yīng)配備《垃圾記錄簿》。該《垃圾記錄簿》，無論是否作為正式航海日志的一部分，還是其他形式,都應(yīng)采用本附則附錄中規(guī)定的格式：Everyshipof400tonsgrosstonnageandaboveandeveryshipwhichiscertifiedtocarry15personsormoreengagedinvoyagestoportsoroffshoreterminalsunderthejurisdictionofanotherPartiestotheConventionandeveryfixedandfloatingplatformengagedinexplorationandexploitationofthesea-bed,shallbeprovidedwithagarbagerecordbook.Thegarbagerecordbook,whetherasapartoftheship’sofficiallogbookorotherwise,shallbeintheformspecifiedintheAppendixtothisAnnex.(a)每次排放入?；蛑两邮赵O(shè)備或完成的焚燒作業(yè)都應(yīng)立即記錄在《垃圾記錄簿》中，并在焚燒或排放的當(dāng)天由負(fù)責(zé)的高級船員簽字?！独涗洸尽访坑浲暌豁摱紤?yīng)由船長簽字。《垃圾記錄簿》的每項(xiàng)記載應(yīng)至少用英文、法文或西班牙文書寫。如果這些記載也使用該船船旗國的官方語言書寫，在發(fā)生爭執(zhí)或有不同意見時，以船旗國的官方語言的記載為準(zhǔn)。Eachdischargeintotheseaortoareceptionfacility,oracompletedincineration,shallbepromptlyrecordedinthegarbagerecordbookandsignedforonthedateoftheincinerationordischargebytheofficerincharge.Eachcompletedpagepfthegarbagerecordbookshallbesignedbythemasteroftheship.TheentriesintheGarbageRecordBookshallbeatleastinEnglish,FrenchorSpanish.WheretheentriesarealsomadeinanofficiallanguageoftheStatewhoseflagtheshipisentitledtofly,theentriesinthatlanguageshallprevailincaseofadisputeordiscrepancy.(b)每次排放或焚燒的記錄都應(yīng)寫明日期與時間、船舶位置、垃圾種類和焚燒或排放垃圾的估計(jì)數(shù)量；Theentryforeachincinerationordischargeshallincludedateandtime,positionoftheship,categoryofthegarbageandtheestimatedamountincineratedordischarged;(c)《垃圾記錄簿》應(yīng)保存在船上或固定或浮動平臺上的合適的位置以使在合理的時間內(nèi)可隨時取來接受檢查?！独涗洸尽窇?yīng)自最后一次記錄日期起保存2年；Thegarbagerecordbookshallbekeptonboardtheshiporthefixedorfloatingplatform,andinsuchaplaceastobeavailableforinspectioninareasonabletime.Thisdocumentshallbepreservedforaperiodoftwoyearsfromthedateofthelastentryismadeontherecord;(d)如發(fā)生本附則第7條所指的任何排放或意外落失，垃圾記錄簿上應(yīng)予以記錄，或?qū)θ魏涡∮?00總噸的船舶，應(yīng)在該船的正式航海日志中記錄該排放或落失的地點(diǎn)、情況和原因、排放或落失的物品細(xì)目、以及為防止或盡量減少這種排放或意外落失業(yè)已采取的合理預(yù)防措施。Intheeventofanydischargeoraccidentallossreferredtoinregulation7ofthisAnnexanentryshallbemadeintheGarbageRecordBook,orinthecaseofanyshipoflessthan400grosstonnage,anentryshallbemadeintheship'sofficiallog-book,ofthelocation,circumstancesof,andthereasonsforthedischargeorloss,detailsoftheitemsdischargedorlost,andthereasonableprecautionstakentopreventorminimizesuchdischargeoraccidentalloss.(4)主管機(jī)關(guān)可以對下述船舶免除《垃圾記錄簿》要求TheAdministrationmaywaivetherequirementsforgarbagerecordbooksfor:核準(zhǔn)載運(yùn)15名或以上人員，航行持續(xù)時間為1h或以下的船舶；或Anyshipengagedonvoyagesofone(1)hourorlessindurationwhichiscertifiedtocarry15personsormore;or從事海床勘探與開發(fā)的固定或浮動的平臺。fixedorfloatingplatformswhileengagedinexplorationandexploitationofthesea-bed.(5)本公約締約國政府的主管機(jī)關(guān)，可檢查?？科涓劭诨蚪Ｑb卸站的適用本規(guī)定的任何船舶的《垃圾記錄簿》或船舶的正式航海日志，并可將記錄簿或日志中的任何記錄制成副本并要求船長證明該副本是該項(xiàng)記錄的真實(shí)副本。這種經(jīng)船長證明為船上《垃圾記錄簿》或船舶的正式航海日志中某項(xiàng)記錄的真實(shí)的副本在任何法律訴訟中應(yīng)作為該項(xiàng)記錄中所述事實(shí)的證據(jù)。主管機(jī)關(guān)根據(jù)本項(xiàng)規(guī)定對《垃圾記錄簿》或船舶的正式航海日志的檢查和制作確證無誤的副本應(yīng)盡速進(jìn)行，并不應(yīng)對船舶造成不當(dāng)?shù)难诱`。ThecompetentauthorityoftheGovernmentofaPartytotheConventionmayinspectthegarbagerecordbookorship'sofficiallog–bookonboardanyshiptowhichthisregulationapplieswhiletheshipisinitsportsoroffshoreterminalsandmaymak
